BOARD OF ADJUSTMENT MINUTES
June 18, 1992
The meeting was called to order at 7:00 P.M.

Adams motioned to approve the amended minutes of March 5, 1992. Seconded
by Heninger. Vote: all aye. Motion carried.
AEProval of Minutes of April 2, 1992
Becker motioned to approve the minutes of April 2, 1992. Seconded by Reid.
Vote: all aye. Motion carried.
ReSlllest of Von Jacobs Group, Inc. for a Variance to reduce the front yard
setback from 65' to 34', located at 749 Bear Creek Circle, zoned PUD
LeBlanc explained that the reason for the variance request is due to the
fact that most covenants in the Tuscawilla PUD have a clause that allows
the developer to grant variances. This subdivision, however, does not. The
front yard restriction is on the plat and that was why I.eBlanc convened the
Board of Adjustment to settle any title matters that may occur if this were
to be built less than 65' from the front. A similar variance was granted
next door to this location in February 1991.
Caroline Powell, representing the Von Jacobs Group explained that the Von
Jacobs Group has contracted through Tuscawilla Realty and Winter Springs
Development, to build a home on lot 29 of Bear Creek Estates. Since W.tnter
Springs Development is the current owner of the property, a letter
authorizing the Von Jacobs Group to serve as their agent to secure the
variance on lot 29, to amend the front setback from 65' to 34', was sent to
Mr. LeBlanc's office. (The actual setback on the plot plan is 35.38'.)
LeBlanc suggested, in his June 8, 1992 letter to the Board of Adjustment,
that the 35.38' be changed to 34', but be kept as close to 35.38' as possible.
Discussion followed regarding approval of the plans. The Homeowners
Association has approved the Von Jacobs Group plan as long as a variance
is approved by the City.
Becker motioned to approve the variance. Seconded by Heninger. Vote: all
ayes. Motion granted.
Meeting was adjourned at 7:25 p.m.
