Home My WebLink About1998 09 28 Consent Item C COMMISSION AGENDA ITEM C Consent Information Public Hearin Re ula r xx September 28. 1998 Meeting REQUEST: Community Development Department, Land Development Division, presents to the Commission for their approval, BFl's request to change the residential solid waste and recyclable collection days throughout most of the City. PURPOSE: The purpose ofthis Agenda Item is to present to the Commission for their approval the request ofBFI to change the residential solid waste and recyclable collection days throughout most of the City, effective October 5, 1998. APPLICABLE LAW: Ordinance no. 649 - An ordinance terminating the City of Winter Springs Solid Waste collection franchise agreement dated December 12, 1992 and awarding a new franchise to BFI effective March 1, 1997; providing for assignment, terms, conditions and severability. Exhibit" A", Franchise Agreement, Section II - Duties of BFI - BFI promises to perform its duties hereunder in a good and workmanlike manner and in strict compliance with the specification for the collection of Solid Wast and Recyclable Materials attached hereto as Exhibit "B" of Mandatory Solid Waste Ordinance No. 537 of the Winter Springs Code of Ordinances, and incorporated herein by reference as though set forth in full at this place, which specifications shall be binding on the parties hereto. September 28, 1998 CONSENT AGENDA ITEM C Page 2 Ordinance No. 537, Section 3(e) - The City's Franchisee shall have the authority to suggest such regulations governing the days and regulations for collection of solid waste and recyclable materials as it may deem necessary, and to suggest changes and modifications to such regulations to the City Commission, provided that such changes and modifications are not contrary to this Article and are in compliance with any applicable franchise agreement. FINDINGS: BFI proposes to reduce the number of curbside trips for the residents to a minimum of two (2) or maximum of three (3) because of this route change. There is to be no change of pickup day for yard waste. This will remain on Wednesday. BFI will furnish door hanger notices informing the residents of the route changes on Tuesday, September 29, 1998 and again on Saturday, October 3, 1998. BFI has requested that this change become effective on Monday, October 5, 1998. The changes suggested are not contrary to applicable law. There is to be no change in the commercial pickup schedule. RECOMMENDA TION: It is recommended that the City Commission approve the request ofBFI to change the residential solid waste and recyclable pickup days throughout most of the City. ATTACHMENTS: September 22, 1998 - BFI Letter to Commission - Information to be provided to residents - Maps depicting new route schedules COMMISSION ACTION: ID Bff September 22, 1998 City of Winter Springs Dear Honorable Commission, City Manager, Public Works Director and Staff: BFI Waste Systems seeks your approval in performing a route/service day change. This change is in effort to as always increase and ensure the high level of service provided to the City, and to our advantage, more strategically divide the City into zones so it may be supervised and collected easier. This change will affect roughly 6,000 residents, (please see attached door hangers, maps, etc.) and as a large incentive to those and the unaffected customers, reduce from what is now a possible 3-4 "trips to the curb" to a maximum 2-3 "trips to the curb" there by reducing the days that refuse is actually out for collection lending to a cleaner appearance of the community. Additionally, we will be making some upgrades to our fleet and increasing the number of units actually servicing the City, again resulting in a higher level of quality service. Lastly, this change will allow us to schedule the same personnel to service the City each and every collection thus resulting in a increased spirit of "Ownership" by our employees as their relationships build with your residents. This (2 independent notifications), should ease the adjustment, feel confident that we will make any collections needed through the first week of the change in order to get the community on track.
