CODE ENFORCEMENT BOARD MEETING
CITY OF WINTER SPRINGS
TUESDAY, OCTOBER 8, 1985
The Code Enforcement Board Meeting was called to order by Ben Kaplan, Vice-
Chairman at 7:00 p. m.
Roll Call:
Jay Alpert, Chairman, present
Phil Kulbes, present
Ben Kaplan, Vice Chairman, present
Thomas Dougherty, present
Marianne Cheeseman, present
Al Peiper, present
Code Inspector Barry Cook, present
Code Prosecutor Bob Butler, present
Approval of minutes of July 16, 1985:
Motion was made by Mr. Kulbes, seconded by Mr. Dougherty to approve the minutes of
July 16, 1985. Discussion. Vote on the motion: Mr. Dasher, abstained; Mr. Kulbes,
aye; Mr. Kaplan, aye; Mr. Dougherty, aye; Mr. Peiper, aye; motion carried.
Mr. Kaplan then passed the gavel to Mr. Alpert as he entered the meeting.
Mr. Kaplan addressed the Board in reference to two previous cases, Mr. Kriebel
and Mr. Jacobson.
Motion was made by Mr. Kaplan, seconded by Mr. Kulbes to send a letter to the
City Commission asking them to make certain that the Staff personnel are properly
oriented in all of the Codes of the City and that they do not issue any permits
that are illegal. Discussion. Vote on the motion: Mr. Kulbes, aye; Mr. Kaplan, aye;
Mr. Alpert, no; Mr. Dougherty, aye; Mr. Peiper, aye; Mrs. Cheeseman, no; Mr. Dasher,
no; motion carried.
Judith Wolframe - Violation of Section 5-24:
Code Prosecutor Bob Butler presented the Case of Judith and Robert Wolframe,
720 Sybilwood circle who were sent a Notice To Appear At Hearing to determine
whether they were in violation of Section 5-24. Mr. and Mrs. Wolframe and Officer
Barry Cook were sworn in by the City Clerk.
Mr. Wolframe said he attempted to obtain a permit but was directed to go before the
Architectural Review Board in Tuscawilla.
Motion was made by Mr. Dougherty, seconded by Mrs. Cheeseman to table until the
next meeting. Vote on the motion: All aye, with Mr. Kulbes voting no. Motion
carried.
Tony Awad - Violation of Section 5-122:
Code Prosecutor Bob Butler presented the Case of Tony Awad, 898 Chokecherry Drive,
who was sent a Notice To Appear AT Hearing to determine if he was in violation of
Section 5-122. Mr. Awad and Officer Cook were sworn in by the City Clerk in order
to give testimony.
Motion was made by Mr. Kulbes that we find Mr. Awad in violation of Section 5-122
because he did not comply with either set of plans that he submitted and that he
be required to remove the fence back 15 feet as shown on his second permit.

Seconded by Mr. Dasher. Discussion. Vote on the motion: Mr. Kaplan, aye; Mr. Alpert,
abstained; Mr. Dougherty, abstained; Mr. Peiper, aye; Mrs. Cheeseman, no; Mr. Dasher,
aye; Mr. Kulbes, aye; motion carried.
Motion was made by Mr. Kulbes that we grant Mr. Awad 90 days in which to substantially
complete the relocation of that fence and if it is not substantially completed that
he be fined $100.00 per day for every day thereafter that it is not completed. Motion
died for lack of a second.
Motion was made by Mr. Dasher that the gentleman relocate his fence within 90 days,
and failing to do so he shall be fined $50.00 per day until the fence is properly
placed. Seconded by Mr. Kulbes. Discussion.
Motion was amended by Mr. Kaplan that he be given 90 days to relocate the fence
or pay a fine of $25.00 per day until the fence is properly located. Seconded by
Mr. Peiper. Vote on amendment to the motion: Kulbes and Alpert abstained; Kulbes
voted no; other members voted aye;
Vote on the main motion as amended: Mr. Alpert, abstained; Mr. Dougherty, abstained;
Mr. Peiper, aye; Mrs. Cheeseman, no; Mr. Dasher, aye; Mr. Kulbes, aye; Mr. Kaplan,
aye; motion carried.
The Vernon Pitt case has been postponed until the next meeting.
There was discussion of cases brought before the Board.
Meeting was adjourned at 8:25 p. m.
