CODE ENFORCEMENT BOARD MEETING
CITY OF WINTER SPRINGS
TUESDAY, JULY 18, 1989
The Code Enforcement Board Meeting was called to order by Mr. Bob Gray,
Chairman, at 7:00 P.M..

Motion was made by Mr. Ferring to approve the minutes of the May 16, 1989
meeting. Seconded by Mr. Langelotti. All ayes. Minutes approved.
The Seminar at the Winter Park Campus of U.C.F. which the membersof the Board
attended on June 9, 1989, was discussed. Mr. Ferring said that he felt that
the City of Winter Springs had quite an "advanced jump" on some of the areas
that they discussed. Mr. Dasher said that he felt that Winter Springs has
accomplished more than some of the other cities and has been more aggressive.

Closed and Pending Cases:
Case no. 5 on the Agenda, Walter or Sandra Rawlings, will be held over until
the next meeting because Mrs. Rawlings is in the hospital, and wished to be
present at the meeting. Lieutenant Butler will reschedule it for the next
meeting.
Bill Toney, 657 Silvercreek, in violation of Sec. 44-81, having a commercial
vehicle in R-zoning. Lieutenant Butler explained that this is an ongoing
problem. He has been warned but continues to park the vehicle at his
residence. Also, a boat is still parked in the front yard. He recommended
that he be found guilty, and be fined for everyday that the violation con-
tinues.
Witnesses were sworn in.
First witness was Louis Patricelli, 401 Santa Maria Way, Longwood. He stated
that he owns property at 653 Silvercreek Drive. He said that Mr. Toney
refused to move his truck when he asked him to.
Bill Toney witnessed-next. He said the boat hadn't been there for a month.
He said that he uses his truck for everything, not just his job.
Mrs. Toney witnessed. She felt that Mr. Patricelli had a personal vendetta
against them.

Mr. Patricelli witnessed again. He said that there is a conventional auto-
mobile parked at his residence which Mr. Toney says belongs to his mother.

Mr. Dasher moved that Mr. Toney be declared in violation of Winter Springs
Ordinance No. 44-81 by having a commercial dual wheel truck parked in his
driveway. Mr. Langelotti seconded the motion. Vote on the motion: Mr. Gray,
aye; Mr. Dasher, aye; Mr. Ferring, aye; Ms. Schneider, aye; Mr. Anderson, aye;
Ms. Fickling, aye; Mr. Langelotti, aye. Motion carried.
Relief Order: Mr. Ferring made motion that Mr. Toney, having been found in
violation of Sec. 44-81, will be fined $10 per day for each day after official
notification which will take place seven days from tonight, and thereafter
continue on that basis. Mr. Dasher suggested that Mr. Ferring indicate in
his motion, that Mr. Toney is present tonight. Mr. Langelotti seconded the
motion. Discussion. Vote on the motion: Mr. Dasher, aye; Mr. Ferring, aye;
Ms. Schneider, aye; Mr. Anderson, aye; Ms. Fickling, aye; Mr. Langelotti, aye.
Motion carried.
Armando Guarin, 602 Anhinga Road, in violation of Sec. 9-277and Sec. 6-3,
use of building altered. Lieutenant Butler stated that Mr. Guarin is occupying
his residence without meeting the requirements for a certificate of occupancy.
Letters were sent to him by Mr. Archer, the building official three times,
and were ignored. Lieutenant Butler recommended that the Board find Mr. Guarin
in violation of these City Codes, or be fined for every day the violations
continue. On Sec. 6-3 he has only a temporary certificate of occupancy. He
said that Mr. Archer will explain Sec. 9-277, P(2).

Mr. Archer was sworn in. He stated that he had told the real estate agent
that the garage must be converted back into a garage. The agent said that
he would stipulate that whoever bought the house would have to do it, and
he reduced the price of the house considerably for that reason. This was
known to Mr. Guarin. He explained the Code that concerns that violation,
to Mr. Guarin. Discussion. Mr. Archer showed a picture of the house to
the Board.
Witnesses were sworn in.
The first witness was Calvin Withrow, 500 Spoonbill Court, Greenspoint. As
a member of the Greenspoint Homeowner's Association, he and two other members
visited Mr. Guarin's home to explain the covenants of the Homeowner's Asso-
ciation regarding building. He said that Mr. Guarin at that time, said he
would put up the garage doors. Then, another time he said he wasn't going
to do it.
The next witness was Ken Ralph, 63 Falcon Court, Winter Springs. He confirmed
Mr. Withrow's testimony.
The next witness was Kathleen Degrenia, Executive Director of the Highlands,
529 Moree Loop. She stated that they had had special meetings with Mr.
Guarin. He was told that it was a requirement in the Highlands to have
garage doors. He finally stated that he wasn't going to do it.

The next witness was Paul Kelley, attorney for Mr. Guarin. He works for
Brooks and Willingham in Longwood. He said that Mr. Guarin will comply if
he is found in violation of this Code. He said that there is nothing in the
Code that says you have to have a garage.
Lieutenant Butler said that they advised Mr. Guarin that his temporary license
of occupancy would be revoked on May 15.

Mr. Guarin witnessed. He said that he put in a driveway. He said he has a
big driveway. Mr. Gray asked him if he understood when he bought the house
that he was supposed to convert the room to a garage. Mr. Guarin answered that
it is a garage. Discussion. Mr. Archer read the Temporary Certificate of
Occupancy No. 1235, which says that a model home is for sale use only, and not
to be lived in wihout a new certificate of occupancy being issued.
Mrs. Guarin witnessed. She had received letters from people complaining
about the residence, which she brought with her.
Mr. Ferring made motion that Mr. Armando Guarin is in violation of Sec. 9-277,
and Sec. 6-3. Langelotti seconded the motion. All ayes. Motion carried.
Relief Order: Mr. Dasher moved that Mr. Armando Guarin, who is present before
us tonight, having been found in violation of the Winter Springs Ordinances
involving his garage door, shall correct the situation within three weeks of
this date, or be fined $25 a day until the situation in the judgment of officers
of the City of Winter Springs, is in compliance. Mr. Gray asked that the words
'garage door' be taken out of the motion, and residence put in its place.
Mr. Dasher amended the motion: "Until he brings his residence in compliance
with the original plan of the City of Winter Springs as determined by a Winter
Springs official". Mr. Ferring seconded the motion. Vote on the motion:
Mr. Ferring, aye; Ms. Schneider, aye; Mr. Anderson, aye; Ms. Fickling, aye;
Mr. Langelotti, aye; Mr. Gray, aye, Mr. Dasher, aye. Motion carried.
Meeting adjourned at 9:00 P.M..
