Mr. James Morgan
1782 Otisco Way
Winter Springs, FL. 32708
Dear Mr. Morgan,
Thank you for granting us permission to survey the location of your new shed.
Locklin & Associates performed the survey on November 3rd and for your convenience I
have enclosed a copy.
Unfortunately the results of the survey indicate that the shed encroaches into the
7.5 foot drainage and utility easement by 1.3 feet, violating Section 6-84 of the City of
Winter Springs Code of Ordinances which states: "No buildinq shall be constructed or
placed on an easement."
This would be an appropriate time to bring the shed into compliance with all
provisions of theTuskawilla unit 14B final development plan standards by meeting the
required setbacks for accessory structures (a minimum of 10' from the side property line
and a minimum of 7.S'from the rear property line).
To avoid any code enforcement action by the City the relocation needs to be
accomplished on or before December 18,1998.
Thank you for your attention to this matter.

REF: Morgan Variance Request
Dear Mr. Hanratty:
In response to your letter of November 24, 1998 to City Attorney Robert Guthrie
requesting an extension of time for the above referenced code violation, please
be advised that I am granting an extension of time to January 22, 1999.
Additionally, please be advised that I do not desire to extend this matter beyond
this time. I think itis in the best interest of everyone to bring this matter to close
as quickly as possible. If it were not for the fact that your client has only recently
engaged you in this matter and the impending Holiday Season, I would not be
recommending this extension.
The City Attorney and I will be happy to do whatever we can to assist you in
resolving this matter in the most expeditious manner possible.
Sincerely,
y~~ ~r-r

Re: 1782 Otisco Way
Jimmette,
Here is the complete file on the shed at the above address that encroaches into a
7.5' side yard utility easement and the 10' side yard setback of that subdivision.
Included is a survey that the city paid to have prepared because on the submitted
plans inadvertently noted that the shed must comply with a 7.5' side yard setback.
The survey revealed that the shed is only 6.2' off the side lot line.
Please initiate the necessary code enforcement to accomplish relocating the shed
outside of the 10' side yard setback requirement.
Thanks,
Don
