This will confirm our conversation of this date regarding
tonight's Code Enforcement Board meeting and the "wall" issue.
As we discussed, the facts appear to be that Mr. Jacobson
was given a building permit that authorized his constructing a
wall in excess of eight feet. The City Zoning Codes prohibit
any wall being constructed in excess of eight feet. The City
Commission did not authorize a wall in excess of eight feet.
Based upon these limited facts, the issue of "estoppel" was
raised by Mr. Jacobson's attorney. However, in order for our
office to properly assure the City is protected, I would prefer
the Code Enforcement Board take all evidence on the issue and
then we will issue a written opinion regarding the applicability
of current "estoppel" law to the case.
