CALL TO ORDER Chairman Greg Smith called the Regular Meeting to order Thursday, May 2, 2002, at 7: 18 p.m. in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). Roll Call: Chairman Greg Smith, present Vice Chairperson Elizabeth Randall, present Board Member John Herbert, present Board Member Jack Taylor, absent Board Member Thomas Waters, absent The Pledge of Allegiance followed. Chairman Smith welcomed newest Board Member John Herbert. II. CONSENT CONSENT A. Approval Of The April 4, 2002 Regular Meeting Minutes. Chairman Smith asked for a Motion to approve the Minutes. "I MOTION THAT WE APPROVE THE MINUTES." MOTION BY VICE CHAIRPERSON RANDALL. SECONDED BY BOARD MEMBER HERBERT. DISCUSSION. WITH CONSENSUS OF THE BOARD, THE MOTION WAS APPROVED. MOTION CARRIED. III. REGULAR REGULAR A. Variance For Ms. Irene Clark 763 Sheoah Boulevard Section 6-2. (Compliance With Chapter). CITY OF WINTER SPRINGS MINUTES BOARD OF ADJUSTMENT REGULAR MEETING - MA Y 2, 2002 PAGE 2 OF 3 Mr. John Baker, AICP, Current Planning Coordinator, Community Development Department introduced the Agenda Item and stated, "Looking through the six (6) Variance criteria, we don't believe that it meets those six (6) criteria." Pictures of the present structure were circulated among the Board Members. Discussion followed regarding whether the City Code distinguished between a screened enclosure for a pool versus a screened enclosure without a pool; confirmation that the existing enclosure encroaches five (5) feet into the setback; the dimensions of the present enclosure; and the location of the proposed enclosure in relationship to the main structure and the property lines. Ms. Irene Clark, 763 Sheoah Boulevard, Winter Springs, Florida: spoke of owning her home for over twenty (20) years; adding the present dilapidated enclosure; submitted a "Petition" indicating support from the neighbors; and requested the Board to grant her the Variance. Discussion. Mr. Mike Montgomery, 756 Gretna Court, Winter Springs, Florida: addressed the Board in support of Ms. Clark; spoke of his plan to add an enclosure to his home in the future, thus he will be in the same situation; and remarked that the Code is so restrictive that you cannot improve your own property. Discussion followed regarding whether the Homeowner's Association agreed to the setback encroachment; whether a screened enclosure is considered a building or a structure; and the setback requirements for pools. Note: During the above discussion there was no formal review of the six (6) criteria required for the Variance. MOTION BY VICE CHAIRPERSON RANDALL. "I MAKE A MOTION THAT WE GRANT THE VARIANCE - WE ARE SENDING IT ON TO THE CITY COMMISSION FOR CONSIDERATION." SECONDED BY BOARD MEMBER HERBERT. DISCUSSION. CHAIRPERSON SMITH SUGGESTED "AN AMENDMENT TO THIS MOTION - THAT THE VARIANCE BE GRANTED UNDER THE CONDITION THAT YOU [MS. CLARK] - THE APPROVAL OF YOUR HOMEOWNER'S ASSOCIATION FOR THE ENCROACHMENT WiTHIN THE SETBACK." VICE CHAIRPERSON RANDALL SECONDED. DISCUSSION. Mr. Montgomery spoke for the record regarding neighbors supporting neighbors. VOTE (ON THE AMENDMENT): VICE CHAIRPERSON RANDALL: AYE BOARD MEMBER HERBERT: AYE CHAIRMAN SMITH: AYE MOTION CARRIED. VOTE (ON THE MAIN MOTION): BOARD MEMBER HERBERT: AYE CHAIRMAN SMITH: AYE VICE CHAIRPERSON RANDALL: AYE MOTION CARRIED. IV. FUTURE AGENDA ITEMS This Agenda Item was not discussed. V. REPORTS None. VI.
