HomeMy WebLinkAbout1996 06 06 Board of Adjustment Regular Minutes ~ BOARD OF ADJUSTMENT MEETING MINUTES JUNE 6,1996 The June 6, 1996 meeting of the Board of Adjustment was called to order by Chairman Greene at 7:00 p.m. ROLL CALL: Elizabeth Harrow, present James Greene, Chairman, present Al Becker, present Frank Adams, present Gregg Smith, present CITY OFFICIAL: D. LeBlanc, Land Mgt. Specialist Approval of Minutes of March 21. 1996: Chairman Greene asked if there were any comments or corrections to the minutes of March 21, 1996. There were no comments or corrections to the minutes of March 21, 1996. Smith moved to approve the minutes of March 21,1996. Seconded by Adams. Vote: All aye. Minutes stand approved as presented. - Request of Robert Fiorentini for Variances to Sections 6-219(a) and 6-219(c) of the Code of Ordinances, to allow a swimming pool (water's edge) to be closer than ten (10) feet from the rear property line, and the screen enclosure to be closer than seven (7) feet from the rear property line. The property is located in Winding Hollow Unit 2, Lot 113, Plat Book 48, Pages 85-88, Public Records of Seminole County (533 Saddlewood Lane). The subject property is zoned R-IA (One Family Dwelling District: LeBlanc gave his presentation. LeBlanc stated that all property owners within 150' of the subject property were notified by certified mail, return receipt; and a FAX was received on this date from Ron Saro who stated that he did not have any objections to the request. (Copy of FAX given to Board members) - Greene stated the Code calls for the water's edge to be no closer than 10 feet and the applicant is asking for it to be 7 feet; and the screen enclosure, by Code is to be no closer than 7 and the applicant is asking for 5 feet 4 inches. Greene stated the applicant is asking for three feet on the swimming pool and one foot, eight inches on the screen enclosure. Greene asked if there was anyone present who would like to speak against the request. There was no one present who spoke against the request. Greene asked if there was anyone present who would like to speak in favor of the request. I""""' Mr. Robert Fiorentini, property owner, spoke in regards to his request. Mr. Fiorentini stated that he and his home contractor and pool contractor were unaware at the time they initiated contract on the home that the pool that he and his family choose over shot the zoning ordinance. Board of Adjustment Minutes June 6, 1996 Page 2 that the issue of the two and three feet difference in the pool and screen enclosure, at that time is when he (Fiorentini) requested a variance. Discussion. Greene stated that the Board has granted these types of variances in the past, and normally when this was granted (normally) is when a house backed up to a green area. In your case you have an undeveloped lot behind your property, which makes it a different situation. Mr. Fiorentini stated that the property that is vacant behind his property, there are many trees left for a natural boundary and it appears that his request will not infringe on the privacy of the home to be on the vacant lot behind his property. There was question as to the rear set-back on the lot. LeBlanc stated that he believes that the rear setback in R-IA zoning is 25 feet. - Greene asked Fiorentini if he has looked at any other pool configurations which would meet the requirements. Mr. Fiorentini said yes he has and any that he has seen would have to be narrowed somewhat and after modifications, it would give the appearance of "a big bath tub" and in consideration of the amount of expense that the pool will cost, they would like to get the configuration that he and his family wanted. - Adams asked if there were any plans to put a privacy fence along the back property line. Mr. Fiorentini said he has had discussions with one of his neighbors and they talked about putting a fence along the back property line; and said that a fence is a strong consideration at this point. Smith stated that he recalls that the Board had a similar application by a property owner to get a variance and the Board had asked the property owner to go back and look at other options. Smith said that the Board knew that the property owner would probably not receive the most desired pool arrangement, nonetheless, the Board felt that there was a possibility that that pool could be configured and stay within the Code, that the Board would like to see that. Smith stated that personally that is his view point, that there are some options that need to be explored to try and fit within the 10 foot offset. There was discussion on this item. Mr. Byron Maddox of Signature Pools, also spoke in regards to the request and explained the situation. r Adams moved to grant the variance as requested. Seconded by Becker. Discussion. Greene said he would like some specifics in the motion and they are: that the screen enclosure be no closer than five feet four inches from the rear property line and the water's edge be no closer than seven feet to the rear property line. Adams amended his motion to state the specifics stated by Greene. Becker amended his second to approve the motion to include the specifics stated. Vote: Harrow: aye; Becker: aye; Greene: aye; Adams: aye; Smith: nay. Motion passes. ,"-" - - .r Board of Adjustment Minutes June 6, 1996 Page 3 Greene mentioned that he has been notified that his term expires in July and stated that by letter to John Ferring, Deputy Mayor, he is asking that he not be reappointed. Greene stated that he has held the position as Chairman for ten years and said that in his letter he mentioned that he has enjoyed his tenure and working with the Board and hopes that he has done something worth while and wished everyone luck.
