CODE tNFO~CEME~T BOARD CITY OF WINTER SPRINGS Upon a Hearing held on September 20, 1982: e ORDER OF THE BOARD Upon an offer by 7-11, acceptance of said offer by Mr. John Bennett, agreement of the Code Enforcement Board to the effect that an experiment be made, prior to further action in the matter, said experiment to attempt to cause the lighted point of sales siqn at 7-11 in Tuscawilla to be acceptable to Mr. Bennett, the Board decided as follows: e 1. The Board has proper jurisdiction over this matter. 2. The Southland Corporation, D/B/A 7-11 at Tuscawilla does not admit being in violation of the Code of the City of Winter Springs, Florida. 3. In order to attempt to correct the complaint of Mr. Bennett, 7-11 will modify the liqhting arrangement of the point of business siqn. 4. During the time of this test the siqn will remain unlighted. 5. When the adjustment of the sign is completed, the City will be notified. The City will then schedule the sign to be illuminated for two (2) consecutive nights. During this time the proper City officials will inspect for determination as to whether the sign is a11eqed1y in violation of the Code. 6. In the event the sign is found to be in compliance with the Code, the proper City official will authorize further illumination of the sign. 7. This test in no way prejudices the position of 7-11 or John Bennett to request further action of the Board. It is therefore ORDERED by the Board that: 1. 7-11 will immediately cause illumination of the sign to be terminated. 2. The proper City officials will aid and accomplish the tests as heretofor set out. 3. The proper City officials will authorize or deny the illumination of the-:si~n after the correction has occurred. 4. Neither party is prejudiced regarding further action before the Board.
