BOARD OF ADJUS'IMENT MINUTES
September 7, 1989
The meeting was called to order at 7:00 P.M.

Approval of Minutes of Auqust 3, 1989:
Greene asked if there were any objections or corrections to the minutes of
August 3, 1989. There were no objections or corrections to the minutes of
August 3, 1989. The minutes stands approved as submi tted.
Request of MZL Partners for a Variance to Section 9-241 (d), to allow side
slopes of a retention/detention basin steeper than two and one-half (2 1/2)
feet horizontal to one (1) foot vertical. The property is zoned C-2 (General
COJ!llll~.:rcial and Ind}1Strial District) and i~ le>qlted ad.E!.~~nt to 125~L~1l ~ven~_~
LeBlanc gave his presentation. He stated that the applicant is expanding the
business and the second phase will be a mirror image of the first phase. The
applicant would like to have the retention pond be allowed to have vertical
slopes and have a wall as the fence just as the first phase has.
Reid asked what was the purpose of the slope. Kozlov stated that safety is the
purpose of the slope. He stated that if anyone fell into the retention pond
the slope allows someone to climb out.
Jay Alpert, owner/developer, was present to speak for his request.
Alpert stated that he and his partner feel that the retention/detention of the
first phase is aesthetically pleasing and safe, so they would like to repeat
the same design, but the City's Code has changed since the first . phase was
buil t .
Alpert showed the Board pictures of the present retention pond. He stated that
there is a fence around this pond and has a minimum height of six foot and is
higher in some places. The fence has tines that are no more than four inches
apart.
Alpert also stated that he has spoken with the Building Official, the Fire
Marshall and the Police Chief, and these people expressed that they didn I t have
any problem with the fence. Alpert added that the fence was made of industrial
al umimun.
Alpert stated that the perk time for the present retention pond is about two
hours after a rain, and there is never any more than sixteen inches of water in
the pond and is gone wi thin two hours.
