CODE ENFORCEMENT BOARD MEETING
CITY OF WINTER SPRINGS
TUESDAY, MARCH 17, 1987
The Code Enforcement Board Meeting was called to order by Vice Chairman
Frank Broyles at 7:00 PM.
ROLL CALL:

Bob Gray, present

Code Inspector Brenda Sonafelt, absent
Code Prosecutor Gerald Justice, present
City Attorney Linda Barnaby, present
A motion was made by Mr. Peiper to excuse the members who were missing, James
Dasher, Larry Cerra, and Milo Jones. The motion was seconded by Mrs. Beverly
Fickling; Vote: all ayes; motion carried.
Motion was made by Mr. Peiper to accept the minutes of February 3 as presented.
Seconded by Mr. Bob Gray. No discussion. Vote on the motion: all aye; motion
carried.
Prosecutor Justice opened discussion on closed and pending cases. The violation
by John Otten of Section 44.81 on November 18, 1986, and his subsequent violation
on February 23, 1987 of the same Section 44.81 was discussed.
Motion was made by Mr. Peiper that the ruling of November 18 be kept, in which
Mr. Otten is to pay a $50 fine for each day he is in violation. Motion was
seconded by Beverly Fickling; all aye; Motion carried unanimously.
A suggestion was made to list the address as well as the name of the violator
so that when that person's name appears on the Agenda, the Board will know
that he or she has been a previous offender.
Attorney Linda Barnaby stated that a Board member may report a violation to the
Code Inspector.
Attorney Linda Barnaby discussed the question of whether an alleged violator
must be present, and whether he or she waives his or her rights to give
testimony by not appearing at a hearing. She reviewed Statute 162, County
or Municipal Code Enforcement. Discussion. Attorney Barnaby will continue to
research the matter.
Motion was made by Mr. Peiper to adjourn. Seconded by Mr. Gray. All aye.
Motion carried.
Meeting was adjourned at 7:50 PM.
