REQUEST: The Community Development Department/ Code Enforcement Division
requests the City Commission set a date for a workshop to discuss
regulations regarding the parking of commercial vehicles in residential
districts. In addition, statTrequests direction as to the enforcement policy
of current regulations regarding parking commercial vehicles in residential
areas and instruct statT as to the policy in handling violations of this
regulation.
PURPOSE: The Community Development Department/ Code Enforcement Division
requests the City Commission set a date for a workshop to discuss
regulations regarding parking commercial vehicles in residential areas and
establish policy in connection with enforcement and outstanding violations.
APPLICABLE LAW AND PUBLIC POLICY:
Section 20-431 of the Code of the City of Winter Springs prohibits the
parking of commercial vehicles in residential areas. Section 20-432 of that
code defines which vehicles are considered commercial for the purposes of
this ordinance.
CONSIDERATIONS: At the February 15, 1999 workshop, statTpresented information
to the City Commission at its request concerning the current regulation
prohibiting the parking of commercial vehicles. An additional workshop is
needed to discuss the matter and make recommendations for any possible
changes. In the interim, statThas been instructed not to issue violation
notices for commercial vehicles parked in residential areas. Current
regulations prohibit parking commercial vehicles in residential areas. StatT
is asking when enforcement is to begin and to what extent. StatT also
needs direction in processing those outstanding violations of this
regulation.
RECOMMENDATION:
Staff recommends that the City Commission set a date for a workshop to
discuss regulations for parking commercial vehicles in residential areas.
Staff requests that the City Commission give direction for the enforcement
of the current regulations and instruction for handling outstanding
violations. The following is suggested:
1. Existing commercial vehicle violations will be forwarded to the
Code Enforcement Board with a staff recommendation that the item
be tabled until Sections 20-431 and 20-432 are revised.
2. New violations of commercial vehicle parking in residential areas
will be cited but not processed until further notice.
