Please note that the tenants are responsible for obtaining Occupational Licenses for their respective shops and perhaps you would take the matter up further directly with the tenants. As regards the overgrowth in and around the retention pond at the rear of the building, we have taken care of this problem but as you are well aware the City of Winter Springs is responsible for the maintenance and upkeep as the retention pond is shared by all the surrounding property and therefore a notice of violation ought to be sent to the City of Winter Springs. In answer to your remarks concerning the occupational license of a tenant and the property owners ~~ responsibility, I am enclosing a copy of the Florida Statutes that regulate municipalities and their ccXi?- enforcement procedures. You will note that once a fine is imposed, it "shall" (which indic.1tes a mm;datory action, not a discretionary one), become a lien on \Jle property on which \Jle violation exists. In other words, the property owner is the one who will be alTected by the actions of ltis/her tenant. We always givc notice to the property owner when we are seeking relief from a tenant. In regard to the overgrowth in and around the retenlion pond, I spoke with Kip Lockcuff. Public Works Director, Kimberly Hall, Stonnwater Manager and have researched Ihe plat books on record. The retention pond was constructed to handle runoff from the impervious areas, such as the parking 101. It is your responsibility to maintain that portion of the stonnwater system. As of this date, the pond and the surrounding area is overgrown and heavily lillcrcd. Please advise when the area is in compliance and we will arrnnge for an inspection.
