CODE ENFORCEMENT BOARD MEETING
CITY OF WINTER SPRINGS
TUESDAY, JANUARY 20, 1987
The Code Enforcement Board Meeting was called to order by Mr. James Dasher, Chairman
at 7:00 PM.
Roll Call:
James Dasher, Present
Lawrence Cerra, Present
Frank Broyles, Present
Beverly Fickling, Present
Bob Gray, Present
Al Peiper, Absent
Milo Jones, Present
Mr. Dasher, introduced Mr. Jones, new board member replacing Mr. Jay Alpert. Mr.
Jones gave brief history of employment before moving to Winter Springs six years
ago. Each board member was introduced by Mr. Dasher and requested to give a brief
history.
Motion was made by Mr. Cerra to approve the minutes of November 18, 1986. Seconded
by Mr. Gray. No discussion. Vote on the motion: All aye; motion carried.
Nominations were opened by Mr. Dasher for the election of a new Chairman for 1987.
Mr. Gray made a motion to renominate Mr. Dasher as Chairman. Mr. Cerra seconded
the motion for nomination. Mr. Cerra moved the nominations be closed. Mrs. Fickling
seconded the motion. Vote for the election of Mr. Dasher as Chairman; All aye;
motion carried.
Nominations were opened by Mr. Dasher for the election of a Vice Chairman. Mrs.
Fickling made a motion to nominate Mr. Broyles as Vice Chairman. Mr. Jones seconded
the motion for nomination. Mr. Gray moved the nominations be closed. Mrs. Fickling
seconded the motion. Vote for the election of Mr. Broyles as Vice Chairman; All aye;
motion carried.
Discussion of closed and pending cases - no discussion.
7:15 P.M. - Cases
Olive P. Wagner - Sec. 5-l49(c)
Olive P. Wagner or her representative were not present. Code Prosecutor Gerald
Justice presented the case.
Motion was made by Mr. Broyles that Olive P.Wagner is in violation of Sec.5-l49(c) of
the Code of the City of Winter Springs, stagnant water in swimming pool at 55 S.
Fairfax. Seconded by Mr. Gray for discussion. Discussion. Vote on motion: Mr.
Dasher, aye; Mr. Cerra, aye; Mr. Broyles, aye; Mrs. Fickling, aye; Mr. Jones, aye;
motion carried.
Motion was made by Mr. Broyles that Olive Wagner be fined $50.00 per day retroactive
to November 12, and to continue each day through January 20. After January 20, she
will have a period after service of Order of the Board until January 31, to come
into compliance with the Code. The $50 per day continues from January 20, until
the point there is either satisfaction or January 31. If there is still not
satisfaction by that time, the fine will increase to $100 per day. Seconded by

Mr. Dasher declared the motion failed and opened for new motion.
Motion was made by Mr. Gray that Olive P. Wagner be given seven days after service of
Order of the Board to come into compliance. If she does not come into compliance,
a fine of $15.00 per day retroactive to November 12, until the seventh day. If she
is not in compliance in seven days, to be fined $100.00 per day until she is in
compliance. There will be no fine at all if she comes into compliance within seven
days. Seconded by Mr. Cerra for discussion. Discussion. Vote on motion: Mr. Dasher,
aye; Mr. Cerra, aye; Mr. Broyles, no; Mrs. Fickling, no; Mr. Gray, aye; Mr. Jones, no;
Vote for the motion was tied.
Mr. Dasher declared the motion failed and opened for another motion.
Motion was made by Mr. Gray, that Olive Wagner be fined a $500 one time set fee.
After Order of the Board is served an additional $50.00 perday fine until she comes
into compliance. Seconded by Mr. Broyles for discussion. Discussion.
Motion was amended by Mr. Gray, Olive Wagner be fined $500 one time set fee. After
Order of the Board is served, an additional $100.00 per day fine until she comes into
compliance. Amendment seconded by Mr. Broyles for discussion. Discussion.
Motion withdrawn by Mr. Gray.
A new motion was made by Mr. Gray. On service of the Order of the Board to Olive
Wagner, if she is not in compliance on that day, she will be assessed a fine of $500.00.
She will have a three day grace period to clean up the pool before there is an addit-
ional $100.00 per day fine assessed until she comes into compliance. Seconded by
Mr. Broyles for discussion. Discussion. In discussion it was determined the motion
was intended that if the pool is in compliance at the time the Order of the Board is
served, Mrs. Wagner will still be fined the $500.00. Vote on the motion: Mr. Cerra,
aye; Mr. Dasher, aye; Mr. Gray, aye; Mrs. Fickling, aye; Mr. Jones, aye; Mr. Broyles,
aye. Motion carried.
Meeting adjourned 8:20 PM.
