REQUEST: The Community Development Department - Planning Division requests the
Commission hold a public hearing for the second reading and adoption of
Ordinance 729 to expand the S.R. 434 Corridor New Development Overlay
Zoning District to include the 7.558 acre Wofford/Slappey property.
PURPOSE:
The purpose of this agenda item is to request the Commission hold a public hearing for the
second reading and adoption of Ordinance 729 to expand the S.R. 434 Corridor New
Development Overlay Zoning District to include the 7.558 acre Wofford/Slappey property. The
contract purchaser has indicated his willingness to abide by the New Development Overlay
Zoning District Regulations in the development of the property.
APPLICABLE LAW AND PUBLIC POLICY:
The provisions of 163.3167(11) which states "Each local government is encouraged to articulate
a vision of the future physical appearance and qualities of its community as a component of its
local comprehensive plan. The vision should be developed through a collaborative planning
process with meaningful public participation and shall be adopted by the governing body of the
jurisdiction. "
In 1995 the City Commission approved the preparation of a S.R. 434 Corridor Vision Plan that
would include a "New Development Area".

CONSIDERATIONS:
. The City Commission adopted Ordinance # 670 on July 28, 1997 creating a "New
Development Area" Overlay Zoning District.
· The City Commission adopted Ordinance 675 on December 8, 1997 to institute
the "New Development Area" Overlay Zoning District Regulations (Design
Guidelines) of the State Road 434 Corridor Vision Plan
FUNDING:
No funds are required for extension of the New Development Area Overlay Zoning
District.
FINDINGS:
. The contract purchaser representative for Winter Springs Executive Park, Inc. has
indicated their willingness to abide by the S.R. 434 Corridor Vision New
Development Area Overlay Zoning District regulations in the May 12, 1999 letter
to the City.
· The City Commission at its June 14, 1999 meeting expressed its desire that the
New Development Overlay Zoning District be extended.to include the
Wofford/Slappey property.
STAFF RECOMMENDATION:
City staff recommend that the City Commission hold a public hearing for second reading
and adoption of Ordinance 729 to expand the S.R. 434 Corridor New Development
Overlay Zoning District to include the 7.558 acre Wofford/Slappey property.

IMPLEMENTATION:
The ordinance would immediately take effect upon adoption per 166.041(4) Florida
Statutes and Section 4.15 of the City Charter.

AN ORDINANCE OF THE CITY COMMISSION
OF THE CITY OF WINTER SPRINGS, FLORIDA
AMENDING ORDINANCE 670 BY EXTENDING
THE STATE ROAD 434 CORRIDOR VISION
PLAN "NEW DEVELOPMENT AREA"
OVERLAY ZONING DISTRICT TO INCLUDE
THE 7.558 ACRE WOFFORD/SLAPPEY
PROPERTY EAST OF THE BELTWAY (S.R. 417
uTHE GREENEW AY") AND ON THE
NORTHSIDE OF S.R. 434; PROVIDING FOR
SEVERABILITY, CONFLICTS AND AN
EFFECTIVE DATE.
WHEREAS, 163.3167(11), Florida Statutes, encourages local
governments to articulated a vision of the future physical appearance and
qualities of its community. . .";
WHEREAS, the City, in accordance with 163.3167(11) F.S. has
developed a collaborative planning process with meaningful public participation
in the development of the concept and design guidelines of the S.R. 434 Corridor
Vision Plan New Development Area Overlay Zoning District;
WHEREAS, the Planning and Zoning Board/Local Planning Agency has
reviewed the concept and design guidelines for the New Development Area
Overlay Zoning District and has recommended to the City Commission adoption
of same;
WHEREAS, contract purchaser, Winter Springs Executive Park, Inc. has
agreed to abide buy the requirements of the S.R. 434 Corridor Vision Plan New
Development Overlay Zoning District regulations;
WHEREAS, The City Commission at its June 14, 1999 meeting
expressed the desire that the Wofford/Slappey property be included in the New
Development Overlay Zoning District and be subject to its requirements.
NOW, THEREFORE, BE IT ORDAINED that the City
Commission of the City of Winter Springs, Florida, as follows:
SECTION I
NEW DEVELOPMENT STANDARDS APPLlED
The State Road 434 "New Development Area" Corridor Overlay Zoning
District is amended to incorporate and to include the Wofford/Slappey property
as depicted on the accompanying map marked Exhibit A. Said property shall
'be subject to the development standards set forth in Ordinance 675, New
Development Overlay Zoning District Regulations".
SECTION I
SEVERABILITY.
If any provision or portion of this Ordinance is declared by any court of
competent jurisdiction to be void, unconstitutional, or unenforceable, then all
remaining provisions and portions of this Ordinance shall remain in full force and
effect.
SECTION ill
CONFLICTS
That all Ordinances or parts of Ordinances in conflict herewith are hereby
repealed.
SECTION IV
EFFECTIVE DATE.
This Ordinance shall immediately take effect upon adoption, with a
quorum present and voting, by the City Commission of the City of Winter
Springs, Florida, this 12th day of July 1999.

Re: Application for Annexation, Change of Land Use, and Rezoning of Parcel
located at 500 W. SR 434, approximately YI mile East of SR 417 comprising +/- 7.38 .C.
ladies and Gentlemen:
The purpose of this letter is to clarify the land use change and accompanying zoning request
for the parcel located at 500 W SR 434, approximately % mge to the East of SR 417. The
parcel has ~95' of frontage and 8 depth of -665'. C-2 zoning Is sought for the parcel as a
whole, with the Southernmost 220' limited to C-1 uses, which include retail uses and
professional offlce uses such as attorneys. florists. insurance and/or real estate agents. etc.
The proposed use for the Northern portion of the property Is -2 acres of retention pond and
wetland presetvation area, and C-2 uses such as dentists, lawyers, accountants. real estate
agents. as well 8S home servicing and repair businesses (e.g.. plumbers, electricians. pool
contractors) that do not normally have a retail storefront. The Applicant believes that C-2
uses such as auto body shops, kennefs, junkyards, flea markets. drive in theaters, and bus
terminals should be prohibited on this parcel.
As residents of the area. the Applicants are highly motivated to work with the City in its goal
of maintaining and beautifying the SR 434 corridor. AccordIngly, the applicant will follow the
spirit of the City's SR 434 Corridor VISIon Plan by providing appropriate setbacks and
landscaping along the retaH portion of the parcel. and InstalUng appropriate buffering of the
C-2 uses on the non.frontage portions of the roadway. The applicant appreciates the City's
desire to promote and maintain quality growth and development along the SR 434 corridor
and wRI cooperate with the City to ensure the parcel meets or exceeds existing development
and aesthetic standards.
This proposed development of the parcel lends itself toward support of the surrounding
Winter Springs and Oviedo communities. Namely. it is intended that the development

the surrounding residential communities. The Northern portion of the development will also
be marketed to persons currently utiljzlng a "home office" who may benefit from an office

The parcel to the West of the subject property appears to contain a private salvage yard and
auto repair facility, while the parcel to the East contains several large storage buildings and
a single family home. The Northem boundary of the subject property Is defined by an
abandoned rail line.
At present, the City does not offer utilities within the vicinity of the parcel. The Applicant
intends to Install permanent well water and septic tank systems to accommodate the first
phase of development Should the City be able to offer utilities during the future
development of a portion of the parcel, the Applicant will tie-in to the City utilities at that time.
We hope that this request wUI be received favorably by the City and look forward to a
