REQUEST: The Community Development Department - Planning Division requests the City
Commission approve the first reading for adoption of Ordinance No. 685, to
annex the 17.41 acre (Kingsbury) parcel.
PURPOSE:
The purpose of this Board Item is to request the Commission approve the first reading for
adoption of Ordinance No. 685 to annex a 17.41 acre parcel located on the northwest
corner of S.R. 434 and Tuskawilla Road. This property would become part of the
proposed Town Center District.
APPLICABLE LAW AND PUBLIC POLICY:
The provisions of 171. 044( 1) Florida Statutes which states "The owner or owners of real
property in an unincorporated area of a county which is contiguous to a municipality and
reasonably compact may petition the governing body of a said municipality that said
property be annexed to the municipality."

The Legislature recognizes that enclaves can create significant problems in planning,
growth management, and service delivery, and therefore declares that it is the policy of
the State to eliminate enclaves [ref 171.046(1) F.S.].
The provisions of 171.044 F.S. which states "Upon determination by the governing body
of the municipality that the petition bears the signatures of all owners of property in the
area proposed to be annexed, the governing body may, at any regular meeting, adopt a
non-emergency ordinance to annex said property and redefine the boundary lines of the
municipality to include said property."
The City has expressed an interest in annexation in the past, (ref 8-14-95 City
Commission meeting).
CONSIDERA TIONS:
. The owner of the subject property has requested annexation into the City.
· The applicant is the sole owner of the 17.41 acre property, but has provided
authorization to proceed with annexation to the contract purchaser, Joshi and
Associates.
. The City has expressed an interest in annexation in the past (ref 8-14-95 City
Commission meeting).
. The City has the capacity to service the property with sewer and water, as well as
provide the other urban services it currently provides to other areas of the City.
. The adjacent parcels owned by Schrimsher Properties on the east side and south
side of the intersection of Tuskawilla Road and S.R. 434 are indicated as
"Commercial" on the City's Future Land Use Map. The proposed annexation
parcels on the west side of the intersection are indicated as "Commercial" on the
County's Future Land Use Map. The County Enclave located across State Road
434 and South of the porposed annexation parcel is indicated as commercial and
office on the County Future Land Use Map.
. The adjacent parcels owned by Schrimsher Properties on the east side and south
side of the intersection of Tuskawilla road and S.R. 434 are zoned as C-l
"Neighborhood Commercial" on the City's Zoning Map. The proposed
annexation parcels on the west side of the intersection are zoned as A-I
"Agriculture" on the County's Zoning Map.

FINDINGS:

RECOMMENDA TION OF THE PLANNING & ZONING BOARDILP A TO THE CITY
COMMISSION:
The Planning & Zoning Board recommended to the City Commission the annexation of a 9.95
acre Kingsbury parcel into the city, based on the findings located in the document titled
Kingsbury Annexation (ANX-6-97).
NOTE:
The original request for annexation in September, 1997 did not include all of the
Kingsbury property.

STAFF.RECOMMENDATION TO THE CITY COMMISSION:
Staff recommends the City Commission approve the first reading of Ordinance # 685
based on:
1. The findings indicated above;
2. Previous expressions of interest by the City for annexation;

3. That it is consistent with the state policy of the Florida Legislature that, AThe
Legislature recognizes that enclaves can create significant problems in planning,
growth management, and service delivery, and therefore declares that it is the
policy of the state to eliminate enclaves.=.
4. The City has the capacity to service the property with sewer and water, as well as
provide other urban services it currently provides to other areas of the City.
5. The recommendation of the Planning and Zoning Board/Local Planning Agency
on September 17, 1997.
IMPLEMENTATION SCHEDULE:
The City Commission would hold a public hearing for second reading of Ordinance 685
on April 26, 1999 and adopt Ordinance 685 to annex the 17.41 acre parcel. Except as
otherwise provided in the City Charter, every adopted ordinance shall become effective
at the expiration of thirty (30) days after adoption or at any date specified therein.

SECTION IV - This prdinance shall take effect immediately upon adoption, in
