Chairman, Present Harry Reid, Vice-Chairman.Present Richard Tiffany, Absent Frank Adams. Present Tim Johnson. Absent CITY OFFICIAL: D. LeBlanc, Land Dev. Coordinator AP~roval of minutes of November 2~, 1990: Reid made a motion to approve the m~nutes. Adams seconded the motion. All ayes. Motion carried. Request of City of Winter Springs for a Variance to Section 9-241(d) of the Code to allow a wet-bottom pond and a Variance to Section 9-276 of the Code to allow ~~~eng~_rkj.!!g space to be less than 200 square feet. LeBlanc said our Code allows for retention pond bottoms to be dry one foot above the high water table. The City is requesting a wet bottom pond. He said the Board has a letter from Ms. Nancy Kline with Gladding Lopez for the parking spaces. He said we're requesting to keep more pervious area and green area. That the parking slots be 18'xl0' instead of 20'x10,' the curb serving as a stop. He said it's better for maintenance etc.. The City Engineers approved the concept of a wet bottom pond and the small parking spots. Discussion. Reid made a motion to approve the request for a Variance to Section 9-241(d) to allow a wet bottom bottom pond. Adams seconded the motion. Vote on the motion. Motion carried. Adams made a motion to accept the Variance to Section 9-276 to allow a parking space to be less than 200 square feet. Reid seconded the motion. Vote on the motion. All ayes. Motion carried. Request of SALA. Inc. for a Condi tional Use to Section 20-234 of the Code to allow Multi-Family residential units within a Neighborhood Commercial District (C-l) and a VarIance to Section 20-211 of the Code to establish lot size and setback requirements for patio homes in this Multi-Family Dwelling District (R -=.l1 . LeBlanc said a lot of this area is C-1 fronting State Road 419, and R-3 between Moss and Sherry. He said there is no place that addresses the lot size or setbacks for patio homes and they arc reqllesting typical 50'x100' lot sizes. a minimum of 5,000 square feet. They asked for 20 feet setbacks front and rear and 5 feet on the side. Discussion. LeBlanc said that for patio homes there is no set side back requirement in the Code. Discussion. Mr. Sabeti. who is present to speak for the request. said they are looking for a single family lot with about 6 units maximum per acre instead of 12 units for Multi-Family. He said the houses would be about three bedrooms. two baths. 1,200 square feet with one or two car garages. The price range would be about $70,000 to $75.000. LeBlanc said this would meet the requirements for affordable housing that all cities have to have in their Comprehensive Plans. Discussion. Reid suggested their making the side yards ]0 feet apart instead of 5. Mr. Sabeti said he couldn't build the houses on that size lot. The houses will be about 10 feet apart. Sabeti said they would build a fence along the C-l area, and a wall around Sherry and 419. Adams questioned the spacing in regard to fire requirements. LeBlanc said the only requirements are the spacing of fire hydrants. He said if this is approved, he will not have any ingress-egress off of 419. It will be off Sherry Avenue.. Greene asked about putting swimming pools in. Sabeti said he was not planning to put any in. Greene asked about any problems with the Fire Department. LeBlanc said all these problems will be addressed when the plans are submitted to the City for review. Le Blanc said the streets will have to be built to City standards. He said that is in the Code now. Greene asked about side setbacks on corner lots. LeBlanc said we don't have any setbacks with this type housing. Discussion. Sabeti said these plans are preliminary. LeBlanc said these streets will be City standard - 50 feet right-of-way. He said there will be a Homeowner's Association. They will be responsible for the wall. Greene questioned the fact that if you go 5 feet to the street, you will be too close to the street on corner lots. He said he thinks we need 12 to 15 feet. LeBlanc said there are 2,600 feet that you can't build on. Public input was positive for the building of the homes. Discussion. Reid said he felt it should have some restrictions put on it to make it a nice area. Discussion. Greene asked about sidewalk requirements. LeBlanc said according to Code all subdivisions must have sidewalks. LeBlanc said he will have to meet all requirements. He said that if the Board decides to grant his request, that only allows him to start on site plan, then Staff has to go through the review process. Discussion. Discussion about size of corner lots. Greene asked if Sabeti would accept another 15 feet of setback. Sabeti said he would accept 12 1/2 feet. Greene said he felt that would be sufficient. Discussion. LeBlanc said we require fences for subdivisions. He said we will also have the developer dedicate to the City the ingress-egress routes for those lots bordering each exterior street (like 419, Sherry and Moss). Discussion. Reid said he feels we are creating a "mini" R-IA. LeBlanc said we are establishing setbacks for patio homes within an R-3 zoning area, which is not addressed in the Code. Discussion. The Board asked if we grant the use of these smaller sized lots for patio homes, do all other conditions for R-3 apply to what Sabeti does on this property. LeBlanc said yes. Greene said why not say the side setback is 5 feet, the front setback is 20 feet, and no house will ever be built closer than 12 1/2 feet on corner lots. Mr. Sabeti said he was in agreement. Discussion. Reid said to limit it to no more than 6 houses per acre, and no more than 40 percent lot coverage with structure. Adams made a motion that we grant the requested Conditional Use of C-1 and the Variance in R-3 as proposed to include the following: in noted conditions that all sideline setbacks to all streets be greater than or equal to 12 1/2 feet, and front setbacks be as proposed but no house can be built closer than 12 1 feet to the street on the side of the house and that the condition of no greater than 6 units per acre be placed, and also the condition that lot coverage not Board of Adjustment Minutes January 3, 1991 Page 3 be more than 48 percent for the structure. These conditions are for the whole project. Reid seconded the motion. Vote on the motion. All ayes. Motion carried. Greene said the Variance is granted with the conditions stated.
