Call to Order This board meeting was called to order by Chairperson Schneider at 7:00 p.m. in the Municipal Building, 1126 East S.R. 434, Winter Springs, Florida. 2. Plede:e of Allee:iance 3. Roll Call Also Present Bob Gray, present Anne Schneider, Chairperson, present Ken Haines, present Kitty Reilly, absent Chuck Holzman, present Bob Amato, present Lurene Lyzen, present Captain Bob Pieper, Code Enforcement Officer AI White, Code Enforcement Inspector 4. Approval of the Mav 20. 1997 Ree:ular Meetine: Minutes Moved, seconded, and carried to approve the minutes as written. Approval of the June 3. 1997 Special Meetine: Minutes Moved, seconded, and carried to approve the minutes as written. 5. Discussion of Closed and Pendine: Cases Lyzen asked about Case #'s 97008850, 97008851, 97008852, 97008853, 97008856, and 97008857. White said that he would have to review the cases and get back with the board. Witnesses were sworn in for testimony. 6. Case #97004614............................................0wner: David R. and Terri L. Buzzella 761 Bear Creek Circle Mortgagee: SunTrust Morte:ae:e Inc. Section: 4-1 '20.25) Barkine: Doe: Captain Pieper presented the case. White distributed an update, and provided testimony. Mr. and Mrs. Femando Menendez were swom in for testimony. Fernando Menendez, 763 Bear Creek Circle, provided testimony. David Buzzella and Terri Buzzella of 761 Bear Creek Circle also provided testimony. The Chair called a five minute recess. The meeting reconvened at 9: 10 p.m. (Finding of Fact) Motion: In the case of CEB# 97004614 of the City of Winter Springs, the Code Enforcement Board has read the complaint filed and the written information prepared by the Code Inspector, and heard at this meeting the swom testimony of the Code Inspector, and other parties involved in this case. Based upon these proceedings, I move that David R. and Terri L. MINUTES CODE ENFORCEMENT BOARD JUNE 17, 1997 - REGULAR MEETING PAGE 2 OF 4 Buzzella of 761 Bear Creek Circle are in violation of Section(s) 4-1 (20.25) of the Code of the City of Winter Springs, and that an appropriate Relief Order be issued at this meeting. Motion by Lyzen. Second by Gray. Vote: Holzman, aye; Lyzen, aye; Amato, aye; Schneider, nay; Haines, nay; Gray, aye. Motion passed. (Relief Order) Motion: In the case of CEB# 97004614 of the City of Winter Springs, David R. and Terri L. Buzzella having been found to be in violation of Section(s) 4-1 (20.25) of the Code of this City, I move that David R. and Terri L. Buzzella shall come into compliance with regard to this violation. If compliance is not achieved immediately, a fine of twenty-five dollars ($25.00) will be imposed per day for each violation until compliance is achieved, as verified by an officer of the city. Furthermore, any and all future recurrence(s) of this violation after compliance has been achieved will immediately cause the stated fine to be imposed until compliance is again achieved, as verified by an officer of the City. Since David R. and Terri L. Buzzella are present and has heard the Order of this board, I further move that due notification has been given as of this meeting. Motion by Lyzen. Second by Gray. Inc. 614 South Ede:emon Avenue Mortqaqee: Fleet Morte:ae:e Corp. Section: 20-411 Boat and Traller White stated that the case had been corrected; therefore, was not going to be presented. 8. Case ##97009010.................................................0wner: NTC Inv. Services 209 South Moss Road (includes: 211.213.215.217.219 S. Moss Rd) Section: 13-3 Fallure to keep up property White stated that the case had been corrected; therefore, was not going to be presented. 9. Case ##97005312............................................ Owner: Richard D. Carlson 101 Garden Drive (includes: 111 and 121 Garden Drive) Section: 13-2'b) Rotted Fence Manaqement Co: Mark Manaqement (Meridvth Kanae:er) White stated that the case had been corrected; therefore, was not going to be presented. 10. Case ##97005985.............................................. Owner: Woodrow M. & Sandra Bere:man 201 Sherry Avenue Section: 4-2. More than two (2) doe:s Captain Pieper presented the case, and distributed copies of a letter from Mrs. Woodrow M. Bergman (Sandra) dated June 10, 1997. Inspector White and Sandra Bergman, 201 Sherry Avenue provided testimony. The Captain also read City Code 4-2, and informed Bergman to seek consent from the City Commission to contain more than two (2) dogs in her home. MINUTES CODE ENFORCEMENT BOARD JUNE 17, 1997 - REGULAR MEETING PAGE 3 OF 4 (Finding of Fact) Motion: In the case of CEB# 97005985 of the City of Winter Springs, the Code Enforcement Board has read the complaint filed and the written information prepared by the Code Inspector, and heard at this meeting the swom testimony of the Code Inspector, and other parties involved in this case. Based upon these proceedings, I move that Woodrow M. And Sandra Bergman of 20 1 Sherry Avenue are in violation of Section(s) 4-2 ofthe Code of the City of Winter Springs, and that an appropriate Relief Order be issued at this meeting. Motion by Haines. Seconded by Lyzen. Vote: Amato, aye; Holzman, aye; Lyzen, aye; Schneider, aye; Gray, aye; Haines, aye. Motion passed. (Relief Order) Motion: In the case ofCEB# 97005985 of the City of Winter Springs, Woodrow M. And Sandra Bergman having been found to be in violation of Section(s) 4-2 of the Code of this City, I move that, Woodrow M. And Sandra Bergman, upon due notification, be given until September 16, 1997 to come into compliance with regard to this violation. If compliance is not achieved by that date, a fine of fifty dollars ($50.00) will be imposed per day until compliance is achieved, as verified by an officer of the city. Furthermore, any and all future recurrence(s) of this violation after compliance has been achieved will immediately cause the stated fine to be imposed until compliance is again achieved, as verified by an officer of the City. Since Sandra Bergman is present and has heard the Order of this board, I further move that due notification has been given as of this meeting. Motion by Haines. Seconded by Amato. Owner: James Daniel 625 Marni Drive Mortaaaee: Norwest/lllinois Section: 4-1 (20.25) Barkine: Doe: Captain Pieper presented the case. White distributed an update, and circulated a letter from a neighbor of James Daniel. Lyzen abstained from the case. John Daniels of 625 Mami Drive and the code inspector provided testimony. Daniels stated that they have three dogs, and Amato informed Daniels of an ordinance which allows only two dogs and two cats. (Finding of Fact) Motion: In the case of CEB# 97000935 of the City of Winter Springs, the Code Enforcement Board has read the complaint filed and the written information prepared by the Code Inspector, and heard at this meeting the swom testimony of the Code Inspector, and other parties involved in this case. Based upon these proceedings, I move that James Daniel of 625 Marni Drive and NorwestJlllinois are in violation of Section(s) 4-1 (20.25) of the Code of the City of Winter Springs, and that an appropriate Relief Order be issued at this meeting. If compliance is not achieved by that date, a fine of fifty dollars ($50.00) will be imposed per day until compliance is achieved, as verified by an officer of the city. Daniels asked for copies of the cases documents, and Pieper explained that he needed to contact White to make his request. 12. Minutes submitted by: Martha Jenkins, Deputy City Clerk CITY OF WINTER SPRINGS ORDER OF THE CODE ENFORCEMENT BOARD IN RE: CASE NUMBER 97000935 HAND DELIVERY OWNER OF RECORD: JAMES DANIEL 625 MARNI DRIVE, WINTER SPRINGS, FL 32708 CER T #P226024173 MORTGAGEE: NORWEST/ILLINOIS 3200 ROBBINS ROAD, SPRINGFIELD, IL 62704-6560 The Code Enforcement Board of the City of Winter Springs, Florida, sat in hearing on June 17, 1997 in the matter of James Daniel and Norwest/Illinois to determine whether they are in violation of Section 4-1 (Barking Dog) of the Codes of the City of Winter Springs, Florida (20.25, Seminole County, Florida). Upon hearing all evidence on the matter, the Board arrived at the following: James Daniel and Norwest/Illinois are in violation of Section 4-1 of the Code of the City of Winter Springs (20.25, Seminole County). ORDER OF THE BOARD James Daniel and NorwestlIllinois having been found to be in violation of Section 4-1 of the Code of this City (20.25, Seminole County), shall be given five (5) days after notification to come into compliance with regard to this violation. If compliance is not achieved by that date, a fine of$50.00 will be imposed per day until compliance is achieved, as verified by an officer of the city. Furthermore, any and all future recurrence(s) of this violation after compliance has been achieved will immediately cause the stated fine to be imposed until compliance is again achieved, as verified by an officer of the City.
