The pool was built in a utility easement and did not meet the setback requirements in place in 1975. The permit should have been denied for both reasons, in a utility easement and not meeting setbacks. It is evident that the owner of the property commenced the process of vacating the easement as far back as August 1978. But, for whatever reason, the process was not completed. ,II"'" The owner of the property at 625 Clearn Court became aware of these violations when he attempted to sell the property. The necessary width of the easement to accommodate the pool was vacated on August 28, 1995 and a variance for the setbacks was obtained on September 7, 1995. The owner, John D. Stibich, has requested a refund of all fees associated with having to vacate the easement and acquiring the variance. A total of$486.00 was paid to vacate the easement and to acquire a variance. I agree that a refund for the cost of the variance, $286.00, should be refunded. But, because the owner knew that the easement had to be vacated, the $200.00 should not be refunded. Stibich ave made request for variances to Section 6-219(a) of The Code ofOrdinanc ow a swimming pool (water's edge) to be located closer than ten (10) feet from the rear property line and ten and one-half (1 0 1/2) feet from the side property line. Section 6-219(a) reads: (a) No pool (excluding surrounding patio) shall be located closer to the side yard property line of the lot, parcel or piece of land upon which such pool is located than the distance required by the zoning ordinance of the city for side yards in the zone in which the property is located, plus three (3) feet, not less than ten (10) feet from the rear property line, ....." Note: The side yard setback for this property (located within the Highlands PUD) is seven and one-half (7 1/2) feet. All property owners within one hundred fifty (150) feet of the subject property have been notified by Certified Mail, Return Receipt Requested. The pool is located in a utility easement and the southerly eight (8) feet of the easement should be vacated by Ordinance at the Commission Meeting of August 28, 1995. This pool was permitted in December 1978 according to the attached information, provided by the applicant. City Records are not available for that time frame. Also attached are pool diagrams and a plat of the property. The property is located at 625 Clearn Court (Lot 3, The Highlands Section Four Tracts A&B Replat, Plat Book 21 Page 9, Public Records of Seminole County, Florida). This property was platted in 1959 under the guidelines of Seminole County. The property is zoned R-lAA (One-Family Dwelling District). The address of this property is 266 Morton Lane. WHEREAS, the City Commission of the City of Winter Springs, Florida, has deemed it in the best interest of the public's health, safety, and general welfare, that variances and special exceptions only be granted upon authority of the City Commission. NOW, THEREFORE, BE IT ORDAINED BY THE CITY CO!vfM.ISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS: SECTION L Sections 20-76 through 20-84 shall be amended to provide that the decisions of the Board of Adjustment, pursuant to section 20-82, shall be recommendations to the Winter Springs City Commission. The City Commission for the City of Winter Springs, Florida, shall be the final authority for granting or denying any request for a variance or special exception or any other request pursuant to Section 20-82. SECTION II. CONFLICTS. All Ordinances or parts of ordinances in conflict with any of the provisions of this ordinance are hereby repealed. SECTION III. SEVERABILITY. If any Section or portion of a Section of this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. EFFECTIVE DATE. This Ordinance shall become effective immediately upon its passage and adoption.
