CODE ENFORCEMENT BOARD MEETING CITY OF WINTER SPRINGS TUESDAY, JULY 19, 1988 The Code Enforcement Board Meeting was called to order by Mr. James Dasher, Chairman, at 7:00 P.M. ROLL CALL: James Dasher, Present Milo Jones, Present Anne Schneider, Absent Jim Kaley, Absent Beverly Fickling, Present Bob Gray, Present Al Peiper, Present Mr. Peiper made motion to accept the minutes of May 17, 1988. Mr. Gray seconded the motion. All ayes. Motion carried. Ms. Fickling made motion to accept the minutes of the June 28, 1988 Special Meeting. Mr. Jones seconded the motion. All ayes. Motion carried. The Board went over the cases handled by the City from May 1, 1988 to June 30, 1988. Discussion. Discussion of closed and pending cases: Chuck Thompson, Winter Springs Development Corporation, 1301 Winter Springs Boulevard, Removing soil, rock, and sand without City Permit, Sec. 9.5, and filling in with mulch, and storing where soil was removed without City Permit, Sec. 14.125. This case has been continued at the request of Officer Dowell. He has further work to be done on it. James R. Whitley, 300 Mohawk Trail, no valid Building Permits, Sec. 5.35, Sec. 5.4~ Case requested by the Building Inspector, to be continued. There will be a conference between James Whitley, his attorney, the Building Inspector and the City Manager. This case will be continued at the next meeting. Marlyn Pippin, 407 Hawthorne Circle, Paul Nass, P.O. Box 340, Winter Park, First Union Mortgage Corp., Suite 140, 2375 Westmonte Drive, Altamonte Springs, Sec. 44.85, disabled vehicle parked on City property, and Sec. 7.2(A), Unkempt property. Case has been continued by the Code Inspector due to the fact that the notices have not been signed for. Officer Dowell explained that this is an estate where the gentleman has passed away. He has not been able to contact the person in charge of the estate. Robert Stowell, 610 Tina Lane, Animal at large, Sec. 4.13. Code Inspector Dowell was satisfied that the problem was brought under control. Therefore the case is closed. . . . Code Enforcement Board Meeting, July 19, 1988 Page 2 First Atlanta Mortgage Company, 615 Peachtree St., E., Atlanta, Ga., Jo Dean Johnson, 2356 Town and Country Drive, Kissimmee, Weeds and grass grown up (unkempt property), Sec. 7.2. At the Code Inspector's request, case has been continued to allow time to establish someone closer than the Atlanta Mortgage Company. Melvina Pfeifer, #5 Gumtree Court, Garbage & trash stacked in garage with door open, unkempt yard, door open, Sec. 7.1 (B( and 7.1 (A). Case requested to be continued. Officer Dowell explained that a lady had turned in a report of grand theft. He hasn't been able to locate her. Norman Lawton, 1111 Duncan Drive, Unkempt property, Sec. 7.2 (A). Mr. Lawton and a witness, Mr. Robert Worley were sworn in. A notice of violation had been sent to Mr. Lawton, but as of yesterday (July 18), it had not been corrected. Officer Justice read the violation in the City Code Book. Mr. Worley, 1114 Duncan Drive, was called to testify. He stated that the lawn had not been mowed since July, 1987. He showed pictures that he had taken of the lot. Ms. Fickling asked if the house was for sale. Mr. Worley said yes. Officer Justice said that Mr. Lawton was given a notice on June 12th and again on the 28th. Mr. Lawton testified. He gave his residence as P.O. Box 536, Casselberry. Mr. Lawton said that he had not been aware that there was an Ordinance from May 25th until June 12th, and that he was sick during that time. Since then, he said he had trimmed and cleaned the yard. He stated that his lawn mower does not work, and he is financially unable to get it fixed at this time. Mr. Lawton said that he had his house listed with a Real Estate Agent, who said that she would have the yard cut, but it has not been cut yet. He talked with her about two weeks ago. Officer Justice said that he felt that Mr. Lawton as owner of the property, was responsible for it, and asked that the Board move accordingly. Mr. Dasher asked for a motion. Mr. Peiper moved that Mr. Lawton be found guilty of Sec. 7.2. Ms. Fickling seconded the motion. Vote on the motion: Mr. Jones, aye; Ms. Fickling, aye; Mr. Gray, aye; Mr. Peiper, aye; Mr. Dasher, aye. Motion carried. Relief Order: Mr. Peiper moved that Mr. Lawton be fined $10 per day starting tomorrow, for each day that the yard is not taken care of. Mr. Dasher seconded the motion for discussion. Mr. Gray moved that Mr. Lawton be given five business days after this hearing to come into compliance with Sec. 7.2 of the Winter Springs Code, and for every day thereafter, be fined $10 per day until the property comes into compliance. Seconded by Mr. Peiper. Vote on the motion: Ms. Fickling, aye; Mr. Gray, aye; Mr. Peiper, aye; Mr. Dasher, aye; Mr. Jones, aye. All ayes; motion carried. Lindel White, 45 South Edgemon Av., Noise nuisances, Sec.9.14. Officer Justice stated that they had received several complaints on May 21 at 3:28 A.M., on May 23 at 12:45 A.M., on May 26 at 6:40 P.M., and May 20 at 3:40 P.M., complaining of loud music and people screaming and yelling. The notice to be at the meeting was hand delivered and signed for on June 1, 1988 by Mrs. White. The complainant contacted the Code Inspector prior to this meeting, saying that after contacting Mrs. White, the problem may have been somewhat resolved, but it has been a continual problem. Officer Justice said that he would like for the Board to make a move to try to stop it. He said that on the 28th the complaint was confirmed. He stated that he has a sworn affidavit signed by the complainant. Discussion. Motion: Peiper moved that Mrs. White be found guilty. Seconded by Ms. Fickling. Vote on the motion: Mr. Gray, aye; Mr. Peiper, aye; Mr. Dasher, . . . Code Enforcement Board Meeting, July 19, 1988 Page 3 Mr. Jones, aye; Ms. Fickling, aye. Motion carried. Relief Order: Ms. Fickling moved that Mrs. White, after notification, be fined $50 for each incident of noise in the future. Mr. Dasher seconded for discussion. It was moved and seconded that after notification, Lindel White be fined $50 for each occassion of noise nuisance, Sec. 9.14. Vote on the motion: Ms. Fickling, aye; Mr. Gray, aye; Mr. Peiper, aye; Mr. Dasher, aye; Mr. Jones, aye. Motion carried. Mr. Dasher announced that Mr. Peiper may be moving away from Winter Springs,. and this might be his last meeting with us. Mr. Peiper moved that the meeting adjourn. Seconded by Mr. Gray. All ayes.
