CODE ENFORCEMENT BOARD
SPECIAL MEETING
SEPTEMBER 27,2001
I. CALL TO ORDER
Madam Chairperson Joanne Krebs called the Special Meeting to order at 7:03 p.m. on
Thursday September 27, 2001, in the Commission Chambers of the Municipal Building
(City Hall, 1126 East State Road 434, Winter Springs, Florida 32708).

II. AGENDA

Charles R. Warner ET AL c/o Theodoros & Polly Lyssiotis
Section 6-81. (Minimum Housing Standards)
The Deputy City Clerk swore in those persons who may be providing testimony during
the presentation of tonight's cases.
Ms. C. Jimette Cook, Code Enforcement Manager, Code Enforcement Division,
Community Development Department reviewed this case, past testimony and the
complaints from the tenants for the Board; displayed photographs; and referred to tenants
having been subpoenaed and in attendance.
Ms. Lisa Conti, 215 Moss Road, Winter Springs, Florida: stated "Everything's been
fixed."
Ms. Phyllis Johnson, 215 Moss Road, Winter Springs. Florida: spoke of repairs being
done in the apartment within the last month.

Discussion.
Ms. Yarda Dawkins, 209 South Moss Road, Winter Springs: informed the Board that
repairs were made to the apartment yesterday with the exception of the air conditioning
thermostat, and that the bathroom sink was being held up with sticks.
Mr. Herbert Bouey, 213 South Moss Road, Winter Springs, Florida: addressed the Board
regarding the "Patch" repaIrs made to the apartment.
Mr. Steven Shingler, 219 South Moss Road, Winter Springs, Florida: spoke of his
relationship with the property manager and that his vehicle had been towed.
Mr. Shannon Shingler, 219 South Moss Road, Winter Springs, Florida: spoke of leaks in
the ceiling from the upstairs bathroom; and no outside lighting.
Mr. Nick Chrysochos, NTC Investors Services, 419 West Lancaster Road, Orlando,
Florida: as the owner of this company, he informed the Board that he was unaware of
the numerous problems prior to the middle of August; and spoke of a State Inspection
done in the past.

Mr. Chrysochos spoke of his lack of knowledge regarding the City's notices and when he
was informed of the problems, he began the repairs.
The Board and Mr. Chrysochos discussed the City's faxes; the "Patch repairs"; meetings
with Ms. Cook; and of tenant phone calls being ignored. Discussion.
Ms. Jessica Ruez, NTC Investors Services, 419 West Lancaster Road, Orlando, Florida:
as Property Manager, she spoke of receiving a "Different fax" on May 81\ and said that
the majority of the repairs have been completed. Ms. Ruez acknowledged she received a
list from the City in May. Discussion.

Ms. Cook spoke of the list of violations being expanded in August and further stated "the
City doesn't want to punitive, the City doesn't want to be-labor the point, the City is very
glad that the corrections have been - taken place. Our goal was compliance. It took us a
little while to get here but we're glad that they have been complied with - we don't have
quite all compliance."
City Attorney Anthony A. Garganese departed the Meeting at 8:51 p.m.

The Board asked Mr. Chrysochos when the air conditioner's thermostat and the bathroom
sink at 209 Moss Road could be repaired. Mr. Chrysochos replied, "It will be fixed next
week, next Friday [October 5,2001]." Discussion.
FINDING OF FACT:
"IN THE CASE OF CODE ENFORCEMENT BOARD NUMBER CEB-01-965 OF
THE CITY OF WINTER SPRINGS, THE CODE ENFORCEMENT BOARD HAS
READ THE COMPLAINT FILED WITH THE WRITTEN INFORMATION AND
TESTIMONY AS PREPARED BY THE CODE MANAGER AND HEARD AT
THIS MEETING, THE SWORN TESTIMONY OF THE CODE MANAGER AND
OTHER PARTIES INVOL VED IN THIS CASE. BASED UPON THESE
PROCEEDINGS, I MOVE THAT CHARLES WARNER ET AL C/O
THEODOROS & POLLY LYSSIOTIS AND NTC INVESTORS OF 209-219 MOSS
ROAD ARE IN VIOLATION OF SECTION 6-81. [MINIMUM HOUSING
STANDARDS] OF THE CODE OF THE CITY OF WINTER SPRINGS, AND AN
APPROPRIATE RELIEF ORDER BE ISSUED AT THIS MEETING." MOTION
BY BOARD MEMBER FURTH. SECONDED. DISCUSSION.

RELIEF ORDER - ORDER OF THE BOARD:
"IN A CASE OF CODE ENFORCEMENT BOARD NUMBER CEB-01-965 OF
THE CITY OF WINTER SPRINGS, CHARLES WARNER ET AL C/O
THEODOROS & POLLY L YSSIOTIS AND NTC INVESTORS HAVING BEEN
FOUND IN VIOLATION OF SECTION 6-81. [MINIMUM HOUSING
STANDARDS] OF THE CODE OF THE CITY. AND I MOVE THAT CHARLES
WARNER ET AL C/O THEODOROS & POLLY L YSSIOTIS AND NTC
INVESTORS BE GIVEN UNTIL OCTOBER 5TH OF 2001 TO COME INTO
COMPLIANCE WITH REGARD TO THIS VIOLATION. IF COMPLIANCE IS
NOT ACHIEVED BY THAT DATE A FINE OF $250.00 PER DAY, PER
VIOLATION WILL BE IMPOSED UNTIL COMPLIANCE IS ACHIEVED AS
VERIFIED BY AN OFFICER OF THE CITY, AND SINCE A MEMBER OF NTC

FURTHER MOVE THAT DUE NOTIFICATION HAS BEEN GIVEN AS OF
THIS MEETING." MOTION BY BOARD MEMBER FURTH. SECONDED BY
BOARD MEMBER WARNER. DISCUSSION.

Ms. Cook stated, "For the record, the City acknowledges that apartment 209's
outstanding violation is a sink that is not properly affixed to the wall or - the vanity is
properly affixed and secured and there is an air conditioner unit that is not working
properly in that the thermostat is not working properly and that is will be repaired by
October 5th or a fine of $250.00 per, per violation."
Board Member Furth requested, "And can we in addition ask that the Code Enforcement
Managers keep a close watch on the apartment complex to see that no further violations
are obvious at least from the outside." Ms. Cook replied, "Yes sir."
Mr. Clarence Dawkins, 209 South Moss Road, Winter Springs: spoke of the aIr
conditioning unit.
III. ADJOURNMENT
Chairperson Krebs adjourned the Meeting at 9: 15 p.m.
