REQUEST: The Community Development Department - Planning Division requests the City
Commission approve the second reading for adoption of Ordinance No. 685, to
annex a 17 Al acre parcel.
PURPOSE:
The purpose of this Board Item is to request the Commission approve the second reading
for adoption of Ordinance No. 685 to annex a 17A1 acre parcel located on the northwest
corner of State Road 434 and Tuskawilla Road. This property would become part of the

proposed Town Center District.
APPLICABLE LAW AND PUBLIC POLICY:
The provisions of 171.044 (1) Florida Statutes which states "The owner or owners of real
property in an unincorpqrated area of a county which is contiguous to a municipality and
reasonably compact my petition the governing body of a said municipality that said
property be annexed to the municipality."

The Legislature recogni~es that enclaves can create significant problems in planning,
growth management, and service delivery, and therefore declares that it is the policy of the
State to eliminate enclav,es [ref 171. 046(1) F. S J
The provisions of 171.044 F.S. which states "Upon determination by the governing body
of the municipality that the petition bears the signatures of all owners of property in the
area proposed to be annexed, the governing body may, at any regular meeting, adopt a
non-emergency ordinance to annex said property and redefine the boundary lines of the
municipality to include said property."
The City has expressed an interest in annexation in the past, (ref 8-14-95 City
Commission meeting). '
CONSIDERA TIONS:
· The owner of the subject property has requested annexation into the City. This
parcel is part of the largest county enclave surrounded by the City.
· The applicant is ~he sole owner of the 17.4 1 acre property.
· The City has exp;ressed an interest in annexation in the past (ref 8-14-95 City
Commission meeting).
· The City has the 'capacity to service the property with sewer and water, as well as
provide the othet; urban services it currently provides to other areas of the City.
· Th adjacent parcels on the east side and south side of the intersection of
Tuskawilla Road. and S.R. 434 are indicated as "Commercial" on the City's Future
Land Use Map. The adjacent parcels on the west side of the intersection, in the
county enclave, are indicated as "Commercial" and "Office" on the county's
Future Land Use: Map.
· The adjacent parcels on the east side and south side of the intersection of
Tuskawilla Road and S.R. 434 are indicated as C-l "Neighborhood commercial"
on the City's Zoning Map. The adjacent parcels on the west side of the
intersection, in the county enclave, are indicted as A-I "Agriculture" on the
county's Zoning Map.

The Planning & Zoning Board r~commends to the City commission the annexation of9.95 acre
Kingsbury parcel into the city, b:ased on the findings located in the document titled Kingsbury
Annexation (ANX-6-97).
NOTE:
The original request for annexation did not include all of the Kingsbury property.

1. The findings indicated above;
2. Previous expressions of interest by the City for annexation;

Legislature recognizes that enclaves can create significant problems in planning,
growth management, and service delivelY, and therefore declares that it is the
policy of the stale to eliminate enclaves. ':

4. The City has the capacity to service the property with sewer and water, as well as

IMPLEMENTA TION SCHEDULE:
The City Commission would hold a public hearing for second reading of Ordinance 685 on
April 26, 1999 and adopt Ordinance 685 to annex the 17.41 acre parcel. The ordinance
for annexation immediately takes effect upon adoption.

WI-IEREAS, the applicant, LaVerne and June Kingsbury, the owners of the
