CODE ENFORCEMENT BOARD

The meeting was called to order at 7:00 by Vice-Chainman schneider.

Approval of Minutes of March 16, 1993:
Lyzen moved to approve the minutes of March 16, 1993. Seconded by Gray.
Vote: All aye. Motion carried.
Discussion of Closed and Pending Cases:
Lyzen asked about the two cases from the last meeting that was tabled to
this meeting.

Al White, Code Inspector, stated that the Villafane case is still pending
because the mortgage company and bank that is involved will not handle this
until they receive all the paper work.
White also stated that the other case involving the Jasjulski's has been
taken care of.

Linden Drive, Section 20-413, Pig in House:
Grace E. Reeves was sworn in for testimony.
White distributed an update on this case to the Board members.
Lt. Tolleson stated that on April 16, 1993, this complaint came to the
attention of the Code Inspector. On April 19, 1993, White went to 711
Linden and found a six month old vietnamese pot-bellied pig in the
residence. At that time White issued a warning for a violation of Section
20-413 of the City ordinance which reads: "..no one shall keep the following
animals in an R-1, R-1A, or R-1AA residential zoned areas: horses, cows,
pigs, chickens, geese, goats or any other foul or livestock other than
household pets." White gave the Reeves' until April 22, 1993, to come into
compliance. White spoke with Ms. Reeves on April 21, 1993 and Reeves stated
to him that she was prepared to face the Code Board. On April 27, 1993, a
statement of violation and notice of hearing was served on Ms. Reeves and
that corrective action must be taken immediately. As of this date the
~ violation has not been corrected.

Tolleson then stated that at this time we would like to ask the Board to
rule that the violation still exists and issue an appropriate relief order.
Schneider asked if the Board had any questions.
Gray asked what was the nature of the complaint other than someone knew that
there was a pig that existed in this home. White said that he received a
phone message that indicated there was a pig in the house and there was a
violation of City Code. White stated that he visited the area of the
complaint and met with Ms. Reeves and discussed the ordinance with her.
Lyzen stated that the ordinances stated anything other than household pets,
and Ms. Reeves said that her pig is a household pet.
Prestera stated that vietnamese pigs are now considered household pets in
many areas and in the future they will become more common place.
The Board discussed the difference between livestock and household pet.

Ms. Reeves gave the Board a letter from herself and information on pot-
bellied pigs to the Board.
Discussion.
Schneider asked Reeves for the record if she has any intention of keeping
the pig permanently outdoors, any intention of breeding the pig, any
intention of slaughtering the pig. Reeves answered no to all the questions.
Schneider then said that seems to cover any applications for livestock.
Lyzen moved to dismiss this case.
Motion carried.
Seconded by Gray.

All aye.
The meeting was adjourned at 7:25 P.M.
