Multiple-family, Residential Units in Neighborhood Commercial District
The applicant, Mr. H. Sabeti, has made request that multiple-family residential units be allowed as
a conditional use in a Neighborhood Commercial District as per Section 20-234 of the Code which
reads :
Sec. 20-234. Conditional uses.
a) Multiple-family residential units may be permitted as conditional uses as provided by the
board of adjustment.
b) Before a conditional use may be granted within the classification, the board of
adjustment must, after public hearings, find that the use of uses are consistent with the general
zoning and with the public interest.
The property where this conditional use is requested is the southeast comer of the intersection of
Moss Road and S.R. 419. A similar conditional use was granted on March 5, 1992 to build
quadraplexes at the intersection on Sherry Avenue and S.R, 419. Granting this conditional use
would mean a 100% usage of the property as quadraplexes.
The meeting is scheduled for December 1, 1994 at 7:00 P.M.

January 5, 1995
TIlls is a reminder of the upcoming Board of Adjustment meeting scheduled for January 5, 1995.
The Board will hear the request of :Mr. H. Sabeti for a Conditional Use which would allow
multiple-family residential units in a Neighborhood Commercial District as per Section 20-234 of
the Code, if approved. The meeting is scheduled to commence at 7:00 PJvf. You have previously
received the package for this request.
AI Becker has informed the Recording Secretary that he will be out of country on this date.
Therefore, to avoid another no quorum meeting, please make every effort to attend this meeting.
As previously requested, please assure that the Recording Secretary has your current work and
home telephone numbers.
NOTE: The Reverend Neil Backus has appealed the Board's denial ofhis request a Conditional
Use for a Church in RC-1 Zoning. This appeal will be heard by the City Commission at their
scheduled meeting of January 9, 1995.

RE: Notification to Board Members regarding meeting
of January 5, 1995
The beginning of December, Mr. Al Becker informed the Recording
Secretary he would be out of the country, and unable to attend the
January 5, 1995 B.O.A. meeting.
On December 21, 1994, Mrs. Adams called to say Mr. Frank Adams
would be out of state, and unable to attend the January 5, 1995
meeting.
Wendy Austin was contacted by phone on December 22, 1994. She
informed the Recording Secretary she would be attending the January
5, 1995 meeting; however, she will be submitting a letter of
resignation from the Board of Adjustment to the appointing
Commissioner.
Greg Smith was contacted by phone on December 22, 1994. He also
stated he would be attending the January 5, 1995 meeting.

Re: Appeal to Board of Adjustment Denial of Conditional
Use for a Church at 415 South Moss Road
Dear Property Owner:
The Reverend Neil Backus has appealed the decision of the Board of
Adjustment to deny his request for a Conditional Use to allow a
church within the RC-1 Single Family Dwelling District.
This appeal will be heard at the Commission Meeting scheduled to
commence at 7:30 P.M. on Monday, January 9, 1995.
