Code Enforcement Board Meeting
Monday, May 21, 1984
The Code Enforcement Board Meeting was called to order by Chairman Jay Alpert.
Roll Call:
Jay Alpert, present
Tom Stoddart, present
Ben Kaplan, present
Thomas Dougherty, present
Marianne Cheeseman, absent
Mike DePasquale, present
Arthur Hoffmann, present
Code Inspector Wesley Dowell, present
Code Prosecutor Charles Sexton, present
Motion was made by Mr. Dougherty, seconded by Mr. DePasquale, to approve the minutes
of March 19, 1984. Discussion. Vote on the motion: all aye; motion carried.
Discussion of Closed and Pending Cases - discussed.
CASE, Diane Setordepour:
Officer Sexton presented the Case of Diane Setordepour. Officer Wilkins, W.S.P.D., and
Diane Setordepour were sworn in by Chairman Jay Alpert.
Officer Wilkins said that he was dispatched on a complaint to 211 Murphy Road that
there was a chicken on the property on April 29. He asked Mr. Setordepour if there
was a chicken on the property and was told there was one. The Officer then gave a
written warning that it was against the City ordinance to have a chicken on the
property.
Mrs. Setordepour then said they did get rid of two of the chickens, but the children
were very upset when she tried to get rid of the last one. It is a very small pet
chinese chicken which is kept in a cage in the house.
Motion was made by Mr. Dougherty, seconded by Mr. Kaplan, as a finding of fact, there
still remains one chicken at the property of Diane Setordepour, 211 Murphy Road, Winter
Springs, Florida. Discussion. Vote on the motion: All aye; motion carried.
Motion by Mr. Kaplan, seconded by Mr. DePasquale, as a finding of law, the fact the
chickens live at 211 Murphy Road is a violation of Section 44.77. Discussion. Vote
on the motion: all aye; motion carried.
Motion was made by Mr. DePasquale that we give them until July 9, 1984, to get rid of
the chickens or get an allowance for it from the appropriate City agency or commence
a fine of $10.00 per day starting the 9th of July, 1984, upon an investigation by the
Code Officer. Seconded by Mr. Dougherty. Discussion. Vote on the motion: Stoddart,
aye; DePasquale, aye; Alpert, aye; Kaplan, aye; Dougherty, aye; Hoffmann, aye; motion
carried.
