CODE ENFORCEMENT BOARD MEETING JANUARY 18, 1982 The Code Enforcement Board Meeting was called to order by Victor Suarez, Chairman at 7:00 p. m. Roll Call: Victor Suarez, Chairman, present Jay Alpert, present J. R. Hattaway, present Ben Kaplan, present Gary Hunt, present George Mahoney, present Lt. Bo Smart, Code Inspector, present Jack Cooper, Code Prosecutor, present Chairman Suarez welcomed new member George Mahoney. Motion was made by Kaplan, seconded by Alpert to approve the minutes of November 16, 1981. Discussion. All voted aye, minutes are approved. Chairman's Comments: Chairman Suarez suggested that a plaque of appreciation be given to the past Chairman Gary Hunt for his services on the Board. Chairman Suarez also asked that each member receive a certificate from the City in appreciation for their service on the Board. Introduction of new Code Inspector - Code Inspector's Calendar: Jack Cooper, Code Prosecutor, introduced the new Code Inspector, Lt. Bo Smart. The calendar of the Code Inspector was discussed. Mr. Alpert talked about some of the cases such as the barking dogs and the littering cases. Mr. Alpert questioned whether or not such cases come within the purview of the Code Enforcement Board based on the City ordinance. Mr. Hunt was of the opinion that all cases presented could be heard by the Board. Motion was made by Hunt that this Board accept and take into consideration all violations presented by the Code Inspector and Code Prosecutor. Seconded by Suarez. Discussion. In discussion, Mr. Alpert felt the Board should ask the City Commission if they want to change the ordinance to expand into those areas such as barking dogs, etc. Mr. Alpert had no objection to hearing those cases; he didn't know if the Board had the authority to hear such cases. Jack Cooper is to ask the City Attorney for a written legal opinion to clarify whether or not the Board should hear only those items specifically delineated in the ordinance and/or state statute or should the Board interpret the ordinance and state statutes broadly and hear all cases which constitute a violation of the Code. Vote on the motion: Alpert,no; Hattaway, no; Suarez, no; Kaplan, no; Hunt, yes; Mahoney, yes; motion failed. Potential contempt of an order of the Board - Gary Hunt: Lt. Smart said he had talked with Mr. Hunt and that there is progress being done; the work would be completed by the time it was ordered to be done. Mr. Hunt questioned the wording on the agenda; he said he had told the Board he would comply and he didn't feel that cases should be so pointed out. Mr. Cooper made a public apology. Mr. Cooper explained the only reason for putting that on the agenda . . . -.., .:- Code Enforcement Board Meeting, Jan. 18, 1982 Page 2 was to determine what the timing was, in conjunction with Item 7, regarding calling a special meeting of the Board. Mr. Cooper said that Item #6 has been brought into basic compliance with the order of the Board. Potential special meeting for Hearings: For special meetings the Board felt they could meet as stated in the rules of the Board on five days notice. Any items of emergency the Chairman would call all members to see if they could meet in one day's notice. Discussion of Code Inspector's procedures: The Board requested that the calendar be broken down into three categories: cases closed; cases pending and new cases. The Board also asked if the address could be removed and the Section of the Code that is being violated be shown. Motion was made by Alpert that Chairman Suarez and Hunt remain the Rules Committee for the next year. Seconded by Hunt. All voted aye. Motion carried. Meeting was adjourned at 8:08 p. m.
