CALL TO ORDER Pledge of Allegiance The meeting was called to order at 7:00 p.m. on Tuesday, December 15, 1998, by Vice Chairperson Lurene Lyzen in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). The Pledge of Allegiance followed. Roll Call Joanne Krebs, Chairperson, absent Lurene Lyzen, Vice Chairperson, present Jacqueline Adams, present Paul Finnegan, present Ken Haines, absent Chuck Holzman, present Doug Reid, present Also Present Jimette S. Cook, Code Enforcement Officer Approval of the October 20, 1998 Regular Meeting Minutes The minutes from this meeting could not be approved, as there were not enough Board Members at tonight's meeting, that had also been in attendance at the October 20, 1998 Regular Meeting. Approval of the December 8, 1998 Special Meeting Minutes These minutes could also not be approved, as there were again not enough members at tonight's meeting, that had been in attendance at the December 8, 1998 Special Meeting. II. REGULAR AGENDA Code Enforcement Officer Jimette S. Cook first advised the Board that the following cases were "In Compliance" - therefore, these cases would not need to be heard tonight: B. Case #CEB-98-1124 Dannie Fischer Tenant: Julie Gray Location: 413 David Street Section 20-433., Disabled Motor Vehicle (Unlicensed) MINUTES CODE ENFORCEMENT BOARD DECEMBER 15, 1998 - REGULAR MEETING PAGE 3 OF 5 Officer Cook next explained that she would be presenting two cases this evening, and Ms. Cook promptly began with the following case: A. Case #CEB-98-927 Eric D. Kay Location: 13 Elkwood Court Section 20-433., Disabled Motor Vehicle The Deputy City Clerk swore in those persons who may be providing testimony during the presentation of tonight's cases. Regarding the first case, Code Enforcement Officer Cook stated for the record, "That nobody showed up, although we did get proof of delivery back". A photograph of the disabled car on this property was passed amongst the Board Members, and Ms. Cook explained that there were at one time, seven (7) disabled cars on this property, and that just this week, a number of them had been moved. Ms. Cook advised the Board, that "The City would like a Finding of Non-Compliance for this property, and a date certain of the fine to begin. 1'd like to give them another ten days, just to make sure that, since they are not here this evening, give them ten (10) days, and then a fine of fifty ($50.00) dollars a day be imposed". There was further discussion about the status of disabled vehicles, and some of the details of this case. FINDING OF FACT: "In the case ofCEB Case Number 98-927 of the City of Winter Springs, the Code Enforcement Board has read the complaint filed and the written information prepared by the Code Inspector, and heard at this meeting, the sworn testimony of the Code Inspector. Based on these proceedings, I move that owner Eric D. Kay (of 13 Elkwood Court) is in violation of Section 20-433. of the Code of the City of Winter Springs, and that an appropriate Relief Order be issued at this meeting". Motion by Chuck Holzman. Seconded. Discussion. Vote: Paul Finnegan: Aye; Jacqueline Adams: Aye; Chuck Holzman: Aye; Doug Reid: Aye; Lurene Lyzen: Aye. Motion passed. RELIEF ORDER - ORDER OF THE BOARD: "In the case of CEB 98-927 of the City of Winter Springs, Eric D. Kay having been found in violation of Section 20-433. of the Code of the City, I move that Eric D. Kay be given ten (10) days to come into compliance with regard to this violation. If compliance is not achieved by this date, a fine of fifty ($50.00) dollars will be imposed - the fifty ($50.00) dollars per day, until compliance is achieved and verified by the Officer of the City. Furthermore, any and all further reoccurences of this violation, after compliance has been achieved will MINUTES CODE ENFORCEMENT BOARD DECEMBER 15,1998 - REGULAR MEETING PAGE 4 OF 5 immediately cause the stated fine to be imposed until compliance is achieved, as verified by the Officer of the City". Motion by Paul Finnegan. Seconded by Chuck Holzman. Discussion. Vote: Chuck Holzman: Aye; Lurene Lyzen: Aye; Doug Reid: Aye; Jacqueline Adams: Aye; Paul Finnegan: Aye. Motion passed. Ms. Cook then presented the second and final case ofthe evening: 1. Case #CEB-98-1 054 Christopher & Marie L. Arce Location: 116 Cory Lane Section 20-433., Disabled Motor Vehicle Code Officer Cook began this case by explaining the parking lot situation at this apartment quadrap1ex, and stated for the record, "That there's nobody here in the audience to speak on behalf of the Arces' (Christopher and Marie), that live in Arlington, Virginia". Further details about this case were explained to the Board, along with an approximate timeline of the violations and related inspections. Ms. Cook told the Board, that the City is "Asking for a Finding of Non-Compliance and a fine to start with a date certain of about ten (10) days. That gives me time to get the people in Virginia noticed - and get their attention that yes, you may live in Virginia, but you still have some responsibility to the City, and also to your tenants". Furthermore, there was some discussion about the (VIN) Vehicle Identification Number of this vehicle (which is obscured); the status of the parking lot of this building; abandoned cars; imposing a lien on this property; and the management of apartments in general. (AMENDED) FINDING OF FACT: "In the case ofCEB 98-1054 of the City of Winter Springs, the Code Enforcement Board has read the complaint filed and the written information prepared by the Code Inspector, and heard at this meeting, the sworn testimony of the Code Inspector. Based upon these findings, I move that Christopher and/or Marie L. Arce (address of: 116 Cory Lane and other address is in the State of Virginia) are in violation of Section 20-433. of the Code of the City of Winter Springs, and that an appropriate Relief Order be issued at this meeting". Motion by Paul Finnegan. Seconded by Chuck Holzman. Discussion. Vote: Jacqueline Adams: Aye; Doug Reid: Aye; Paul Finnegan: Aye; Chuck Holzman: Aye; Lurene Lyzen: Aye. Motion passed. MINUTES CODE ENFORCEMENT BOARD DECEMBER 15, 1998 - REGULAR MEETING PAGE 5 OF 5 RELIEF ORDER - ORDER OF THE BOARD: "In the case of CEB 98-1054 of the City of Winter Springs, Christopher & Marie L. Arce having been found to be in violation of Section 20-433. of the Code of the City, I move that Christopher & Marie L. Arce be given ten (10) days to come into compliance with regard to this violation. If compliance is not achieved by that date, a fine of fifty ($50.00) dollars will be imposed per day, until compliance is achieved as verified by the Officer of the City. Furthermore, any and all further reoccurences of this violation, after compliance has been achieved will immediately cause the stated fine to be imposed until compliance is again achieved, as verified by the Officer of the City". Motion by Jacqueline Adams. Seconded by Chuck Holzman. Discussion. Vote: Doug Reid: Aye; Jacqueline Adams: Aye; Lurene Lyzen: Aye; Chuck Holzman: Aye; Paul Finnegan: Aye. Motion passed. III. DISCUSSION OF GENERAL ISSUES Board Member Finnegan asked Ms. Cook about the status of revised Ordinance Number 711 which was on the Agenda for the December 14, 1998 (the previous evening's) City Commission Meeting. Officer Cook briefly explained what some of the revisions to this Ordinance involve, along with the intent of this Ordinance. III.
