REQUEST: The Community Development Department - Planning Division recommends the
Commission consider establishing a Business Retention Pilot Program for the
City.
PURPOSE:
The purpose of this agenda item is to inform the Commission that a meeting was held on
October 23, 1998 between the City Manager, Wayne Weinberg, President of the Greater
Seminole Chamber of Commerce, Tracy Grygiel of the Mid Florida Economic Development
Council and the Commerce and Industry Board to discuss a possible new role for its members. At
the meeting it was suggested that the commission consider establishing a Business Retention
Program for the City.
APPLICABLE LAW AND PUBLIC POLICY:
The provisions of Sec. 2-70 City Code which state in part "There is hereby created the City of
Winter Springs Commerce and Industry Development Board hereinafter referred to in this
division as the board. The purpose of the board shall be to recommend plans and work toward
attracting clean, nonpolluting commercial businesses to the City that are compatible with a high
quality oflife, culture and environment."
CONSIDERATIONS:
· The Commerce and Industry Board, through a letter dated August 27, 1998, from
Mel Glickman, Chairman, to the City Manager, requested a meeting to discuss the role of
the Board in the various activities of the City.

The City Manager attended the September 9, 1998 meeting of the Board to give his views
on the role and focus of the Board.

On September 14, 1998, the Commission discussed the future role of the Board.

On October 23, 1998, at the request of the City Manager, Tracy Grygiel of the Mid
Florida Economic Development Council and Wayne Weinberg, President of the Greater
Seminole Chamber of Commerce met with the City Manager and the Commerce and
Industry Board. The purpose of the meeting was to explore possible future roles for the
Board.

The Economic Development Commission has an effective ongoing Business Retention
Program which utilizes trained volunteers to call on businesses and complete a
questionaire designed to identify program areas. The survey results are referred to the
Economic Development Council for action.

It was suggested that a similar pilot program be established in Winter Springs on a trial
basis. The City's business retention program would be patterned after the established
Economic Development Commission's Volunteer Program. Training for volunteers will
be available through the Economic Development Commission in mid January, 1999.

If the Commission is receptive to the idea of a business retention pilot program, new
language will need to be prepared replacing in part Sec. 2-70 City Code, and a time frame
established to evaluate the effectiveness of the program.
FUNDING:
No funds required.
RECOMMENDATION:
. Staff recommends the Commission consider:
(1) Creating a new board whose principal function is to develop an ongoing
business retention program.

(2) Establishing a pilot Business Retention Program patterned after the Mid
Florida Economic Development Commission's program, and a time frame
to evaluate the effectiveness of the program.

(dl If the person cited fails to pay the civil pen-
lty within the time allowed, or fails to appear in
~ourt to contest the citation, he shall be deemed to
have waived his right to contest the citation and
.udgment may be entered against the person for
~n amount up to the maximum civil penalty not
to exceed five hundred dollars ($500.00).
(e) Any person who willfully refuses to sign or
accept a citation issued by a code enforcement of-
ficer or refuses to provide the information re-
quired in the citation shall be in violation of this
section and shall be prosecuted as a lnisdemeanor
of the second degree, punishable as provided in ~
775.082 or ~ 775.083 of the Florida Statutes.

Sec. 2.69,6. Citation contents,
The citation issued by the code enforcement of.
ficer shall be in a form prescribed by the city and
shall contain:
(1) The date and time of issuance.
(2) The name and address of the person to
whom the citation is issued.
(3) The date and time the civil infraction was
committed.
(4) The facts constituting reasonable cause.
(5) The number or section of the code or ordi-
nance violated.
(6) The name and authority of the code enforce-
ment officer.
(7) The procedure for the person to follow in
order to pay the civil penalty or to contest
the citation.
(8) The applicable civil penalty if the person
elects not to contest the citation.
(9) The applicable civil penalty if the person
elects to contest the citation.
nO) A conspicuous statement that if the person
fails to pay the civil penalty within the time
allowed, or fails to appear in court to con-
test the citation, he shall be deemed to have
waived his right to contest the citation and
that, in such case, judgment may be en-

tered against the person for an amount up
to the maximum civil penalty.

Sec. 2.69.7. Disposition of citations and civil
penalties.
(a) After issuing a citation to an alleged vio-
lator, the code enforcement officer shall:
(1) Deposit the original citation and one (1) copy
of the citation with the clerk of the circuit.
court;
(2) Provide the alleged violator with one (1)
copy;
(3) Deposit one (1) copy with city clerk; and
(4) Retain one (1) copy in the code enforcement
officer's department file.
(b) All civil penalties received by the county
court from violators of city codes or ordinances
shall be paid into the general fund of the city in
the penalty and fine account. All court costs shall
be retained by the clerk of the circuit court.

Sec. 2.69.8. Provisions supplemental.
It is the legislative intent of this subdivision to
provide an additional and supplemental means of
obtaining compliance with city codes and ordi-
nances. Nothing contained in this subdivision shall
prohibit the city from enforcing its codes or ordi-
nances by any other means.

Sec. 2.70. Created.
There is hereby created The City of Winter

Board hereinafter referred to in this division as
board. The purpose of the board shall be to rec-
ommend plans and work toward attracting clean,
nonpolluting commercial businesses to the city
that are compatible with a high quality of life,
culture and environment.
