CODE ENFORCEMENT BOARD
MAY 21, 1996 -- REGULAR MEETING
1. Call to Order
Chairperson Schneider called the meeting to order at 7:00 p.m. in the Commission Chambers, Winter
Springs Municipal Building.

4. Approval of the Minutes of March 19. 1996.
Chairperson Schneider asked for comments or discussions regarding the minutes. Hearing no
discussion or comments, the chair stated that the minutes stand approved as read.
Motion: Accept the minutes as written.
Motion by Lyzen. Second by Gray.
Vote: Gray, aye; Schneider, aye; Lyzen, aye; Amato, aye.
Motion carried.
5. Discussion of Closed and Pending Cases.
There was no discussion of closed and pending cases.
There was a lady present who had filed a complaint. Chairperson Schneider explained to her that her
case was not on the agenda, and by the rules of due process the case could not be discussed. Captain
Pieper stated that there was not an investigation to present. The lady could get with White to start
due process and get the information prepared to either resolve the violation or bring it to the attention
of the board at the next meeting. White obtained the lady's name and number.
Captain Pieper stated there were witnesses present for Items 9 and 12. Item #'s 7, 11, 13, 14 have
been resolved and corrected so the cases will not be presented. He asked that Item #9 be moved to
the top of the order, followed by Item # 12. Chairperson Schneider stated that the procedure is
customary.
Witnesses were sworn in for testimony.

6. Case #95012489.309 Birch Terrace. William C. & Jeanette Crowthers. Jr..
Section 13-2(c) Untended Grass and Weeds. Mortgagee: Source one Mortgage Service
Corp.
White distributed an update on the case. Captain Pieper presented the case. White gave testimony.
Discussion.
Finding of Fact: William C. and Jeanette Crowthers, Jr. of 309 Birch Terrace, and Source One
Mortgage Service Corporation are in violation of Section 13-2( c) of the Codes of the City of Winter
Springs.
Motion by Lyzen. Second by Amato.
Vote: Schneider, aye; Lyzen, aye; Amato, aye; Gray, aye.
Motion carried.
Relief Order: In the case ofCEB#95012489 of the City of Winter Springs, William C. and Jeanette
Crowthers, Jr., and Source One Mortgage Service Corporation having been found to be in violation
of Section 13-2(c) of the Codes of this City, shall be given ~ days, upon due notification by this
board, to come into compliance with regard to this violation. If compliance is not achieved by that
date, a fine of$ 75.00 will be imposed per day until compliance is achieved, as verified by an officer
of the City. Furthermore, any and all future recurrence(s) of this violation after compliance has been
achieved will immediately cause the stated fine to be imposed until compliance is again achieved, as
verified by an officer of the City.

Section 20-411 Boat & Trailer. Mortgagee: Countrywide Funding Corp.
This case was not presented as previously stated under Item #5.
8. Case #95014469.224 Shore Road. John J. & Paula P. Pichon
Section 13-2(c) Untended Grass and Weeds. Mortgagee: Navy Federal Credit Union
White distributed an update. Captain Pieper presented the case. White showed the members of the
board a photo of 224 Shore Road taken this date. White also gave testimony. Discussion.
Findinl! of Fact: John J. and Paula P. Pichon of224 Shore Road and Navy Orlando Credit Union
are in violation of Section 13-2(c) of the Codes of the City of Winter Springs.

Relief Order: In the case of CEB#950 14469 of the City of Winter Springs, John 1. & Paula P.
Pichon and Navy Orlando Credit Union having been found to be in violation of Section 13-2(c) of
the Codes of this City, shall be given ~ days, upon due notification by this board, to come into
compliance with regard to this violation. If compliance is not achieved by that date, a fine of $ 50.00
will be imposed per day until compliance is achieved, as verified by an officer of the City.
Furthermore, any and all future recurrence(s) of this violation after compliance has been achieved will
inunediately cause the stated fine to be imposed until compliance is again achieved, as verified by an
officer of the City.
Motion by Lyzen. Second by Schneider.

9. Case #96007182. 8 Algiers Avenue. Frannmilk M. & Rebecca Caricote
Section 4-1 Barking Dog. Mortgagee: SunTrust Mortgage. Inc.
White distributed updates on the case. Captain Pieper presented the case. White gave his testimony.
Discussion.
Charles Kelly of6 Algiers and Doug Reid of7 Algiers gave their testimony. Kelly played a cassette
tape recording of the dogs barking. The witnesses stated that there are 3 medium dogs and 1 little
dog. Captain Pieper said White will start an investigation on Section 4-2 (in excess of two dogs) of
the City codes tomorrow.
Ji'indilU! of Fact: Frannmilk M. and Rebecca Caricote of 8 Algiers Avenue, and SunTrust Mortgage,
Inc. are in violation of Section 4-1 of the Code of the City of Winter Springs, and Section 20.25 of
the Code of Seminole County, Florida.
Motion by Lyzen. Second by Gray.

Relief Order: In the case of CEB#96007182 of the City of Winter Springs, Frannmilk M. and
Rebecca Caricote and Sun Trust Mortgage, Inc. having been found to be in violation of Section 4-1
of the Code of this City, and Section 20.25 of the Code of Seminole County, shall be given .-l days,
upon due notification by this board, to come into compliance with regard to this violation. If
compliance is not achieved by that date, a fine of $ 100.00 will be imposed per day for each
violation until compliance is achieved, as verified by an officer of the City. Furthermore, any and all
future recurrence(s) of this violation after compliance has been achieved will immediately cause the
stated fine to be imposed until compliance is again achieved, as verified by an officer of the City.

Kelly asked if it is a violation each time the dogs bark or each time they have four dogs. Chairperson
Schneider said that the Ordinance 4-1 "Barking Dogs" is the violation. Captain Pieper stated that
there will be a relief order on file. If a complaint is made to the Police Department that a violation
of this ordinance is occurring, the code inspector will be notified of the violation and that starts the
fine clock ticking. Each 24 hour period that the Police Department get's a complaint and it's verified
as valid, then a fine will be accessed.
Reid asked if he could get a copy of the ordinance which states how many dogs one can have.
Captain Pieper gave him a copy of the ordinance.
10. Case #96007392. 13 Elkwood Court. Eric D. Kay
Section 13-2(c) Untended Grass and Weeds. Mortgagee: American Home Funding
White distributed updated documentation on the case. Captain Pieper presented the case. White
gave his testimony. Discussion.

of Section 13-2(c) of the Code of the City of Winter Springs.

Captain Pieper presented the case. He stated that the relief order issued in November did not include
future violations. White distributed an update and passed around pictures of the stagnant pool. White
gave his testimony. Captain Pieper showed the board members additional photos. Discussion.
Thomas Towner of 1020 NW 125th Avenue in Ocala gave his testimony. Discussion.
Filldill!! of Fact: Thomas 1. Towner of733 Woodhaven Drive, and Mortgagees: Boatmen National
Mortgage and First American RE Tax Service are in violation of Sections 13-2( d), 6-217, and
recurring violations of Sections 13-2 (b) and ( c) of the Codes of the City of Winter Springs.

,Relief Order: In the case ofCEB#95014668 of the City of Winter Springs, Thomas 1. Towner and
Mortgagees: Boatmen National Mortgage and First American RE Tax Service having been found to
be in violation of Sections 13-2(d), 6-217, and recurring violations of Sections 13-2 (b) and (c) of the
Codes of this City and, shall be given ~days, upon due notification by this board, to come into
compliance with regard to this violation. If compliance is not achieved by that date, a fine of $200.00
will be imposed per day until compliance is achieved, as verified by an officer of the City.
Furthermore, any and all future recurrence(s) of this violation after compliance has been achieved will
immediately cause the stated fine to be imposed until compliance is again achieved, as verified by an
officer of the City. Since Thomas Towner was present and heard the Order of this Board, it is further
moved that due notification was given as of this meeting.

Motion passed.
Thomas Towner's mother asked if they will be held in violation if someone comes along and knocks
down their fence again. Gray stated that if it is reported and an officer checks it out and the fence
is broken down, then yes it is a violation. Chairperson Schneider said that the owner of the property
is responsible.
The meeting recessed at 8:30 p.m., and reconvened 8:40 p.m.

15. Case #96007797.639 Pearl Road. Louis & Frances Rodriguez
Section 6-217 No Pool Enclosure. Mortgagee: Bancboston Mortgage (FL)
White distributed an update on the case. Captain Pieper presented the case to the board. A photo was
passed around to the board members by White. Testimony was given by White. Discussion.
Motion: The information and testimony presented at this meeting is incomplete or otherwise
insufficient to render a ruling, and that this matter be continued to the next regular meeting, or to a
special meeting when additional information is available, on a future date to be established by the
Chairman, as per Section 2-60 of the Code of the City of Winter Springs.
Motion by Lyzen. Second by Gray.

Captain Pieper mentioned that he has spoke to each board member about the Commission's interest
in trying to improve the code enforcement efficiency through the Code Enforcement Board process.
The issue was presented to the Commission at the last Commission meeting. The Commission did
approve the action so the Code Enforcement will meet every third Tuesday of the month beginning
in June. The yearly calender will be adjusted and the members that are absent will be notified by the
Clerk's office.
