CODE ENFORCEMENT BOARD
JANUARY 19,1999 - REGULAR MEETING
I. CALL TO ORDER
Pledge of Allegiance
The meeting was called to order at 7:00 p.m. on Tuesday, January 19, 1999, by
Chairperson Joanne Krebs in the Commission Chambers of the Municipal Building (City
Hall, 1126 East State Road 434, Winter Springs, Florida 32708). The Pledge of
Allegiance followed.

Approval of the October 20, 1998 Regular Meeting Minutes
"I make a Motion to approve the October 20th (1998) minutes". Motion by
Jacqueline Adams. Seconded by Paul Finnegan. It was agreed that the Motion to
adopt the minutes of October 20, 1998 was carried by consensus of the Board.
Motion passed.
Approval of the December 8,1998 Special Meeting Minutes
There was a Motion to Table the approval of these minutes, as there were not
enough members at tonight's meeting that had also been in attendance at the
December 8, 1998 Special Meeting. Motion by Lurene Lyzen. Seconded by Chuck
Holzman. With consensus of the Board, the Motion To Table was carried.
Approval of the December 15, 1998 Regular Meeting Minutes
"I make a Motion to approve the minutes of December 15, 1998". Motion by Paul
Finnegan. Seconded by Chuck Holzman. Discussion. Vote: Jacqueline Adams:
Aye; Paul Finnegan: Aye; Chuck Holzman: Aye; Lurene Lyzen: Aye; Joanne
Krebs: Abstain. Motion passed.

were "In Compliance" and these cases would not need to be heard tonight:

Officer Cook then explained that since the owner of the (following) property did not
receive notification on time, the (following) case would not be heard tonight.

Officer Cook next briefly discussed the following case which came into compliance this
week, along with a statement prepared by the Neilson's (see Attachment A), which was
read to the Board (for the record):

the presentation of tonight's cases.

Code Enforcement Officer Cook discussed the first of two cases that would be heard
tonight:
B. Case #CEB-98-1032
Ronald Huggins
Tenant: Jerry Counelis
Location: 735 Ridgewood Way
Section 20-433., Disabled Motor Vehicle
Ms. Cook asked if there was anyone in the audience representing the owner or the tenant,
and there was no reply. Ms. Cook then explained to the Board that neither "The tenant
nor the owner would accept service on this case, which was why we couldn't hear it last
month". Officer Cook explained what is outlined in the Florida Statutes, and what in fact
has been done regarding this case, and then stated that "The City is looking for a Finding
Of Fact that they are indeed in Non-Compliance and a fine of $50.00 a day".
Other details related to this case were next discussed, including the documentation of
attempted mail delivery, and the lack of cooperation by the owner and the tenant.
FINDING OF FACT:
In the case of Code Enforcement Board Number 98-1032 of the City of Winter
Springs, the Code Enforcement Board has read the complaint filed and the written
information prepared by the Code Inspector, and heard at this meeting, the sworn
testimony of the Code Inspector. Based upon these proceedings, I move that
Ronald Huggins (Tenant: Jerry Counelis) of (735 Ridgewood Way) is in
violation of Section 20-433. [Disabled Motor Vehicle] of the Code of Winter
Springs, and that an appropriate relief order be issued at this meeting".
Motion by Lurene Lyzen. Seconded. Discussion. Vote: Chuck Holzman: Aye;
Lurene Lyzen: Aye; Joanne Krebs: Aye; Jacqueline Adams: Aye; Paul Finnegan:
Aye. Motion passed.
AMENDED RELIEF ORDER - ORDER OF THE BOARD:
"In the case of Code Enforcement Board Number 98-1032 of the City of Winter
Springs, Ronald Huggins (Tenant: Jerry Counelis) having been found to be in
violation of Section 20-433. [Disabled Motor Vehicle] of the Code of the City, I
move that Ronald Huggins (Tenant: Jerry Counelis) be given ten (10) days to
come into compliance with regard to this violation. If compliance is not achieved
by that date, a fine of $50.00 per day, will be imposed, until the compliance is
achieved as verified by an officer of the City. Furthermore, any and all future
reoccurrence of this violation, after compliance has been achieved, will
immediately cause the stated fine to be imposed until compliance is again
achieved, as verified by an officer of the City".

Ms. Cook then presented the second and final case of the evening:
G. Case #CEB-98-1183
Aggarwal Trust Fund
Tenant: Jaimadad, Inc.
Location: 370 East State Road 434
Section 10-26., No Occupational License
Officer Cook explained that this business which is listed as a WholesalelRetail Bakery,
still needs to complete the paperwork for a City Occupational License, provide a
certificate from the Board of Health, and provide payment for fees.
Officer Cook advised the Board that "What the City is asking for is a Finding Of Non-
Compliance, and a Date Certain". Discussion.
(AMENDED) FINDING OF FACT:
"In the case of CEB 98-1183 of the Code of Winter Springs, the Code
Enforcement Board has read the complaint filed and the written information
prepared by the Code Inspector, and heard at this meeting, the sworn testimony of
the Code Inspector. Based upon the proceedings, I move that Aggarwal Trust
Fund (Tenant: Jaimadad, Inc.) of (370 East State Road 434) et aI, is in
violation of Section 10-26. [No Occupational License] of the Code of Winter
Springs, and that an appropriate relief order be issued at this meeting".
Motion by Paul Finnegan. Seconded by Chuck Holzman. Discussion. Vote:
Jacqueline Adams: Aye; Joanne Krebs: Aye; Lurene Lyzen: Aye; Chuck
Holzman: Aye; Paul Finnegan: Aye. Motion passed.
(AMENDED) RELIEF ORDER - ORDER OF THE BOARD:
"In the case of CEB 98-1183 of the Code of Winter Springs, Aggarwal Trust
Fund (Tenant: Jaimadad, Inc.) having been found in violation of Section 10-
26. [No Occupational License] of the Code of Winter Springs, I move that
Aggarwal Trust Fund, i.e. Tenant: Jaimadad, Inc. be given twelve (12) days
to come into compliance, and/or February 1st, with regard to this violation. If
compliance is not achieved by that date, a fine of $100.00, per day, will be
imposed, until compliance is achieved, as verified by the Officer of the City.
Furthermore, any and all future reoccurrence of this violation after compliance has
been achieved, will immediately cause the stated fine to be imposed until
compliance has been again achieved, as verified by the Officer of this City".

Officer Cook stated that she would check tomorrow regarding the status of the Certificate
from the Board of Health
III. DISCUSSION OF GENERAL ISSUES
Chairperson Krebs announced to the Board that Board Member and former Chairman
Ken Haines had just submitted his resignation from the Code Enforcement Board. She
then read his letter of resignation into the record (see Attachment B). Discussion.
Chairperson Krebs added that "He really has been a good citizen - he served our City
well!."
III. ADJOURNMENT
The meeting was adjourned at 7:29 p.m.
