BOARD MEMBERS: Bob Gray, Present Art Hoffmann, Cha i rman, Present Anne Schneider, Vice-Chairman, Present Lloyd Anderson, Absent Jim McShea, Absent Lurene Lyzen, Present Gene Prestera, Present CITY OFFICIALS: Lt. Glenn Tolleson, Code Officer Al White, Code Inspector Approval of Minutes of Septerrber 21. 1993: Lyzen moved to approve the minutes of Septerrber 21, 1993. Seconded by Schneider. Vote: All aye. Motion carried. r Discussion of Closed and Pending Cases: Hoffmann asked about the case concerning the Tire Business from last meeting. White said that the problem is corrected, the business license has been changed to "and/or" as was suggested. Hoffmann asked the recording secretary to make sure the Board receives a copy of Ordinance 547, regarding the creation of a the new chapter of Codes Enforcement Citations. CEB-93-442A and CEB-93442B, Ronald D. Truluck and Fleet Funding - 70 South Devon Avenue, Section 13-2(b & c) - Untended Grass and Weeds and Debris in Yard: White gave the Board an up-date on this item and was sworn in for testimony. White said that Truluck is the owner and resident of this home and that he is difficult to locate. Hoffmann asked if an officer from the evening shift has tried to find Truluck home. White said that is the next step after he tries to make delivery, that an officer tries to deliver the notice and if there is no one present it then is delivered by certified mail. Tolleson said that the front yard has been cut but the back yard has not been touched. Lyzen asked if the back yard is visible from the street. Tolleson stated yes it is. Prestera asked how high was the grass in the back yard. Tolleson said it is about three feet high. ~ Gray asked what is on the other side of the property in the back. said another home. white Discussion. r Code Enforcement Board Minutes November 16, 1993 Page 2 Schneider moved that Ronald D. Truluck and Fleet violation of Winter Springs Code Section 13-2 (b & c). Vote: All aye. Motion carried. Funding be found in Seconded by Lyzen. Lyzen moved that Ronald D. Truluck and Fleet Funding having been found in violation of Section 13-2 (b & c) be given 10 days to correct the violation, if not corrected by this time, as detenmined by an officer of the City of Winter Springs, shall be assessed a fine in the amount of $50.00 per day until such violation is found to be corrected by observation of an officer of the City; also any repeat occurrences of the same violation as detenmined by an officer of the City of Winter Springs shall cause the immediate fine of $100.00 to be assessed for each day of continuing violation until the violation is similarly found to be corrected. Seconded by Prestera. Vote: All aye. Motion carried. CEB-93-561, Judith H. Zipay and Mr. Zipay and Source One Mortgage Service- 426 David Street. Section 20-433(1) - Disabled Motor Vehicle: r White gave the Board an up-date on this case. White said that this is an Oldsmobile that was parked on the street on David Street about a year ago and it is now back again. It was there until Saturday and now it is gone again. Hoffmann asked if the automobile was in the same condition as before without wheels. White stated it was in worse condition than before; there is no tag, and the grill and lights are gone. Discussion. Hoffmann stated that the violation did exist, it never came before the Code Board because the violation disappeared, it wasn't corrected it disappeared, now it has returned. Discussion on this case. Schneider moved that Judith H. Zipay, Mr. Zipay and Source One Mortgage Service had been found in violation of Section 20-433(1) of the Code of Winter Springs from October 12, 1993 through November 11, 1993 and also shows evidence of being a repeat offender of this violation of Section 20- 433(1) of the Code of Winter Springs. Seconded by Lyzen. Vote: All aye. Motion carried. .r" Gray moved that Judith H. Zipay, Mr. Zipay and Source One Mortgage Service having been found in violation of Section 20-433(1) of the Code of the City of Winter Springs, be fined $150.00 per day for each future occurrence of the violation of Section 20-433(1) of the Code of Winter Springs as detenmined by an Officer of the City of Winter Springs. seconded by Lyzen. Discussion. Vote: All aye. Motion carried. r Code Enforcement Board Minutes November 16, 1993 Page 3 At this time the Board went through the list of violations White inspected since the last meeting. CEB-93-582, Pauline Oliver and Christopher L. Blanton - 122 North Alderwood street. Section 4-2 - More than 2 Dogs: White passed out an up-date on this case. In the up-date there is a copy of Semi no 1 e County' s An ima 1 Contro 1 report of 5 dogs at th i s address. Wh i te also stated that Ms. Oliver called and told him that he (White) had no business in her yard and that she (Oliver) was not going to get rid of her dogs. Discussion on this case. r Lyzen moved that this Board has read the complaint filed and the written information by the Code Officer and based on these proceedings Pauline Oliver and Christopher L. Blanton are found in violation of Section 4-2 of the Code of Winter Springs. Seconded by Prestera. Vote: All aye. Motion carried. Discussion on this case. Prestera moved that Pauline Oliver and Christopher L. Blanton having been found in violation of Section 4-2 of the Code of Winter Springs be given 30 days to correct the violation, if not corrected in that time be assessed a fine of $25.00 per day until corrected and also a repeat of this violation be fined $25.00 per day until corrected, as determined by an Officer of the City of Winter Springs. Seconded by Lyzen. Discussion. Vote: All aye. Mot ion carried. The meeting was adjourned at 8:30 P.M. Blanton 122 North Alderwood street, Winter Spring, FL The Code Enforcement Board of the City of Winter Springs, Florida, sat in Hearing on November 16, 1993, in the matter of Pauline 01 iver and Christopher L. Blanton, owner of record, to determine whether they are in violation of Section 4-2 of the Code of Winter Springs, Florida. Upon hearing all evidence on the matter, the Board arrived at the following: 1. Pauline Oliver and Christopher L. Blanton, owner of record, are found in violation of Section 4-2. ORDER OF THE BOARD I""""- 1. Pauline Oliver and Christopher L. Blanton, owner of record, having been found in violation of Section 4-2 of the Code of Winter Springs be given 30 days to correct the violation, if not corrected in that time be assessed a fine of $25.00 per day until corrected and also a repeat of this violation be fined $25.00 per day until corrected, as determined by an Officer of the City of Winter Springs. Truluck and Fleet Funding, owners of record, having been found in violation of Section 13-2 (b & c) of the Code of Winter Springs, be given 10 days to correct the violation, if not corrected by this time, shall be assessed a fine in the amount of $50.00 per day until the violation is found to be corrected, as detenmined by an Officer of the City of Winter Springs; also any repeat occurrences of the same violation as detenmined by an Officer of the City shall cause the immediate fine of $100.00 to be assessed each day of continuing violation until the violation is similarly found to be corrected.
