REQUEST:
The Community Development Department-Code Enforcement
Division requests the City Commission consider the request of
Trisha Sherven, 417 S. Hawthorn Circle, to keep three dogs at
her residence until December 31, 1999 in accordance with City
Code section 4-2.
PURPOSE:
The purpose of this agenda item is to request the City Commission
consider the request of Trisha Sherven to receive permission from the City
Commission to keep three dogs at her residence at 417 S. Hawthorn Circle.
APPLICABLE LAW AND PUBLIC POLICY: Section 4-2 of the Code of the City of
Winter Springs states; "No household in the City shall own or contain more
than two (2) dogs and two (2) cats without the express consent of the City
Commission. Once permission is obtained from the city Commission,
additional dogs or cats may be maintained in the same household until such
time as a public complaint is registered against their domicile or
maintenance. The City Commission shall have the right to revoke the
granting of this special exemption as set forth above at any time."

CONSIDERATIONS: Ms. Sherven has requested permission to keep three dogs at her
residence. She was unaware of the regulation when she moved to Winter
Springs from Gainesville. Neither the Code Enforcement Division, nor the
Police Department have received complaints concerning the dogs. Ms.
Sherven has remarked that she intends to relocate in the late fall of this
year.
STAFF RECOMMENDATION: Staff recommends that the City Commission grant permission
for Ms. Sherven to keep three dogs at her 417 S. Hawthorn Circle
residence until December 31, 1999.

Dear Ms. Cook,
I am writing to request an appearance before the Winter Springs City Commission. The
purpose of my presentation is to ask permission for an exemption to Section 4.2 of the
City Code, the pet limit.
Right now I am renting the house, with my fiance, Dan Doskey, at 417 S. Hawthorn
Circle in Winter Springs. We own two dogs and are a foster home to a third. The third
dog is the last of the final litter of the two parents we own. We thought we had a home
for the baby, but it fell through. We recently moved to Winter Springs from Gainesville.
Gainesville has no similar limit to the number of pets people can have. That's why I am
both surprised and worried that I may be forced to get rid of the innocent little dog that
has no home. While I am still looking for an appropriate home for him, he has become a
cherished part of our family.
The dogs stay outside during the day and come inside at night. While I'm not sure what
their behavior is like when we're not there, they are very quiet and well behaved when
we are home. We are clean, quiet~ law-abiding citizens of the city. We are willing to do
whatever it takes to be permitted to keep t11e three animals.
We are respectfully asking for a few moments at the next possible City Commission
meeting to describe our situation and request an exception to the ordinance. We love all
three of the dogs and want them to be kept as a family as long as possible.
