HomeMy WebLinkAbout1990 03 20 Code Enforcement Board Regular Minutes ~ CODE ENFORCEMENT BOARD MEETING CITY OF WINTER SPRINGS TUESDAY, MARCH 20, 1990 The Code Enforcement Board was called to order by Chairman Bob Gray at 7:00 P.M.. ROLL CALL: Bob Gray, present James Dasher, present John Ferring, present Anne Schneider, present Lloyd Anderson, present Beverly Fickling, present Lurene Lyzen, present Officer Wesley Dowell, present Lieutenant Ed Taylor, present At the January 16, 1990 Meeting, James Dasher was re-elected Vice-Chairman for 1990. Mrs. Fickling made the motion to nominate him. Mr. Ferring seconded the motion. Mrs. Lyzen moved that the nominations be closed. Mrs. Schneider seconded the motion. Vote on the motion: Bob Gray, aye; James Dasher, aye; John Ferring, aye; Anne Schneider, aye; Lloyd Anderson, aye; Beverly Fickling, aye; Lurene Lyzen, aye. Motion carried. Mrs. Lyzen made a motion, to accept the minutes of the January 16 meeting as amended. Mrs. Fickling seconded the motion. Vote on the motion: Bob Gray, aye; James Dasher, aye; John Ferring, aye; Anne Schneider, aye; Lloyd Anderson, aye; Beverly Fickling, aye; Lurene Lyzen, aye. Motion carried. r-. Mr. Gray said that Mr. Ferring met with the City Attorney last Friday. Copies of a memorandum which was sent to Mr. Rozansky concerning the meeting were given to the Board. The City Attorney felt that some of the documents that are submitted to the Code Enforcement Board should be in much more detail, and should be given to the members of the Board in advance of the meeting so that the Board will have time to 10bk at the information and make decisions concerning evidence that is brought to the Prosecutor's office. Also he felt that the past cases which are handled by the Code Enforcement between meetings should be more detailed as to the actual cases and the specifics of the cases. The City Attorney will discuss that with the City Manager. The Police Department was discussed as not being fully involved in the zoning ordinances and building codes, so it's a possibility that for better continuity, the Code Enforcement Bureau should be shifted to another department other than the Police Department. The City Attorney said the Board would only have to indicate that they would like further representation and he will come to, the meeting. He is going to do a survey of cities to find out how their structure is set up and make recommendations based on that survey. Mr. Gray asked Mr. Ferring to have a meeting with the City Manager before the next Code Enforce- ment Board Meeting. There were no closed and pending cases to discuss. ,r-- Case no 5: Allen Leigh or Katherine Ann Perri Leigh, in violation of Secs. 13-2, 24-33 and 24-11. Lieutenant Taylor said that a warning was issued on January 18, with a follow-up on February 11. The condition at that time was worse. Pictures which were taken on January 18 and again today, were shown to the Board. The property is vacated~t6day, but two boats and a large piece of wood are still there. Code Enforcement Board Meeting Page 2 "- Witnesses were sworn in: Mrs. Phyllis Pulliam of 226 Buttonwood Avenue, stated that the Leighs were building a shrimp boat in the front yard. Since they have vacated the property, there is trash in the front yard and three boats are still there. The Leighs were renting the home. Lucy felicetti, 903 Redwood Court, Altamonte Springs, said her mother had lived at 222 Buttonwood. She said she had to pick up trash in her mother's backyard. James Albert Felicetti, 903 Redwood Court, Lucy Felicetti's son, said there is a tree house in the back yard that is an eyesore. Officer Dowell said that the tenants have removed the power meter from the house. This will be coming up later. Mr. Terry Duffy, who represents Lucy Felicetti in the management of the property at 222 Buttonwood, said it was inappropriate to sell the property because of the condition of the violators' property which is next door. Mrs. Felicatti rented the property, but could not get full rental market value because of the property next door. ~ Mr. Dasher made a motion that Allen Leigh or Katherine Ann Perri Leigh be declared guilty of violating collectively, Ordinances of Winter Springs 13-2, 20-433, and 20-411. Mr. Ferring seconded the motion. Vote on the motion: Mr. Ferring, aye; Mrs. Schneider, aye; Mr. Anderson, aye; Mrs. Fickling, aye; Mr. Lyzen, aye; Mr. Gray, aye; Mr. Dasher, aye. Motion carried. Relief Order: Mr. Ferring made a motion that Allen Leigh and Katherine Ann Perri Leigh, having been found in violation collectively of Secs. 13-2, 20-433 and 20-411, that a fine of $50 per day commencing 7 days from this date, be levied. Mrs. Lyzen seconded the motion. Discussion. Officer Dowell suggested that someone write a letter backing him up, addressed to the Board. This will help him recommend to the City to take action on this. Mr. Gray suggested that anyone who is interested, write a letter right away and address it to the City c/o Wesley Dowell. Vote on the motion: Mrs. Schneider, aye; Mr. Anderson, aye; Mrs. Fickling, aye; Mrs. Lyzen. aye; Mr. Gray, aye; Mr. Dasher, aye; Mr. Ferring, aye. Motion carried. Case No.6: Danny Ray Baugher, in violation of Secs. 20-431, 20-433, 13-1 and 13-2. Lieutenant Taylor said that property is at 270 Tradewinds in the Ranchlands area of the City. A warning was issued on January 15, 23 and on February 14. Pictures of the property were taken on February 15, 22 and today. Today, only one vechicle was in violation, and garbage needs to be removed. Mr. Baugher was cited in another area of the City last year. and the violation was never corrected. Discussion. ,-. Mr. Dasher made a motion that Danny Ray Baugher be found guilty of continuing violations of Winter Springs Ordinances 20-431, 20-433, 13-1 and 13-2. Mrs. Schneider seconded the motion for discussion. Discussion. Mrs. Schneider seconded the motion. Vote on the motion: Mr. Anderson, aye; Mrs. Fickling, aye; Mrs. Lyzen, aye; Mr. Gray, aye; Mr. Dasher, aye; Mr. Ferring, aye; Mrs. Schneider, aye. Relief Order: Mr. Dasher made a motion that Danny Ray Baugher be found guilty of continuing violations of Winter Springs Ordinances 20-431, 20-433, 13-1, and 13-2. He shall have 7 days after notification of this Board's action in which to correct the specified violations. If, after this period, any of these violations should occur in the opinion of an officer of the City of Winter Springs, there shall be a fine of $50 a day until said violation is corrected. Mr. Ferring seconded the motion. Discussion. Mr. Gray recommended changing the fine to $75. Discussion. Mr. Ferring removed his second to the motion. It was decided to change the amount of the fine to $75. Mr. Ferring seconded the amendment to the motion. Discussion. Vote on the motion: Mrs. Fickling, aye; Mrs. Lyzen, aye; Mr. Gray, aye; Mr. Dasher, aye; Mr. Ferring, aye; Mrs. Schneider, aye; Mr. Anderson, aye. Motion carried. Mr. Gray made a motion to adjourn.
