LeBlanc, Land Development Coordinator Approval of Minutes of October 2, 1986: Reid moved to approve the minutes of October 2, 1986. Girda. Vote: All aye. Motion carried. Seconded by Request of R.B. Kite-Powell, Jr., for a Special Exception to Section 44.55 (1) to reduce the setback on Fairfax Avenue from 25 ft. to 0 ft. and a Special Exception to Section 44.51 (2) to reduce the side setback adjacent to a residential lot from 30 ft. to 0 ft. on property in Zone C-l; Lot 2 and Northern portion of Lot 3, Second replat of Block 5, 61: Tract "All, North Orlando 2nd Addition, Plat Book 16, Page 18 (east side of Fairfax Avenue just south of S.R. 434): R.B. Kite-Powell, developer, was there to speak for his project. He stated that this project was presented to the City several months ago, the previous developer had the City approval for this project. He stated that the previous developer has withdrawn from this project and he has taken over. He stated that the request is for 0 ft. setbacks, to be able to continue the building around the property and not jog into the property as previously proposed. Al Land, Land Engineering, was there to speak for the development. There was discussion on the buffer area around the property. There was also discussion on the property surrounding this project. It was determined that there is Multi-Family on one side of the property, and there is a single family residence on another side of the property. There was question on a buffer between the Multi-Family property and single family property and the development. LeBlanc stated that the surrounding property was zoned R-1A and C-l. He also stated that there is a cul-de-sac located on this property and has been requested to be vacated, and also stated that he has not walked the property and has no knowledge of what is surrounding it. There was question on the distance between the wall and the street, and the height of the wall. It was determined that the distance from the wall and the street will be about 11 ft., and the height of the wall will be 8 ft. Joseph Hage was there to speak on the development. Greene stated that this request is two separate matters and the Board will vote separately on the two requests. , '" r-- ,..-...,. Board of Adjustment Minutes May 1, 1981 Page 2 Kessler moved to deny the request for a Special Exception to Section 44.51 (1) to reduce the setback on Fairfax Avenue from 25 ft. to 0 ft. Seconded by Reid. Vote: All aye. Motion carried. Kessler moved to deny the request for a Special Exception to Section 44.51 (2) to reduce the side setback adjacent to a residential lot from 30 ft. to 0 ft. on property in Zone C-1. Seconded by Reid. Vote: All aye. Motion carried. Greene stated to Kite-Powell that he has the right to appeal the decision of the Board of Adjustment that any person, or persons, jointly or severally, aggrieved by any decision of the Board of Adjustment may, within thirty days after the filing of any decision in the office of the Board of Adjustment, but not thereafter, apply to the City Council for administrative relief, After a hearing before the City Council, an aggrieved party may, within thirty days after the decision of the City Council, file an appeal with a court of competent jurisdiction over the subject matter. LeBlanc asked the Board if they could call a Special Meeting on May 21, 1981, as he has an item to bring before the Board. There was discussion on the Special Meeting.
