REGULAR MEETING
CODE ENFORCEMENT BOARD
CITY OF WINTER SPRINGS
MAY 21, 1985
The Code Enforcement Board Meeting was called to order by Jay Alpert, Chairman, at
7:00 p. m.
Roll Call:

Ben Kaplan, Vice-Chairman, present
Also present:
Sam Smith Building Official
Ed Baxa, City Attorney
Tom Dougherty, present
Marianne Cheeseman, present
Mike DePasquale, present
James Dasher, present
Code Inspector Barry Cook, absent
Code Prosecutor Bob Butler, present
Motion was made by Mrs. Cheeseman to approve the minutes of March 19, 1985.
Seconded by Mr. Ku1bes. Discussion. Vote on the motion: all ayes; motion carried.

Discussion of pending and closed cases:
Attorney Baxa reported on the status of the Jacobson lawsuit. He said there was a
Hearing last week. The plaintiff had filed a petition for a writ of mandamus. At
that Hearing Judge Sa1fi decided he would prefer to have a factual stipulation
submitted by both parties in lieu of live testimony. Once the factual stipulation
is submitted to him he will have another Hearing at which time he will review the
information and suggest to Counsel what areas of law are relevant given that factual
stipulation. Attorney Baxa said he is working with Attorney Mike Jones on a factual
stipulation for review by Judge Sa1fi. The Board asked to be notified when the next
Hearing will be.
Case:
Timothy Kriebel, Violation Sec. 5-122:
Timothy Kriebel, Wanda Kriebel, Sam Smith, and Bob Butler were sworn in by the City
Clerk. Mr. Kriebel testified on his own behalf. Jay Alpert was asked to testify.
He turned the gavel over to Vice-Chairman Ben Kaplan. Mr. Alpert was sworn in by
the City Clerk.
Motion was made by Mr. Dasher that the presence of the fence on Mr. Kriebel's property
is in violation having been erected with no building permit, and is a violation of
Sec. 5-122. Seconded by Mr. Dougherty. Discussion. Vote on the motion: Mrs. Cheeseman,
aye; Mr. DePasquale, aye; Mr. Kaplan, aye; Mr. Ku1bes, aye; Mr. Dougherty, aye; motion
carried.
Motion was made by Mr. Dougherty to take the fence down within 60 days or pay a
fine of $50.00 per day thereafter. Seconded by Mr. Ku1bes. Discussion. Vote on
the motion: Mrs. Cheeseman, no; Mr. DePasquale, no; Mr. Kaplan, aye; Mr. Ku1bes,
aye; Mr. Dougherty, aye; Mr. Dasher, aye; motion carried.
Meeting was adjourned 9:05 p. m.
