BOARD OF ADJUS'1MENT MINUTES
August 3 1989
The meeting was called to order at 7:05 P.M.

Approval of Minutes of July 6, 1989:
Reid moved to approve the minutes of July 6, 1989. Seconded by Tiffany. Vote:
All aye. M:ltion carried.
Election of Chairman and Vice-Chairman:
Reid moved to keep the chairman and vice-chairman as is. Seconded by Tiffany.
Vote: All aye. Motion carried.
Request of Wellington Developments for Variances to Section 6-219(a) arrl (c) of
the Code. To Build SWimming Pools wi thin Ten (10) Feet of the Rear Property
Lines and Screen Enclosures wi thin Seven ( 7) Feet of the Rear Property Lines.
The Properties are Zoned Planned Unit Development and are Located at: 1348
Augusta National Boulevard, 1050 Pebble Beach Circle East and 1054 Pebble Beach
Circle East.
Greene stated for the new members that the Board had seen a similar request in
January and February of this year. The City ordinance states that pools be no
closer than ten feet to the property line and this is why these fall into the
jurisdiction of this Board. Each of these properties backs up to a ccmmon
green area, or golf course~ and is not backed up to any additional residential
property and is the reason the Board granted the requests in January and
February.
LeBlanc stated that Mr. Robert Bland, President of Wellington Developnents, is
present to speak on the requests.
Bland stated that they are building homes in Country Club Village in
Tuscawilla. He stated that all of these lots back up to a greenbelt arrl the
greenbelt goes 75 feet to the creek. The side yard requirements are met and
don I t infringe on anyone. He asked the Board to consider the requests as it
lets the developer build a nicer product.
Green asked if the sale of the homes is pending on whether there is a pool or
not. Bland stated that they would probably lose' the sale if there was no pool.
Green also asked about the screen enclosure on lot 150, that this is two to
three feet beyond the side wall of the home. He stated that this is not
allowed in other parts of Tuscawilla.
Bland stated that the lot is pie shaPed and is long in the back. He stated
that this has been signed off by the Architectural Review Board of Tuscawilla.

Green stated that he noticed that the builder has brought in a considerable
amount of fill dirt in order to build the pool on lot 152. He asked what the
builder intends to do about lot 223 as the back property line is about four to
five higher that the patio slab. Bland stated that they will build a retaining
wall on the property line.
There was question on the green area. Bland stated that the green area is a
dedicated permanent drainage area.
Reid asked if this Board will see any more of these applications for a variance
on the pool setbacks. Bland stated that unless there was an absolute
compelling reason that justifies another variance, he stated that he would not
came back in front of this Board for a variance for pool setbacks.
Johnson asked if there would be a problem in the future with the developnent
abutting the greenbelt. Green stated that this greenbelt has been dedicated as
a greenbelt area.
There was discussion on these requests.
The Board decided to handle each request individually.
Green moved to grant the request for a variance on lot 223 with the stipulation
that there be a minimum of a three foot clearance between the screen enclosure
and any retaining wall that is built. seconded by Tiffany. Vote: All aye.
Motion carried.
Tiffany moved to approve the request for a variance on lot 150 as proposed.
Seconded by Reid. Discussion. Johnson stated that he would like to see this
at least three feet from the property line. Discussion. Tiffany amended his
motion to approve the request with the modification that the outside edge of
the pool be a straight line and the bell shape be moved to the inside, with the
paving three feet from the property line and the pool be six feet from the
property line. Seconded by Reid. Vote: All aye. Motion carried.
Tiffany moved to approve the request for a variance on lot 152 with the
stipulation that the design of the retaining wall be one foot from the property
line and that the retaining wall be the base for the screen enclosure and also
have landscaping at the base of the retaining wall. Seconded by Reid. Vote:
Reid: aye; Green: aye; Tiffany: aye; Johnson: nay. Motion carried.
The meeting adjourned at 7: 43 P.M.
