CALL TO ORDER Chairperson Joanne Krebs called the Regular Meeting to order at 7:00 p.m. on Tuesday, February 19, 2002, in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). Roll Call: Chairperson Joanne Krebs, present Vice Chairperson Lurene Lyzen, present Board Member Ken Furth, present Board Member James B. Pitts, present Board Member Greg Roero, present Board Member Greg Thompson, present Board Member Mervin Warner, present The Pledge of Allegiance followed. Chairperson Krebs asked if there would be any Agenda changes and Ms. C. Jimette Cook Enforcement Manager, Code Enforcement Division, Community Development Department advised the Board that "This evening we are happy to report that most of the cases are in compliance with the exception ofCEB-02-021." II. CONSENT CONSENT A. Approval of the January 15,2002 Regular Meeting Minutes. Chairperson Krebs requested a Motion to approve the Consent Agenda if there were no changes. "SO MOVED." MOTION BY BOARD MEMBER PITTS. SECONDED BY BOARD MEMBER THOMPSON. DISCUSSION FOLLOWED. IT WAS NOTED THAT BOARD MEMBER FURTH'S NAME WAS SPELLED INCORRECTLY ON PAGE THREE (3), SECOND PARAGRAPH, OF THE FIRST SENTENCE. III. REGULAR AGENDA The Deputy City Clerk swore in Ms. Cook, who would be providing testimony during the presentation of tonight's case. REGULAR G. CASE CEB 01-021 320 State Road 434 (Badcock Plaza) Aggarwal Pension Trust Fund Section 20-433. (Disabled Motor Vehicle) Ms. Cook asked for the record if anyone present wanted to speak on the behalf of the Aggarwal Pension Trust Fund. No one came forward. Introduced into the record by Ms. Cook was "The Statement of Violation, Notice of Hearing the proof of mailing, the proof of receipt signed by - Aggarwal" and a photograph of the vehicle. Ms. Cook requested that the Board find Aggarwal Pension Trust Fund in violation of the City Code and if they do not come into compliance in a reasonable amount of time they should be monetarily fined. Discussion followed regarding how long the vehicle had been parked in the present location; the owner of the vehicle being "Unknown"; and whether there is a provision in the City of Winter Springs' Code regarding towing abandoned vehicles. Ms. Cook addressed the Board Members regarding the process for towing vehicles; and property owners having the ability to remove vehicles. Board Member Pitts asked if the Police Department has authority to tow abandoned vehicles; and why the Police Department would not tow the vehicle. Discussion followed whether it is the responsibility of commercial property owners to have the abandoned vehicles towed or the Police Department, if the vehicle is in violation of the City Code. Ms. Cook spoke of information the Police Department provides her. Discussion. "IN THE CASE OF CODE ENFORCEMENT BOARD NUMBER 02-021 OF THE CITY OF WINTER SPRINGS, THE CODE ENFORCEMENT BOARD HAS READ THE COMPLAINT FILED AND THE WRITTEN INFORMATION AS PREPARED BY THE CODE INSPECTOR AND HEARD AT THIS MEETING, THE SWORN TESTIMONY OF THE CODE INSPECTOR. BASED UPON THESE PROCEEDINGS, I MOVE THAT AGGARWAL PENSION TRUST FUND, OF 320 STATE ROAD 434, BADCOCK PLAZA, IS IN VIOLATION OF SECTION 20- 433. [DISABLED MOTOR VEHICLE - UNLICENSED] OF THE CODE OF THE CITY OF WINTER SPRINGS, AND AN APPROPRIATE RELIEF ORDER BE ISSUED AT THIS MEETING." SECONDED BY BOARD MEMBER FURTH. DISCUSSION FOLLOWED REGARDING THE TITLE "CODE MANAGER" SHOULD REPLACE "CODE INSPECTOR". BOARD MEMBER WARNER AGREED TO THIS. AMENDED MOTION "IN THE CASE OF CODE ENFORCEMENT BOARD NUMBER 02-021 OF THE CITY OF WINTER SPRINGS, THE CODE ENFORCEMENT BOARD HAS READ THE COMPLAINT FILED AND THE WRITTEN INFORMATION AS PREPARED BY THE CODE MANAGER AND HEARD AT THIS MEETING, THE SWORN TESTIMONY OF THE CODE MANAGER. MOTION BY BOARD MEMBER FURTH. "IN THE CASE OF CODE ENFORCEMENT BOARD NUMBER 02-021 OF THE CITY OF WINTER SPRINGS, AGGARWAL PENSION FUND HAVING BEEN FOUND IN VIOLATION OF SECTION 20-433. [DISABLED MOTOR VEHICLE - UNLICENSED] OF THE CODE OF THE CITY. I MOVE THAT AGGARWAL PENSION FUND BE GIVEN FOURTEEN (14) DAYS AFTER NOTIFICATION TO COME INTO COMPLIANCE WITH REGARD TO THIS VIOLATION. IF CITY OF WINTER SPRINGS MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING - FEBRUARY 19,2002 PAGE40F5 COMPLIANCE IS NOT ACHIEVED BY THAT DATE A FINE OF $25.00 PER DAY WILL BE IMPOSED UNTIL COMPLIANCE IS ACHIEVED AS VERIFIED BY AN OFFICER OF THE CITY." SECONDED BY BOARD MEMBER THOMPSON. DISCUSSION. III. FUTURE AGENDA ITEMS Board Member James Pitts suggested that "We have to do something - to get a closer working relationship between the Law Enforcement Division of our City and Code Enforcement." Then Board Member Pitts talked about Ms. Cook not having access to information obtained by the Police Department. Ms. Cook spoke of her working relationship with the Police Department and the purpose and regulations of the National Crime Information Center (NCIC). Discussion. Board Member Pitts suggested that a representative of the Police Department "Come to us and chat with us sometime to find out how we can have a better working relationship." Board Member Ken Furth stated, "These 'Findings Of Pact' and 'Relief Orders' - we need to have them redone, up to date..." Chairperson Krebs asked if those could be done by the next Meeting? Ms. Cook replied, "We are waiting for the Attorney. We will do our best." Additionally Chairperson Krebs said to Ms. Cook, "Could you get with Debbie (Deputy City Clerk) and then have a letter sent to Anthony [Garganese, City Attorney] and have him - that we need it by next Meeting." Ms. Cook agreed to contact the City Attorney on behalf of the Board. Chairperson Krebs requested scheduling a Workshop and suggested that Attorney Garganese attend, possibly in the beginning. Chairperson Krebs spoke about the benefits that the Planning and Zoning Board/Local Planning Agency received from the City Attorney's appearance at their most recent Meeting. Then Chairperson Krebs suggested reviewing guidelines, creating, a checklist, and having a representative from the Police Department - be included in the Workshop. REPORTS Chairperson Krebs thanked Vice Chairperson Lurene Lyzen for chairing last month's Meeting. VI.
