CODE ENFORCEMENT BOARD MEETING
CITY OF WINTER SPRINGS
TUESDAY, MARCH ~, 1986
"
The Code Enforcement Board Meeting was called to order by Chairman James Dasher
at 7:00 p. m.
Roll Call:
James Dasher, present
Jay Alpert, present
Ben Kaplan, present
Marianne Cheeseman, present
Lawrence A. Cerra, present
Brian Rush, present
Al Peiper, present
Code Prosecutor Bob Butler, present
Code Inspector Barry Cook, present
Approval of minutes of January 21, 1986:
Motion was made by Mr. Kaplan to approve the minutes of January 21, 1986. Seconded
by Mr. Rush. Discussion. Vote on the motion: all aye; motion carried.
Mr. Ben Kaplan announced that he will be resigning from the Code Board. He said
he would turn in a letter of resignation.
Officer Bob Butler and Officer Barry Cook also announced they would be leaving the
Board. They will be replaced by Officer Gerald Justice who will be the Code
Prosecutor and Officer Brenda Sonafelt who will be the Code Inspector.
There was no discussion of closed and pending cases.
Cases:
.........." Mr. Jason Frizzell - 44.74 and 44.81:
Mr. Frizzell and Officer Cook were sworn in by City Clerk to give testimony.
The Code Prosecutor presented the Case of Mr. Jason Frizzell, 1006 Weathered Wood
Circle, Winter Springs - Section 44.74 and 44.81. Mr. James Harbin, 1010 Weathered
Wood Circle was sworn in by the City Clerk in order to give testimony.
Motion was made by Mr. Alpert that the Board find Mr. Frizzell was in violation of
Sec. 44.8l-l(g) keeping a boat in excess of 23 feet in a residential district; as a
matter of Fact and a matter of Law, he was in violation of Sec. 44.8l-l(g).
Seconded by Mr. Peiper. Discussion. Vote on the motion: Mrs. Cheeseman, aye;
Mr. Rush, aye; Mr. Cerra, no; Mr. Dasher, aye; Mr. Kaplan, aye; Mr. Peiper, aye;
Mr. Alpert, aye; motion carried.
Motion was made by Mr. Alpert that we as a Board hold any Relief Order in abeyance,
and that we notify the officers if in fact there are any future violations by Mr.
Frizzell of this ordinance, at that address, that they bring that before the Board,
and we notify anyone listening here that it is our intent to exercise our right to
fine Mr. Frizzell for any and all future violations of this offense. Seconded by
Mr. Kaplan. Discussion. Vote on the motion: Mr. Rush, aye; Mr. Cerra, aye; Mr. Dasher,
aye; Mr. Kaplan, aye; Mr. Peiper, aye; Mr. Alpert, aye; Mr. Cheeseman, aye; motion
carried.
Mr. Floyd Jacobs - Sec. 7-2:
Mr. Jacobs was not present.
Motion was made by Mr. Alpert that we hear this case. Seconded by Mr. Cerra.
Discussion. Vote on the motion: all aye; motion carried.

For the record, the relationship of the adult member of Mr. Jacobs family who
received the service of the subpoena was his son.
The Code Prosecutor presented the Case of Floyd Jacobs who resides at 590 Lake
Kathryn Circle, Sec. 7-2. This case is in reference to property at Hayes and
Bahama Roads. (Lot 7, Block E, North Orlando Ranches Sec. 1, P.B. 12, Page 3 of P.R.
of Seminole County, Florida.)
Motion was made by Mr. Alpert that we find Mr. Jacobs in violation of Sec. 7-2
of the Winter Springs Code as a Finding of Fact and Law. Seconded by Mr. Peiper.
Discussion. Vote on the motion: Mr. Dasher, aye; Mr. Kaplan, aye; Mr. Peiper, aye;
Mr. Alpert, aye; Mrs. Cheeseman, abstain; Mr. Rush, aye; Mr. Cerra, aye; motion
carried.
Motion was made by Mr. Alpert that we give Mr. Jacobs 15 days to clean up the lot
in compliance with Sec. 7-2 or suffer a fine of $10.00 per day for every day he is
in violation thereafter. Seconded by Mr. Dasher. Discussion.
Motion to amend the motion by Mr. Kaplan to increase the fine from $10.00 to $25.00
per day. Seconded by Mr. Cerra. Discussion. Vote on the amendment to the motion:
Mr. Kaplan, aye; Mr. Peiper, no; Mr. Alpert, no; Mrs. Cheeseman, abstain; Mr. Rush,
no; Mr. Cerra, aye; Mr.Dasher, no; amendment to the motion failed.
Vote on main motion: Mr. Peiper, no; Mr. Alpert, aye; Mrs. Cheeseman, abstain;
Mr. Rush, aye; Mr. Cerra, aye; Mr. Dasher, aye; Mr. Kaplan, aye; motion carried.
