CALL TO ORDER Chairman Thomas Waters called the Regular Meeting to order Thursday, June 5, 2003 at 7:00 p.m. in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). Roll Call: Chairman Thomas Waters, present Vice Chairman Jack Taylor, absent Board Member Gary Diller, present Board Member John Herbert, present Board Member Sharon Tackaberry, present The Pledge of Allegiance followed. II. CONSENT AGENDA CONSENT A. Approval Of The February 6, 2003 Regular Meeting Minutes. Chairman Waters asked the Members of the Board if there were any corrections to the Minutes and asked, "All those in favor accepting the Minutes as they are, say A YET' WITH CONSENSUS OF THE BOARD, THE MINUTES WERE APPROVED. MOTION CARRIED. III. REGULAR AGENDA REGULAR A. Request Of Mr. Jason Zinno For A Conditional Use Permit To Construct A 1728 Square Foot Accessory Building At 612 Tina Lane. Mr. John Baker, AICP, Senior Planner, Community Development Department introduced the Agenda Item. CITY OF WINTER SPRINGS MINUTES BOARD OF ADJUSTMENT REGULAR MEETING - JUNE 5. 2003 PAGE 2 OF 5 Mr. Jason Zinno, 612 Tina Lane, Winter Springs, Florida: spoke of his proposed plan to build a barn. Brief discussion. Mr. Chris Dunlap, 1054 Chokecherry Drive, Winter Springs, Florida: discussed the Ordinance; complained of run-off water from the applicant's property; and read a letter from Ms. Marilyn James [973 Sequoia Drive, Winter Springs, Florida]. Discussion. Ms. Carolyn Auerbach, 590 Dunmar Circle, Winter Springs, Florida: spoke in support of the applicant. Ms. Carolyn Reickel, 969 Sequoia Drive, Winter Springs, Florida: spoke her concern regarding cleanliness and possible flooding. Brief discussion. Mr. Mike Reynolds, 1052 Chokecherry Drive, Winter Springs, Florida: addressed his concern with additional fill dirt being brought in. Mr. Larry Decker, 1050 Chokecherry Drive, Winter Springs, Florida: asked that a close watch be kept concerning the impact of the building and the land. Ms. Marita Reed, 971 Sequoia Drive, Winter Springs, Florida: spoke of water concerns, dying fruit trees, and the fence. Mr. Stuart Auerbach, 590 Dunmar Circle, Winter Springs, Florida: addressed the Board in support of the barn. Tape IISide B Discussion. Mr. Zinno explained that heavy rains had caused water to encroach to his garage and asked for the City to help. Mr. Zinno added that he was going get a pump to pump it but the Florida Department of Environmental Protection told him "If I pump it out they were going to fine me a $1,000.00 a day. I wasn't allowed to take the water out of it. I was trying to solve the problem myself but I was cut off. They did come out there they showed that some of the dirt from the house pad had eroded into the lower area and I pulled out more than what they said to pull out of that area - put that road up and grassed it as a barrier so there would not be a problem with erosion anymore. I spent ninety days with the EPA going back and forth to appease everyone." Mr. Zinno additionally stated, CITY OF WINTER SPRINGS MINUTES BOARD OF ADJUSTMENT REGULAR MEETING - JUNE 5. 2003 PAGE 3 OF 5 "With regards to the barn I do not have any intentions of building a big mound there. That is high, it is dry, it has never had one bit of fill put on top of that area where I putting the barn and do not have any intention of doing it." Brief discussion. Mr. Baker said that he would address any flooding issues with Mr. Kip Lockcuff, Public WorkslUtility Department Director prior to the City Commission Regular Meeting scheduled for June 9, 2003. "I WOULD LIKE TO MAKE A MOTION THAT WE RECOMMEND APPROVAL OF JASON ZINNO'S CONDITIONAL USE TO CONSTRUCT A 1728 SQUARE FOOT DETACHED STRUCTURE, SPECIFICALLY A HORSE BARN, AT 612 TINA LANE; AND TO ENSURE THAT HE COMPLIES WITH THE GUIDELINES OF THE CITY OF BEING AT LEAST 200 FEET WEST OF OAK FOREST AND AT LEAST TWENTY-FIVE FEET [25'] FROM ANY WETLANDS AND THAT HE ADDRESSES THE OTHER ISSUES OUTLINED BY THE STAFF." MOTION BY BOARD MEMBER DILLER. SECONDED BY BOARD MEMBER HERBERT. DISCUSSION. VOTE: BOARD MEMBER HERBERT: AYE BOARD MEMBER DILLER: AYE CHAIRMAN WATERS: AYE BOARD MEMBER TACKABERRY: AYE MOTION CARRIED. REGULAR B. Request Of Mr. Paul Starks For A Conditional Use Permit To Construct An 875 Square Foot Accessory Building At 210 Arnold Lane. Mr. Baker presented his opening remarks regarding this Agenda Item. Mr. Paul Starks, 484 Wildfox Drive, Casselberry, Florida: briefly spoke of his plans for the building. Mr. Ralph Kruger, 235 East Tradewind Road, Winter Springs, Florida: questioned the location of the building in relation to the canal. MOTION BY BOARD MEMBER DILLER. SECONDED BY BOARD MEMBER HERBERT. DISCUSSION. VOTE: BOARD MEMBER DILLER: AYE CHAIRMAN WATERS: AYE BOARD MEMBER TACKABERRY: AYE BOARD MEMBER HERBERT: AYE MOTION CARRIED. IV. FUTURE AGENDA ITEMS Mr. Baker informed the Members of the Board that next month they will be addressing several "Sign Variance Applications". V. REPORTS No reports were given. VI. ADJOURNMENT Chairman Waters asked for a Motion to Adjourn. "SO MOVED." MOTION BY BOARD MEMBER DILLER. SECONDED. DISCUSSION. WITH CONSENSUS OF THE BOARD, THE MOTION WAS APPROVED. MOTION CARRIED.
