BOARD OF ADJUS1MENT MINUTES
June 7, 1990
The meeting was called to order at 7:00 P.M.

Approval of Minutes of April 5, 1990:
Greene asked if there were any additions or objections, none appearing, the
minutes stand approved as subnitted.
Request of Florida Land Company, for a Variance to Section 9-241(d) of the Code
to Allow a Retention/Detention Pond Bottom Elevation to be Less Than One (1)
Foot (12 inches) Above the Seasonal High Ground Water Elevation. The Property
is Located East of the Terminus of MacGregor Road and North of Edgemon Avenue
(Undeveloped Property wi thin the Highlands PUD). The Zoning is PUD
LeBlanc stated that the Board has received the packet regarding this request.
He stated that Mr. Chancler and Mr. McBridie, representatives of Florida Land
Company, are present for any questions.
ChancIer stated that this property is ten acres within the Highlands PUD and
zoned for twelve units per acre. Due to the market conditions and the
adjoining property, we are combining with the other property owners to the
south of this property to have a joint multi-family.project. We are proposing
to do a zero lot line, single family project with 38 to 39 units on the ten
acres. The stormwater facilities will be located central to the project. A
connector road would be installed on the eastern boundary which is Shepard
Road. We are requesting a variance to install a wet bottom retention pond, for
several reasons; one being the character and nature of the property and second
with the design of the property this will only impact this project and will not
impact any other property. Next to this property the property owners, Newlando
Inc., plan a multi-family project, to the east there is a buffer strip next to
the McAsphal t Company and an RV Storage area, and to the North is the City
owned percolation ponds. .
Our engineers has designed the ponds to acconnnodate the City stormwater in that
area.
Chancler stated that with this type of wet bottom pond would benefit everyone.
He stated that the Highlands Homeowners Association and Kitty DeGrenier have no
objections to this type of pond.

Greene asked about a fence. Chancler stated that the slope will be 6: 1 which
does not require a fence.
Johnson asked heM much water is anticipated to be in the pond at all times.
Chancler stated that there would be about ~ feet of water in the pond during
the high season. Johnson asked if this ~uld be a safety problem. ChancIer
stated that there will be no homes backing the pond and this ~uld be a small
ameni ty to the homes. The homeowners association will be responsible for the
maintenance of the pond.
There was discussion about a fence around the pond. Kozlov stated that if the
slope was 2:1 then there is a need for a fence, but if the slope is at least
4: 1 then no fence is required. Kozlov stated that this issue will be address
in the engineering when this is subnitted to the City for review.
Donnelly moved to approve the request of Florida Land Company. Seconded by
Tiffany. Vote: All aye. Motion carried.
