Alethea Morie and her goat in a RC-l zone
Re:
Gentlemen:
On December 6, 1984 Mrs. Morie came to me to pay $50.00 to be
heard by the Board of Adjustment in regard to her keeping a goat in an
RC-1 zone. Upon checking into the matter further, it was realized that
this could not be made a conditional use by the Board of Adjustment as
the use is not provided for by Code.
I have turned the ma~ter over to the City Attorney for a decision
on the issue, (please see attached memo). Many people in the Ranchlands
have livestock of many varieties, thus making this a very controversial
situation. Only horses are allowed on 3/4 or more of an acre.
If you are determined to see the matter through, please be
prepared to take the issues of this, and all other subsequent cases
regarding livestock to the Commission for a final decision.

This question of livestock in the Ranchlands is a very controversial
question.
1) Only horses are allowed in the area at 3/4 of an acre per animal.
2) This matter cannot be sent to the Board of adjustment as recommended
by the Code Enforce~t Board as it does not fall under a condi-
tional use.
3) The only way this lady could keep her goat is to rezone the land
RU, which is the only zoning allowing for livestock.
4) The Ranchlands also have chickens, ducks, geese and pigs according
to reports from the Code Enforcement Officer. Should these people
be cited as well?
Prior to my doing anything at this time, I think we need a legal opinion
from the City Attorney on which direction to proceed.

IN RE:
John Maiuri
The Code Enforcement Board of the City of Winter Springs, Florida, sat
in Hearing in the matter of John Maiuri who resides at 270 Trade~inds
Road, Winter Springs, Florida, to determine whether Mr. Maiuri is in
violation of Section 44.27.10 of the Code of Winter Springs, Florida.
Upon hearing all evidence on the matter, the Board arrived at the
following:
FINDING OF FACT
1. There still remains two goats on the premises at 270 Tradewinds
Road, Winter Springs, Florida.
After arriving at their Findings of Fact and referring to the Code of
the City of Winter Springs, Florida, the Board arrived at the following:
FINDING OF LAH
1. These goats, as defined under Section 44.27.10, are in violation of
Section 44.27.10.

After arriving at the foregoing Findings of Law, the Board enters an
Order as follows:
ORDER OF THE BOARD
1. That Mr. Maiuri is in violation of Sec. 44.27.10 of the Code and he
be given 30 days to remove the goats from his property or suffer a
fine of $10.00 per day for each day that the goats remain on the
property.
Now then the Code Enforcement Board of the City of loJinter Springs, Florida, "
instructs all enforcement procedures to be instituted to accomplish this
Order.
