HomeMy WebLinkAbout1988 09 20 Code Enforcement Board Regular Minutes . .CODE ENFORCEMENT BOARD MEETING CITY OF WINTER SPRINGS TUESDAY, SEPTEMBER 20, 1988 The Code Enforcement Board was called to order by Mr. Bob Gray, Vice-Chairman at 7:00 P.M.. Mr. Gray asked the three new members of the Board to introduce themselves, and give a brief summary about themselves and their employment. Mr. John Ferring spoke first, then Mr. Lloyd Anderson, and finally Mr. John Langelotti. The older members of the Board also introduced themselves to the new members. ROLL CALL: James Dasher, Chairman, Absent John Ferring, Present Anne Schneider, Present Lloyd Anderson, Present Beverly Fickling, Present Bob Gray, Present John Langelloti, Present Officer Wesley Dowell, Present Lieutenant Gerald Justice, Present Mr. Langelloti made the motion that the minutes of July 19, 1988 be approved. Ms. Schneider seconded the motion. All ayes. Motion carried. Officer Justice explained the cases that have come up over the past two months. . Closed and Pending Cases: All witnesses and one offender were sworn in. . Michael or Deborah Leroux, c/o Douglass, P.O. Box 281, Somerset Ms., and Chase Home Mortgage Company, 135 Chestnut Road, Montvale N.J., in reference to property at 729 Mimosa Court, unkempt property, Sec. 7.2, and stagnated pool, Sec. 5.149. Officer Dowell reported on the case. He reported that the pool was stagnated and the grass was about "knee high". He found that the house was empty and had been for some time. Several attenpts were made to find the owners. He got a return letter from Deborah Leroux after several weeks, saying that a foreclosure was being processed on the property. Her husband was supposed to have taken care of the property but did not. She gave Officer Dowell the address of her husband and the mortgage holder. A notice was sent to the mortgage holder, but no action was taken by them. The City cleaned up the property. A bill for that was assessed. No action was taken to pay the bill. Officer Justice stated that the mortgage company had paid the property taxes in 1987. They were sent notice by certified mail, and the return receipt was received. Officer Justice read the Code Section pertaining to the violations. He produced two pictures showing the condition of the pool as of September 19, 1988. A letter was sent to the mortgage company containing the bill for $108.50, advising them that they had to pay the bill or a lien would be filed against the property. According to the police chief, the City still has not received payment. Discussion. They had been given until September 1, 1988 to make full payment to the City. Discussion. Mr. Richard Brandal of 727 Mimosa Court witnessed as to the condition of the property. Ms. Schneider asked if the mortgage company is the legal owner of the property. Officer Justice answered yes. Discussion. . . . eODE ENFORCEMENT BOARD MEETING, SEPTEMBER 20, 1988 PAGE 2 Ms. Fickling made a motion that the Chase Mortgage Company be found guilty of Sec. 7.2 and 5.149 of the City Code of Winter Springs. Mr. Ferring seconded the motion. Discussion. Vote on the motion: Ms. Schneider, aye; Mr. Anderson, aye; Ms. Fickling, aye; Mr. Gray, aye; Mr. Langelotti, aye; Mr. Ferring, aye. Motion carried. Relief Order: Ms. Fickling made motion that after notification, the Chase Mortgage Company be fined $100 per day until they come into compliance. Mr. Langelotti seconded the motion. Ms. Schneider suggested that they be given one week, and a definite date to come into compliance after notification. Vote on the motion. Relief Order: Mr. Gray, aye; Mr. Langelotti, aye; Mr. Ferring, aye; Ms. Schneider, aye; Mr. Anderson, aye; Ms. Fickling, aye. Motion carried. Paul Vandestreek, 125 Cumberland Circle, Longwood, FL, and the Standard Mortgage Company, 5871 Glenridge Drive, Atlanta, Georgia 30328, in reference to the property at 141 North Bombay Avenue, unkempt property, Sec. 7.2. Officer Justice read Sec. 7.2 of the City Code. Officer Dowell reported that on August 15, 1988 it was reported that the grass was high and the doors were open at this address. Written warning was published that day by Officer Fagan. Notice of violation was mailed out on August 25, advising the owner, Paul Vandestreek, that if it was not corrected by the 31st., to appear at the Board meeting. The owner called and said that he no longer owned the property. On August 25, a notice of violation was mailed to Standard Mortgage Company. A signed receipt was received indicating that they had received it, but the City has not heard from them. Jane Butt of 151 North Bombay was called as a witness. She stated that the grass was overgrown and the windows and doors were all open. She said that it had been that way since May. Discussion. Officer Justice presented two pictures of the property which were taken yesterday, September 19. Ms. Fickling made motion that the Standard Mortgage Company be found guilty of Sec. 7.2. Seconded by Mr. Ferring. Vote on the motion: Mr. Langelotti, aye; Mr. Ferring, aye; Ms. Schneider, aye; Mr. Anderson, aye; Ms. Fickling, aye; Mr. Gray, aye. Motion carried. Relief Order: Ms. Schneider moved that the Standard Mortgage Company be fined $100 per day commencing seven days following receipt of notification. Seconded by Ms. Fickling. Vote on Relief Order: Mr. Ferring, aye; Ms. Schneider, aye; Mr. Anderson, aye; Ms. Fickling, aye; Mr. Gray, aye; Mr. Langelotti, aye. Motion carried. Myrna Waterfield, P.O. Box 55, Altamonte Springs 32701, in reference to the property on 115 Mockingbird Lane, unkempt property, Sec. 7.2. Notices of violation have been sent to Mrs. Waterfield by certified mail at several different addresses. No contact has been made with her. Officer Justice presented pictures of the property. This property has apparently been taken over from a person named Wagner on a 'Quit Claim Deed', and nothing has been done. Discussion. The property was cleaned up by the City about six weeks ago. The bill was $365.00. Discussion. Mr. Gray made motion that Myrna Waterfield be found in violation of Sec. 7.2. Ms. Fickling seconded the motion. Vote on the motion: Ms. Schneider, aye; Mr. Anderson, aye; Ms. Fickling, aye; Mr. Gray, aye; Mr. Langelotti, aye; Mr. Ferring, aye; Motion carried. Relief Order: Mr. Ferring made motion that Mrs. Waterfield be fined $25 per day, seven days after notification. Mr. Gray seconded the motion. Officer Justice stated that if this continues for another 6 or 8 months or more, and the property is not brought into compliance, we will levy fines and if the fines are not met, a lien will be filed in the County Court against the house. The City can foreclose. That will be the decision of the City Attorney. CODE ENFORCEMENT BOARD MEETING, SEPTEMBER 20, 1988 PAGE 3 Joan Larson, 207 Flamingo Avenue, more than two dogs or cats, Sec. 4.2 and Sec. 44.79. Officer Justice read the Codes pertaining to this violation. On June 28, 1988, Officer Margaret Adams issued a written warning to Joan Larson. The warning was signed for on July 11, 1988. The officer followed up on the case and found that five dogs were still on the property. Notice of violation was served and signed for on July 13, 1988. Joan Larson gave witness. Officer Justice questioned her. He asked her if the dogs were still there. She said no. She stated that she has two now. Mr. Ferring asked her when she release the other three dogs. She said maybe a month ago. She said that her lease was up in December, and she planned to move out of the City limits in o~to get her dogs back. Motion was not secondedj Ms. ickling made motion that Ms. Larson be found guilty of Sees. 4.2, 4.4 and 4~.79. r. Langelotti seconded the motion. Ms. Schneider said that by her owncf~orn testimony, Ms. Larson has found homes for three of her dogs, and has come into compliance, and it seems that her 'only crime' was that she didn't call a police officer when she got rid of the third dog. She stated that she believes that Ms. Larson has done everything she could. Vote on the motion: Mr. Ferring, no; Ms. Schneider, no; Mr. Anderson, no; Ms. Fickling, aye; Mr. Gray, no; Mr. Langelotti, aye; Motion did not carry. David Sanchioni, 205 Bennett Street, unkempt property and trash in disabled truck, Sec. 7.2 and 44.85. A warning was issued on April 19, 1988, May 4, 1988, and on August 28, 1988. Notice of violation was sent by certified mail and signed for. Officer Dowell said he received a call from the complainant who was subpoened to come to the meeting, saying he was sick. Both violations have been corrected as of this date. Mr. Ferring made motion that Mr. Sanchioni be found guilty of Sec. 44.85 and 7.2. Ms. Fickling seconded the motion. Discussion. Vote on the motion: Ms. Schneider, aye; Mr. Anderson, aye; Ms. Fickling, aye; Mr. Gray, aye; Mr. Langelotti, aye; Mr. Ferring, aye; Motion carried. Relief Order: Ms. Fickling made motion that seven days after notification, David Sanchioni be fined $25 per day for each Code violation if it happens again. Mr. Langelotti seconded the motion. Vote on the motion: Mr. Anderson, aye; Ms. Fickling, aye; Mr. Gray, aye; Mr. Langelotti, aye; Ms. Schneider, aye: Mr. Ferring, aye; Motion carried. Richard J. Bunner, Jr., 425 David Street, disabled vehicle, Sec. 44.85. Officer Justice stated that the property had been rented out to various tenants. Officer Dowell stated that they were unable to contact the registered owner of the vehicle. A notice was then sent to the occupant of the house, who after signing for the notice, moved out leaving the owner of the property responsible. The property owner was at the meeting, and was sworn in for testimony. Officer Justice asked Mr. Richard Zipay if he was the owner of the property. Mr. Zipay said yes. Officer Justice questioned Mr. Zipay as to his knowledge of the vehicle's being on his property. Officer Justice asked Mr. Zipay to have the vehicle removed from the property tomorrow morning. The case was dismissed. Jo-Dean (Johnson) Zilke, 421 La Costa Drive, Orlando, 32807, unkempt property, Sec. 7.2, at 212 South Edgemon Avenue. Officer Justice said that the violation has been cleared up, however it has been an ongoing situation. The attorney representing Citicorp Savings of Florida Mortgage Company has assured Officer Dowell that the property will be kept in . . .
