HomeMy WebLinkAbout1986 09 16 Code Enforcement Board Regular Minutes ( AMENDED MINUTES CODE ENFORCEMENT BOARD MEETING CITY OF WINTER SPRINGS TUESDAY, SEPTEMBER 16, 1986 The Code Enforcement Board Meeting was called to order by Mr. James Dasher, Chairman at 7:00 p. m. Roll Call: James Dasher, present Brian Rush, absent Al Peiper, absent Jay Alpert, present Bob Gray, present Larry Cerra, present Frank Broyles, present Code Prosecutor Gerald Justice, present Chairman James Dasher introduced Mr. Bob Gray, new Code Board member. Motion was made by Mr. Alpert to approve the minutes of July 15, 1986. Seconded by Xr. Cerra. Discussion. Vote on the motion: all aye; motion carried. Discussion of closed and pending cases - discussed. Sun City Septic Tank Service - Chap. 13, Sec. Mr. Gil Artman, Mr. Sam Smith, Officer Gerald by the City Clerk in order to give testimony. the case. 13.1, 13.2, 13.3 and 13.4: Justice and Mr. David Gould were sworn in Code Prosecutor Gerald Justice presented Motion was made by Mr. Alpert that we find that Mr. David Gould, Sun City Septic Tank is in violation of Chapter 13, Sec. 13.1, 13.2, 13.3 and 13.4. Seconded by Mr. Broyles for discussion. Discussion. Vote on the motion: Mr. Gray, aye; Mr. Cerra, aye; Mr. Dasher, aye; Mr. Alpert, aye; Mr. Broyles, aye; motion carried. Motion was made by Mr. Broyles that Mr. Gould have 24 hours to remove the illegal installation of the drainage system from the City property and if not done so within 24 hours, be subject to a fine of $50.00 per day. Motion died for lack of a second. Motion was made by Mr. Gray that we give Mr. Gould 48 hours to restore the miami curb to its prior condition after receiving a permit and that he be fined $150.00 per day if he does not come into compliance in restoring that curb within 48 hours. Seconded by Mr. Cerra. Discussion. Vote on the motion: Mr. Cerra, aye; Mr. Dasher, aye; Mr. Alpert, aye; Mr. Broyles, no; Mr. Gray, aye; motion carried. Kathleen Eby - 5.24: Mrs. Eby was sworn in by the City Clerk in order to give testimony. Code Prosecutor Gerald Justice presented the case to the Board. Motion was made by Mr. Alpert that the structure at Mrs. Eby's residence is in violation of 5.24 which requires a building permit for any structure from the City. Seconded by Mr. Gray. Discussion. Vote on the motion: Mr. Dasher, aye; Mr. Alpert, aye; Mr. Broyles, aye; Mr. Gray, aye; Mr. Cerra, aye; motion carried. Motion was made by Mr. Broyles that this party be instructed not to use this structure until a proper permit has been secured and approved by the City of Winter Springs and that it be designed by a proper engineer that is qualified to Code Enforcement Board Meeting, Sept. 16, 1986 Page 2 design this type of structure as far as safety is concerned and they be ordered not to use it until that occurs; a fine of $25.00 per day for every day she is in violation or for any use; she has 30 days to secure a permit. If all this has not been accomplished within 30 days, it is to be removed from the site. Seconded by Mr. Cerra. Discussion. Vote on the motion: Mr. Alpert, aye; Mr. Broyles, aye; Mr. Gray, aye; Mr. Cerra, aye; Mr. Dasher, aye; motion carried. Archie Sagers - 44.81, lea), 11.18(1)(a2) and 44.85: Mr. Archie Sagers, 402 George St., was sworn in by the City Clerk in order to give testimony. Code Prosecutor Gerald Justice presented the Case to the Board. Motion was made by Mr. Alpert that we find that Mr. Sagers was in violation of Sec. 44.8l(1)(a), 11.18(1)(a2) and 44.85 and that he is currently in violation of 44.8l(1)(a) which is the commercial vehicle step van/and truck in excess of 3/4 ton parked in a residential area and that we further find that there has been a con- tinuing violation of at least 44.8l(1)(a) from Mr. Sagers. Seconded by Mr. Broyles. Discussion. Vote on the motion: Mr. Broyles, aye; Mr. Gray, aye; Mr. Cerra, aye; Mr. Dasher, aye; Mr. Alpert, aye; motion carried. Motion was made by Mr. Alpert that we issue an Order of the Board that Mr. Sagers come in compliance by tomorrow morning by removing the truck from the residence and that any future violation, if they are verified by the City police, he be fined at a rate of $25.00 per violation per day. Seconded by Mr. Broyles. Discussion. In discussion, Mr. Cerra said (for the record) he felt that $25.00 per vehicle per day for a commercial vehicle parked in a residential area is not enough fine; more in line with $100.00 per day. Vote on the motion: Mr. Gray, no; Mr. Cerra, no; Mr. Dasher, aye; Mr. Alpert, aye; Mr. Broyles, aye; motion carried. Motion was made by Mr. Alpert to adjourn. Seconded by Mr. Cerra.
