CALL TO ORDER Chairperson Joanne Krebs called the meeting to order at 7:00 p.m. on Tuesday, October 17, 2000, in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). The Pledge of Allegiance followed. Jimette Cook, Code Enforcement Manager, Code Enforcement Division Approval of the September 19, 2000 Regular Meeting Minutes Chairperson Jomme Krebs stated "I am looking for a Motion to approve the September 19th Regular Meeting Minutes." "I MAKE A MOTION TO ACCEPT THE SEPTEMBER 19TH MINUTES AS WRITTEN." MOTION BY BOARD MEMBER FINNEGAN. SECONDED BY VICE CHAIRPERSON L YZEN. Jimette Cook, Code Enforcement Manager spoke briefly in reference to a decision made by this Board that was upheld and affirmed in the Circuit Court. The Deputy City Clerk swore in those persons who may be providing testimony during the presentation of this meeting's cases. Ms. C. Jimette Cook, Code Enforcement Manager, informed the Board that they would hear only two (2) cases at this meeting. The following cases would not be heard at this meeting: A. AGENDA NOTE: THE FOLLOWING AGENDA ITEMS ARE DOCUMENTED IN THE ORDER DISCUSSED .:..:. E. Case Number CEB-00-1092 614 Nighthawk Circle Key Realty Dev Inc. Section 13-2. (Untended Grass And Weeds) Code Enforcement Manager Cook introduced this case, and entered into the record the Statement of Violation and Notice of Hearing. Photographs were entered into the record indicating the overgrowth. Additionally, Code Enforcement Manager discussed that the property is not in compliance as of this date; that the Code Enforcement Division is asking for a date certain for compliance; that this is a recurring violation; that this was initiated by the City; and obtaining a finding of Non-Compliance. Discussion ensued regarding the violation process; the levying of a fine; presenting sufficient testimony; heavily wooded lots; the current condition of the property; complaints received from surrounding property owners; the regulation of laws; Code interpretation; and the determination of guidelines regarding overgrowth. FINDING OF FACT: MOTION BY BOARD MEMBER FINNEGAN. "IN THE CASE OF CODE ENFORCEMENT BOARD NUMBER 00-1092 OF THE CITY OF WINTER SPRINGS, THE CODE ENFORCEMENT BOARD HAS READ THE COMPLAINT FILED AND THE WRITTEN INFORMATION PREPARED BY THE CODE INSPECTOR, AND HEARD AT THIS MEETING, THE SWORN TESTIMONY OF THE CODE INSPECTOR. BASED UPON THESE PROCEEDINGS, I MOVE THAT KEY REALTY DEVELOPMENT, INC. OF 614 CITY OF WINTER SPRINGS MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING - OCTOBER 17,2000 PAGE40F6 NIGHTHAWK CIRCLE WINTER SPRINGS IS IN VIOLATION OF SECTION 13-2. [UNTENDED GRASS AND WEEDS] OF THE CODE OF WINTER SPRINGS, AND THAT AN APPROPRIATE RELIEF ORDER BE ISSUED AT THIS MEETING." SECONDED BY VICE CHAIRPERSON L YZEN. DISCUSSION. RELIEF ORDER - ORDER OF THE BOARD: MOTION BY BOARD MEMBER FURTH. "IN THE CASE OF CODE ENFORCEMENT BOARD NUMBER 00-1092 OF THE CITY OF WINTER SPRINGS, KEY REALTY DEVELOPMENT INC., HAVING BEEN FOUND IN VIOLATION OF SECTION 13-2. [UNTENDED GRASS AND WEEDS] OF THE CODE OF THIS CITY. I MOVE THAT KEY REALTY DEVELOPMENT BE GIVEN SEVEN (7) DAYS AFTER NOTIFICATION TO COME INTO COMPLIANCE WITH REGARD TO THIS VIOLATION. AND IF COMPLIANCE IS NOT ACHIEVED BY THAT TIME A FINE OF $25.00 PER DAY WILL BE IMPOSED UNTIL COMPLIANCE IS ACHIEVED AS VERIFIED BY AN OFFICER OF THE CITY. FURTHERMORE, ANY AND ALL FUTURE REACURRANCES OF THIS VIOLATION AFTER COMPLIANCE HAS BEEN ACHIEVED WILL AFTER DUE PROCESS CAUSE THE STATED FINE TO BE IMPOSED UNTIL COMPLIANCE IS AGAIN ACHIEVED AS VERIFIED BY AN OFFICER OF THE CITY." Case Number CEB-00-1098 112 Lisa Loop (V acant lot) L And S Dev Inc., c/o Silvestri Investments Section 13-2. (Storage Of Dirt, Trash, Debris And Building Materials On Vacant Lot) Code Enforcement Manager Cook introduced this case, noted that there was a complaint filed against this property and entered into the record the Statement of Violation and Notice of Hearing. Photographs were entered into the record indicating the overgrowth, and construction debris. Additionally, Code Enforcement Manager discussed the current condition of the site; that a dumpster is located across the street; and the Code Enforcement Manager's request for a finding of non-compliance and a possible fine. Discussion ensued regarding the length of time the debris has existed on the site; that there are no active building permits for this site; and that the correction for this violation would be to remove the trash and debris. FINDING OF FACT: MOTION BY BOARD MEMBER FINNEGAN. "IN THE CASE OF CODE ENFORCEMENT BOARD NUMBER 00-1098 OF THE CITY OF WINTER SPRINGS, THE CODE ENFORCEMENT BOARD HAS READ THE COMPLAINT FILED AND THE WRITTEN INFORMATION PREPARED BY THE CODE INSPECTOR, AND HEARD AT THIS MEETING, THE SWORN TESTIMONY OF THE CODE INSPECTOR. BASED UPON THESE PROCEEDINGS, I MOVE THAT LAND S DEVELOPMENT INC., C/O SILVESTRI INVESTMENTS, FOR THE LOT OF 112 LISA LOOP, WHICH IS A VACANT LOT IS IN VIOLATION OF SECTION 13-2. [STORAGE OF DIRT, TRASH, DEBRIS AND BUILDING MATERIALS ON VACANT LOT] OF THE CODE OF WINTER SPRINGS, AND THAT AN APPROPRIATE RELIEF ORDER BE ISSUED AT THIS MEETING." SECONDED BY BOARD MEMBER PITTS. [STORAGE OF DIRT, TRASH, DEBRIS AND BUILDING MATERIALS ON VACANT LOT] THE CODE OF THIS CITY. I MOVE THAT LAND S DEVELOPMENT INC., C/O SIL VESTRI INVESTMENTS BE GIVEN SEVEN (7) DAYS AFTER NOTIFICATION TO COME INTO COMPLIANCE WITH REGARD TO THIS VIOLATION. IF COMPLIANCE IS NOT ACHIEVED BY THAT DATE, A FINE OF $50.00 PER DAY WILL BE IMPOSED UNTIL COMPLIANCE IS ACHIEVED. AND MATERIALS BE REMOVED IN SEVEN (7) DAYS. AND FURTHERMORE, ANY AND ALL FUTURE REACURRENCES OF THIS VIOLATION AFTER COMPLIANCE HAS BEEN ACHIEVED WILL AFTER DUE PROCESS CAUSE A STATED FINE TO BE IMPOSED UNTIL COMPLIANCE IS AGAIN ACHIEVED AS VERIFIED BY AN OFFICER OF THE CITY."
