PledJ!e of AlleJ!iance The meeting was called to order at 7:00 p.m. on Tuesday, September 16, 1997, by Chairman Haines in the Municipal Building (City hall, 1126 East State Road 434, Winter Springs, Florida). The Pledge of Allegiance followed. 2. Roll Call Also Present Ken Haines, Chairman, present Bob Gray, present Anne Schneider, present Marc Clinch, present Kitty Reilly, present Lurene Lyzen, present Joanne Krebs, present Captain Bob Pieper, Code Enforcement Officer A1 White, Code Inspector 3. Approval of the AUJ!Ust 19. 1997 ReJ!Ular Meetinl!: Minutes Page 10, spelling error: minis. Correction: menace. Motion by Lyzen, and seconded by Reilly. Motion carried to approve the minutes as corrected. 4. Discussion of Closed and Pendinl!: Cases Reilly asked about the PEl signs in the Highlands. White explained that the Building Department will not issue a permit; therefore, the signs will need to come down or the case will be brought to the Code Enforcement Board in October. 5. Case #97006706. 601 Pearl Road Section 13-2(b) Trash in Yard Owner: Gordon L. Andrews MortJ!ae:ee: Bank of America White stated that the case was corrected; therefore, will not be presented. 6. Case #97013893. 466 Lancers Drive Section: 9-374 Postinl!: of Numbers Owner: Mvriam Mora Mortl!:ae:ee: Temple-Inland Mortl!:ae:e White stated that the case was corrected; therefore, will not be presented. 7. Case #97014297. 639 Pearl Road Section: 13-2fc) Untended Grass and Weeds Owner: Louis & Frances RodriJ(uez Mortllallee: Homeside Lendinlllnc./ BancBoston White stated that the case was corrected; therefore, will not be presented. 10. Case #97015195. 236 Buttonwood Section 20-431 Commercial Vehicle Owner: James P. & Brenda R. Miller Mortlllll!:ee: Transamerica RE Tax Service-Tape Pieper presented the case. No witnesses were present. As of this date, the problem has not been corrected. White was swom in for testimony, then he circulated photos of the vehicle, and provided testimony. Discussion. (Finding of Fact) Motion: In the case of CEB# 97015195 of the City of Winter Springs, the Code Enforcement Board has read the complaint filed and the written information prepared by the Code Inspector, and heard at this meeting the swom testimony of the Code Inspector. Based upon these proceedings, I move that James P. and Brenda R. Miller of 236 Buttonwood and Transamerica RE Tax Service-Tape are in violation of Section 20-431 of the Code of the City of Winter Springs, and that an appropriate Relief Order be issued at this meeting. Motion by Lyzen. Second by Gray. Vote: Reilly, aye; Clinch, aye; Schneider, aye; Lyzen, aye; Gray, aye; Haines, aye; Krebs, aye. Motion passed. (Relief Order) Motion: In the case ofCEB# 97015195 of the City of Winter Springs, James P. and Brenda R. Miller and Transamerica RE Tax Service-Tape having been found to be in violation of Section 20- 431 of the Code of this City, I move that James P. and Brenda R. Miller and Transamerica RE Tax Service-Tape be given (5) five days to come into compliance with regard to this violation. If compliance is not achieved by that date, a fine of $50.00 will be imposed per day for each violation until compliance is achieved, as verified by an officer of the city. Furthermore, any and all future recurrence(s) of this violation after compliance has been achieved will immediately cause the stated fine to be imposed until compliance is again achieved, as verified by an officer of the City. Motion by Krebs. Second by Reilly. Discussion. (Relief Order) Amended Motion: In the case of CEB# 97015195 of the City of Winter Springs, James P. and Brenda R. Miller and Transamerica RE Tax Service-Tape having been found to be in violation of Section 20-431 of the Code of this City, I move that James P. and Brenda R. Miller and Transamerica RE Tax Service-Tape be given (5) five days to come into compliance with regard to this violation. Case #97013585. 225 Mockine:bird Lane Section 20-411 Boat and Traner Owner: Robert T. And Lisa L. Rnev Morte:ae:ee: Transamerica RE Tax Serv- Tape White stated that the case was corrected; therefore, will not be presented. 12. Adjournment Jenkins, the recording secretary, introduced Andrea Lorenzo-Luaces, the new Deputy City Clerk.
