HomeMy WebLinkAbout1990 09 18 Code Enforcement Board Regular Minutes r" CODE ENFORCEMENT BOARD MEETING CITY OF WINTER SPRINGS TUESDAY, SEPTEM3ER 18, 1990 The Code Enforcement Board was called to order by Chairman Bob Gray at 7: 00 P.M.. ROLL CALL: Bob Gray, present James Dasher, present John Ferring, present Anne Schneider, present Lloyd Anderson, present Beverly Fickling, present Lurene Lyzen, present Code Inspector Mary Muse, present Lieutenant Ed Taylor, present Mr. Ferring made a motion to accept the minutes of the May 15, 1990 meeting. Mr. Anderson seconded the motion. Vote on the motion: Mr. Dasher, aye; Mr. Ferring, aye; Mrs. Schneider, aye; Mr. Anderson, aye; Mrs. Fickling, aye; Mrs. Lyzen, aye; Mr. Gray, aye. Motion carried. Mrs. Lyzen made a motion to approve the minutes of the special meeting of Tuesday, June 19, 1990. Mrs. Fickling seconded the motion. Vote on the motion: Mr. Ferring, aye; Mrs. Schneider, aye; Mr. Anderson, aye; Mrs. Fickling, aye; Mrs. Lyzen, aye; Mr. Gray, aye; Mr. Dasher, aye. Motion carried. ~ The new Code Inspector, Mary Muse, introduced herself to the Board and gave a brief synopsis of her background. The Board members did the same. Mr. Gray said that John Ferring, Anne Schneider, and Jim Dasher are up for reappointment. Mr. Ferring said he is running for a Seat on the CaJmnission, but as he has declined remuneration on the Code Enforcement Board, there is no need for him to resign his position on the Code Enforcement Board at this time. Mrs. Schneider said she woUld stay on the Board. Mr. Dasher said he would periodically have to miss meetings, but he would like to stay on the Board under those conditions. He said he woUld understand if he is not sponsored. Discussion of closed and pending cases: Lieutenant Taylor said he has had no canplaints since July 30 on the Orange Shopper and the SUn Newspaper. Case No.6, Mr. Joel Austin, Jr., Sees. 6-2, 6-46 and 6-101 has been corrected. Lieutenant Taylor introduced Mr. Millard ("Mac") McKinney, the new Building Official, to the Board. Case No.5, Thomas and Beverly Dearnell, in violation of Sees. 13-2 and 13-3 at 904 Gazell Trail, was explained by Lieutenant Taylor. The CMller I s current address is 280 Hcmard Street, OViedo. The property has now been taken over by the mortgage canpany in Antonio, Texas. Lieutenant Taylor received a complaint on JUly 9. A written warning was issued. Nothing was done for three weeks as the officer who issued the warning left City employment. On August 15 a Notice of Violation and a Hearing Notice were sent certified to the property owners and the mortgage company. He received them back on August 21. The City if!"""" cleaned up the property and put a cinder block at the gate to the pool. Lieutenant Taylor had pictures showing the present condition of the property. Code Enforcement Board Meeting, September 18, 1990 Page 2 "...- Mr. Charles Noppinger, 906 Gazell Trail, witnessed. He said the property was vacant prior to June. He tried to get the Seminole County Health Department to do sanething about it because of the health danger and because he had seen children trying to get in several times. Mrs. Meta said Mr. Dearnell called her around August 30 and said the bank had repossessed the house. She notified the mortgage ccmpany but hasn't had any response from than. The County still had the Dearnells listed as the property owners. Mr. Gray said that as we don't know who the legal owner of the house is, we would have to find the Dearnells in violation and send a copy to the mortgage canpany. Discussion. Mr. Noppinger said someone has changed the locks on the house. Mr. Ferring suggested getting some guidelines on how to pursue these matters if this sort of case comes up often. Mr. Gray suggested that Mrs. Muse mention to the City Attorney that it would have been helpful to have had him at the meeting. Mr. Ferring suggested that Mr. Noppinger bring the health and safety factor of the pool to the attention of the Ccmnission, and they can order constant monitoring of it. He said there is a section in the City Code that addresses this situation. It indicates that if there is a health hazard problem, and the presence of bacteria and harmful materials are present, the City has a right to go in and correct the problem. Mr. McKinney, the Building Official, suggested he ask the City Manager about it. --- Mr. Dasher made a motion that the owner of record, (presently Thomas 6{ Beverly Dearnell), of the property located at 904 Gazell Trail, be found in violation of Sees. 13-2 and 13-3 of unkempt property at this location. Mrs. Schneider seconded the motion. Vote on the motion: Mrs. Schneider, aye; Mr. Anderson, aye; Mrs. Fickling, aye; Mrs. Lyzen, aye; Mr. Gray, aye; Mr. Dasher, aye; Mr. Ferring, aye. ~tion carried. Relief Order: Mrs. Fickling made a motion that the owners of record (presently Thomas 6{ Beverly Dearnell), after notification, are to be given 10 days to clean up the property in violation of Sees. 13-2 and 13-3 of the City Code of Winter Springs or be fined $100 per day until they came into compliance. Mr. Ferring seconded the motion. Vote on the motion: Mr. Anderson, aye; Mrs. Fickling, aye; Mrs. Lyzen, aye; Mr. Gray, aye; Mr. Dasher, aye; Mr. Ferring,faye; Mrs. Schneider, aye. Motion carried. Mr. Dasher stated that he was disappointed that the City Attorney was not present at the meeting. He said the wording of the Relief Order is a problem and he could've helped with that. He suggested that Mr. Gray speak with the Ci ty Attorney before the next meeting. He suggested that the City Attorney read over some of the past Relief Orders and give same constructive criticism as to the wording of them. Mr. Ferring suggested that the City Attorney be given all of the information that the Board gets. The meeting adjourned at 8: 00 P. M. . Respectfully submitted, ."..-.. Caroline McGinley
