REQUEST: City Attorney requests the City Commission consider adoption
of the attached Ordinance No 720, setting a referendum on November 2,
1999 on the question of whether or not the City should add fluoride to the
City's public drinking water.
PURPOSE: The purpose of this ordinance is to set the date of the referendum
election (November 2,1999); the ballot question; notify the Supervisor of
Elections of the date of the election and ballot question; and, provide for
publication of required legal ads.
CONSIDERATION:
The referendum is intended to serve as an expression of sentiment
from the public on the issue of whether fluoride should be added to the City's
water supply.
The City Commission has conducted a number of public meetings
on the issue of fluoridating the City's water supply. Conflicting scientific data and
public sentiment has been expressed.
The Commission has determined that an expression of public
sentiment is the best means of determining public support or opposition to
fluoridating the City's water supply.
The referendum, although advisory only, would allow public
expression on the issue of whether to fluoridate the water.
FUNDING: Legal adds required by State law and ballot printing costs.
RECOMMENDATION:
Consider adoption of Ordinance No. 720.

AN ORDINANCE OF THE CITY OF WINTER SPRINGS. FLORIDA
PROVIDING FOR A REFERENDUM ON TIm ISSUE OF ADOmG
FLUORIDE TO TIlE CITY'S PUBLIC DRINKING WATER SYS~
ESTABLISIDNG THE DATE OF THE ELECTION ON NOVEMBER ~
1999; NOTIFYING THE SUPERVISOR OF ELECTIONS OF THE
REFERENDUM AND BALLOT QUESTION PROVIDING FOR
PUBLICATION OF NOTICE OF THE ELECTION; PROVIDING FOR
CONFLICTS; SEVERABILITY AND EFFECTIVE DATE.
WHEREASt the City of Winter Springs has a public water system that currently does
': not include fluoride; and
WHEREAS, the City Commission has had several public meetings at which scientific
data on the advantages of adding fluoride to the public water supply has been presented; and
WHEREAS. public sentiment on the advantages or disadvantages of fluorinating the
public water supply has been divided.
NOW THEREFORE, BE IT ORDAINED BY THE CITY OF WINTER SPRINGS AS

4. Instructions to the Seminole County Supervisor oLElections: The City Clerk is
hereby directed to provide as copy of this ordinance to the Supervisor of Elections so tha.t the
Supervisor of Elections is on notice of the proposed referendum and the referendum question set
forth in Paragraph 3 of this ordinance. The Clerk should provide this information to the
' Supervisor of Elections as soon as possible; so as to be in ,full compliance with the notice
requirements of Florida Election Law. The notice to the. Supernsor of Elections should request
, that the referendum question be placed on the ballot at the November 2. 1999. general ejection.
5. Publication of Notice of Referendum Election. The Clerk shall publish "Notice of
the Referendum" in a newspaper of general circulation as required by Section 100.361. Florida
Statutes.
6, Costs of Election The City Commission shall be responsible for those costs. if
any, required to be paid by a City placing a referendum question on the ballot at an already
scheduled election, as set forth in the state election laws.
7. Conflicts. All Ordinances in conflict for the provisions of this Ordinance are
hereby superceded and this Ordinance shall prevail. ;
8. Severability. If any words. phrase, sentence or portion of this Ordinance is
stricken by a Florida Court of competent jurisdiction) all other tenns and conditions of the
" Ordinance not specifically stricken shall remain in full force and effect_
9. Effective D~te. This Ordinance shall become effective upon its adoption by the
'.City Commission of the City of Winter Springs. Florida,
