BOARD MEMBERS: Bob Gray, Present Anne Schneider, Chairman, Present Lloyd Anderson, Present Gene Lein, Present Lurene Lyzen, Present Gene Prestera, Present Ken Haines, Present CITY OFFICIALS: Lt. Glenn Tolleson, Code Officer Al White, Code Inspector Schneider welcomed the Board's new member Gene Lein. Approval of Minutes of March 15, 1994: Lyzen moved to approve the minutes of March 15, 1994. Seconded by Anderson. Discussion. Gray mentioned a couple of typo's on page 3. Vote: All aye. Motion carried. I""'"" Discussion of Closed and Pendinq Cases: Schneider asked about the case regarding the three dogs that was sent to the Ccmni.ssion. Lt. Tolleson stated that the owner came into ccrrpliance, he only has two dogs. Discussion. White stated that at the last meeting the City Attomey Frank Kruppenbacher spoke about the out cane of our transfer of that case to the Ccmni.ssion. Schneider said Mr. Kruppenbacher was explaining to us that we had to find him guilty because we couldn't defer cases; because that clause in the Code Board that says that the Ccmni.ssion has the power to grant a variance to that particular ordinance 4-2, and we had deferred the case in order to give the people a chance to talk to the Ccmni.ssion and Mr. Kruppenbacher was correcting us on that in saying that if they are gui I ty we have to find them gui I ty right away; that was what Mr. Kruppenbacher was stressing. Schneider said all she wanted to know was whether they had gone to the Coornission and asked for the variance to have the three dogs. Tolleson stated no, even if they had they couldn't have gotten it because that would have made it a kennel under the Code and it is in an R-lA zoning and isn't allowed in that zoning. Discussion. Gray asked about the case invol ving a burning permit. Whi te said that was the new subdivision being built off of State Road 434 by the power lines. There were sane people on Shore Road that had ccrrplained about the smoke that they were having probl ems breathing because of the smoke. I immediately got the Fire Department involved because they had issued a permit allowing for the open bum in the clearing of the lot. However, in that permit it says you do not cause a problem with the neighborhood with smoke and ash, they were causing a problem and the Fire Department took care of it. .1""'"" Lyzen asked about case number 94004426, on the second page, on Erica, regarding the commercial vehicle; has that been corrected because you gave them 24 hours and the citation was given 3-16-94, has that been corrected? r- Code Enforcement Board May 17, 1994 Page 2 White stated no, that was issued by one of our Police Officers in the field and he is required to clear that up. Tolleson stated that it is cleared but the paper work hasn't gotten to White yet to officially close it out. Lyzen also asked what the letters "UNF" stands for. White said unfO\.mded. Schneider asked about case number 94005273 on Jeffrey, regarding a loose cat, she said that she thought that cats were suppose to be loose. Tolleson said only under voice control. Lyzen asked about case 94-153 in Tuscawi 11 a regarding a f1 ea market. White said that is a vacant lot in Seminole County's jurisdiction. Discussion. Discussion regarding signs. r Prestera asked about periodicals. Tolleson said it could be newspapers, etc. Prestera asked if they were being cited for not picking them up. Tolleson said no, we are citing the newspaper (etc.), owners for casting them without a pe~t. Haines asked about the case that was before the Board at the last meeting regarding the three individuals and loud music. Tolleson said that they moved and that they paid all but one of the citations. Schneider said that before we go onto the Discussion of the Citation Program there are a couple of people here who said they have a problem. White spoke with the two ladies and said that he would meet with they after the meeting and he has to follow the due process. Schneider stated that there is a due process where people have to be notified and then the law states that we have to wait so long so that they can correct the problem. Discussion on the Citation Proqram: White said that we have issued a total of 13 citations and we've successfully collected on 6 of those at this time. There are two that were late that we have to file a judgement on through the Circuit Court and the remainder are still not due. Discussion.
