CODE ENFORCEMENT BOARD MEETING
January 21, 1985
CITY OF WINTER SPRINGS
The Code Enforcement Board Meeting was called to order by Chairman Jay Alpert at
7:00 p. m.
Roll Call:
Marianne Cheeseman, present
Mike DePasquale, present
Jay Alpert, Chairman, present
Ben Kaplan, Vice Chairman, present
James Dasher, present
Phil Kulbes, present
Tom Dougherty, present
Code Inspector Officer Barry Cook, present
Code Prosecutor Officer Bob Butler,present
Motion was made by Mike DePasquale to approve the minutes of the last meeting. Seconded
by Marianne Cheeseman. Discussion. Vote: all ayes, motion carried.
Discussion of Pending Cases - discussed.
Discussion of changing meeting day:
Motion was made by James Dasher to meet at a regular time structure on the third
Tuesday of every other month. Seconded by Tom Dougherty. Discussion. Vote: all ayes;
motion carried.
Election of Chairman:
Mike DePasquale nominated Jay Alpert if he is agreeable to serve for another term.
Seconded Tom Dougherty.
Motion by Phil Kulbes to close nominations. Seconded by Tom Dougherty. Discussion.
Vote: all ayes; motion carried unanimously.
Election of Vice-Chairman:
Phil Kulbes nominated Ben Kaplan for another term of 12 months. Seconded by Tom
Dougherty.
Motion by Phil Kulbes to close nominations. Seconded by Tom Dougherty. Discussion.
Vote: all ayes; motion carried unanimously.
Case: John Maiuri:
Mr. John Maiuri was present. At the last meeting the Board's Findings of Fact were
there were two goats on the property owned by John Maiuri. The Board found that
having two goats, based on City Code, was in violation of Section 44.27.l0~ and it
was the Board's feeling that because these goats have been there for sometime, that
Mr. Maiuri be given some time to get relief from the other divisions of the City if
he could get relief.
Motion was made by James Dasher that there be a fine if the violation is not
immediately corrected of $1.00 per month for each goat until the goats are removed.
Motion died due to lack of a second.

Motion was made by Phil Kulbes that we find Mr. Maiuri in violation of the Code as
noted and that we give Mr. Maiuri 60 days to get rid of the goats and for every day
thereafter we fine him $10.00 for a period of time until those goats are removed.
Seconded by Ben Kaplan. Discussion. Vote on the motion: Cheeseman, no; DePasquale,
no; Alpert, yes; Kaplan, yes; Kulbes, yes; Dougherty, no; Dasher, no; motion failed.
Motion was made by Phil Kulbes that Mr. Maiuri is in violation of Sec. 44.27.10 of
the Code and that he be given 30 days to remove those goats from his property or
suffer a fine of $10.00 per day for each day that the goats remain on the property.
Seconded by Ben Kaplan. Discussion. Vote on the motion: Cheeseman, no; DePasquale,
no; Alpert, aye; Kaplan, aye; Kulbes, aye; Dougherty, aye; Dasher, no;motion carried.
Case - Mona Ward:
Mrs. Ward was present. At the last meeting the Board had a finding of fact that
Mrs. Ward kept one goat on her property and that was a violation of Sec. 44.27.10.
The Board had a finding of law that it was a violation of Section 44.27.10. Mrs.
Ward was given 60 days to try to find relief.
Motion was made by Phil Kulbes that Mrs. Ward be found in violation of Section 44.27.10
That she correct the violation within 30 days. If the violation is not corrected
within 30 days she will be subject to a fine of $10.00 for each day that the
violation continues. Seconded by Tom Dougherty. Discussion. Vote on the motion:
DePasquale, aye; Alpert, aye; Kaplan, aye; Kulbes, aye; Dougherty, aye; Dasher,aye;
Cheeseman, no; motion carried.
Motion by Kulbes, seconded by DePasquale to adjourn. Motion carried. Meeting was
adjourned at 8:12 p. m.
