The Code Enforcement Board Meeting was called to order by Chairman Jay Alpert at 7:06 p. m. Roll Call: Jay Alpert, present Ben Kaplan, present Tom Stoddart, absent Tom Dougherty, absent Marianne Cheeseman, present Mike DePasquale, present Arthur Hoffmann, present Also present: Code Prosecutor Chief John Govoruhk Code Inspector Wesley Dowell Code Inspector Charles Sexton There was a correction to the minutes of November 21, 1983, change the word "of" in the last motion on Page 1 to "up to" (assess a fine up to $250.00 per day). Motion was made by DePasquale, seconded by Hoffmann to approve the minutes as amended. Discussion. Vote on the motion: all ayes, motion carried. Discussion of Closed and Pending Cases - discussed. Chief Govoruhk presented the case of Mr. Harold Howington, 80 N. Edgemon Ave., Winter Springs, Florida, who was sent a Notice to Appear At Hearing for the Board to determine whether he was in violation of Section 44:8l(F). Mr. Howington was not present. Findings of Fact: The Board arrived at the Findings of Fact that there was a bus parked at 80 N. Edgemon Ave., Winter Springs for several months, a 1950 Ford G~1C transit type bus well in excess of 28 feet. Motion was made by Hoffman, seconded by Cheeseman the bus as represented in the attached charge here was parked on the property in excess of one month. Discussion. Vote on the motion: all ayes, motion carried. Findings of Law: Motion was made by Kaplan, seconded by Cheeseman, that Mr. Howington was in violation of Sec. 44.8l(F). Discussion. Vote on the motion: all ayes; motion carried. Motion was made by DePasquale that we make an Order of the Board that Mr. Howington be notified that he was in violation and that if he continues to violate, the Code Board will reconvene to assess a fine up to $250.00 per day. Seconded by Kaplan. Discussion. Vote on the motion: all ayes, motion carried. Chief Govoruhk presented the case of Diane Setordepour, 211 Murphy Road, Winter Springs, Florida, who was sent a Notice to Appear at Hearing for the Board to determine whether she was in violation of Section 44.77 of the municipal code. Findings of Fact: Motion was made by Hoffman, seconded by Kaplan, that there are chickens on the premises in violation of the Code Section 44.77. Discussion. Vote on the motion: Cheeseman, aye; DePasquale, aye; Kaplan, aye; Hoffman, aye; Alpert, aye; motion carried. . . . ~ Code Enforcement Board Meeting, Jan. 16, 1984 Page 2 Findings of Law: The Board has found as a matter of law that the animals are not allowed as household pets. The next question would be an Order of the Board as to what we want to Order. Motion was made by Cheeseman, seconded by Hoffman, that there be an Order of the Board that we give Mr. and Mrs. Setourdepour 60 days from today to find another location to keep their chickens and that at the next Code Enforcement Board Meeting this be brought up and if the chickens are gone the case will be dropped. If not, we will look at a possible fine. Discussion. Vote on the motion: all ayes, motion carried. The next Board meeting will be March 19, 1984.
